HomeMy WebLinkAboutRES NO 15-84RESOLUTION NO. 15-~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD AMENDING THE HEARING PROGRAM FOR AMENDMENTS TO MANDATORY ELEMENTS OF THE GENERAL PLAN AND RESCINDING RESOLUTION NO. 21-77. WHEREAS, pursuant to Section 65351 of the California Govern- ment Code, the Council of the City of Bakersfield adopted Resolu- tion No. 21-77 on the 21st day of March, 1977, adopting a systematic program for the amendment of mandatory elements of the Bakersfield Metropolitan Area General Plan three times each calendar year; and WHEREAS, Section 65361 of the Government Code has been amended by (Chapter 1250, Statutes of 1983) to allow an additional, fourth amendment each calendar year to any such mandatory element; and WHEREAS, the public interest would be better served by having a fourth opportunity each calendar year to have proposed amend- ments to such mandatory elements heard and considered; and WHEREAS, the Planning Commission has recommended by its adop- tion of its Resolution 1-84 that the hearing program for amend- ments to the mandatory elements of the general plan be amended; and WHEREAS, it is necessary to maintain a systematic program for amendments to such mandatory elements in order to avert the possibility that the maximum number of amendments would be heard and considered early in any calendar year, thereby fore- closing consideration of additional amendments for more than three months; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAKERSFIELD that the following program be and hereby is adopted and shall become effective May 1, 1984 for amendments to the mandatory elements of the Bakersfield Metropolitan Area General Plan. -2- 1. The Planning Commission shall conduct its hearings of proposed amendment to the mandatory elements of the Bakersfield Metropolitan Area General Plan on a quarterly basis during the months of March, June, September and December of each year. 2. Proposed amendments to any mandatory element of the general plan shall be consolidated and considered as segments of one amendment and processed as one amendment to such element in accordance with law. 3. The City Council shall conduct its hearings as soon as possible after receipt by the City Clerk of the record of proceedings and recommendations by the Planning Commission. 4. The Planning Commission is authorized to deviate from the above program for any particular mandatory element for good and sufficient reason, provided the intent and purposes of this resolution are served. 5. The schedule set forth by this Resolution shall not restrain the Planning Commission from hearing and recommending adoption or amendment of permissive elements of the general plan, from hearing and making recommendations for adoption or amendment pursuant to Section 65361(b) of the Government Code relative to the development of residential units for families of low or moderate income, or amendments required to comply with court decisions pursuant to Section 65754 of the California Government Code.
