RESOLUTION OF APPLICATION OF THE COUNCIL OF THE
CITY OF BAKERSFIELD PROPOSING PROCEEDINGS FOR
ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 290
(WIBLE NO. 5).
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 35140 of the Government Code of the State of California.
NOW, THEREFORE, the Council of the City of Bakersfield
hereby resolves, finds and determines as follows:
1. That the City of Bakersfield hereby proposes the
annexation to the City of Bakersfield of the territory described
in Exhibit "A", attached hereto and made a part of this resolution
as though fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a part
of this Resolution as though fully set forth herein.
3. That a Plan for providing Services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 35102 of the Government Code, is marked
as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is made pursuant to the Municipal Organization
Act of 1977 (Part 2 of Division 2 of Title 4 of the Government
Code of the State of California, commencing with Section 35000
thereof), and it is requested that proceedings be authorized for
annexation in accordance therewith.
5. That the reasons for the proposed change of organization
are that the owners of the affected territory desire to receive,
and in some instances already are receiving, municipal services
tax
from the City of Bakersfield, and the City desires to receive
revenues for benefits given and to be given to the territory
proposed to be annexed.
6. That zoning upon annexation of Wible No. 5 will
allow the same uses as presently existing in the county.

III.
What effectS, if any, .,ould annexation of this terri~..y have on existing level
of city services {i.e., need for additional emergency service personnel or con-
struction of new facilities, etc.)? The annexation of this territory will not
affect the near term level or capability of the City to provide needed services.
IV.
Would city require any upgrading or change in facili{ies to serve affected terri-
tory (roads, fire hydrants, mains, etc.)? If so, would city or residents be
responsible for financing? No. The primary structure. a Gemco department store
has been operatinq for over one year, and three adiacent or nearby
consisting of retail shops have been completed or are under construction in accord-
ance with County P-D (Precise-Development) plans. Future construction (3 additional
structures) will probably occur under County inspection prior to actual annexation.

Indicate and exp'lain existing zoning in affected territory. See attached Zoninq
Map 12~-1. The entire properties are zoned-C-2 P-D (Commercial with Precise-
Development).

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc.) The Bakersfield Metropolitan Area General Plan designates
approximately one-half of the site as Commercial with the northern half as Low-
Density Residential. In order to accomplish PrezoninQ consistent with approved
County development it will be necessary for the City to undertake a Land Use Element
Amendment to Commercial use for the part not currently desigdated as Commercial.
It is expected that a concurrent General Plan Amendment and pre-zoning ~rocedure
will be submitted to the City Planninq Commission in April, 1984. An Initial Study
wil-1 also be prepared proposinq an appropriate CEQA (environmental) document on
both actions.

List city services that area will directly or indirectly benefit from such as
decrease in fire insurance rate, shorter emergency response time, use of com-
munity facilities, et. City police may be able to respond in a more timely
manner than present County Sheriff and State Highway Patrol Services. The
current City Police standard is 1.65 sworn officers per 1,000 population
comparied to the County standard of 1.15 officers. It is estimated that the
terriroty will benefit by reduced refuse service costs and sewer user charges.
Please provide the following information relative to city and county taxes:
List existing tax rate(s) in area. There is little difference in taxes to be
accrued to the County or City due to annexation. Proposition 13 set a one
percent of market value limit on the general local government property tax.
The existing representative property tax rate is 1.061215 percent per market
value. With annexation theCity will assume payment for community service
areas (CSA's) providing street lighting, fire hydrants and school crossing
guards. The City's Municipal Improvement Bonds, Series A and B will add
$8.72 per $100,000.00 of assessed value upon annexation. The present
assessed value as listed by the County Assessors Office for land and improve-
ments is $7,989,708.00 which would result in an additional tax of $696.54.

PLANNING COMMISSION REVIEW OF WIBLE NO. 5 ANNEXATION LOCATED
ON THE EAST SIDE OF WIBLE ROAD APPROXIMATELY 600 FEET NORTH
OF MING AVENUE COMMONLY KNOWN AS THE GEMCO COMMERCIAL DEVELOP-
MENT.
Two letters received by the City Council regarding annexation
of the Gemco Commercial Development site located on the east
side of Wible Road approximately 600 feet north of Ming
Avenue. The letters from two of the three property owners
(Bakersfield Investors and Ming-Wible Associates Limited
Partnership, copies attached) indicates "no objection" to
the annexation of'11.33 acres defined in Parcel Map 6617
(see attached map) with adjacent Wible Road right-of-way.
The primary development is a 102,400 square foot single level
Gemco Department Store. Three additional commercial struc-
tures have been constructed at peripheral locations on the
site. They have not been completed at this time (see
notations on map). Two other buildings will be constructed
along Wible Road frontage. A pad is available for a sixth
building in the southwest corner of the site. There are 590
parking spaces. The total project area is 12.29 acres
which includes a southern portion of the parking lot already
within the City of Bakersfield. Three small sumps have been
developed along the east project boundary to accommodate
runoff. A masonry wall prevents through access to Kingsley
Lane. Utilities are undergrounded. The property is
designated for both commercial and low density residential
use on the Bakersfield General Plan Land Use Element. A
Land Use Element Amendment and prezoning should be initiated
to reflect the existing and approved development of the
site prior to annexation. The property is currently zoned
C-2 P-D (Commercial with Precise-Development) by the County.
The P-D plan for all improvements, including landscaping,
was approved by the Kern County Planning Director in May,
1982 and the Parcel Map for seven lots was recorded on
May 27, 1983.
RECOMMENDED ACTION:
Recommend that the City Council initiate the annexation
process for Wible No. 5 finding the proposal within both
City of Bakersfield sphere of influence and General Plan
boundaries and initiate a Land Use Element Amendment to
reflect approved and existing commercial development.
