HomeMy WebLinkAboutRES NO 12-84RESOLUTION NO. 12-84 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGMENT V OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 2-83). WHEREAS, the Council of the City of Bakersfield referred Segment V of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, in accordance with Code, held a public hearing on December 15, 1983, on Segment V of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment V of the proposed amendment to the Bakersfield Metropolitan Area General the Land Use Element of Plan is as follows: Study was project SEGMENT V: the Planning Commission of the City of Bakersfield, the provisions of Section 65351 of the Government WHEREAS, for the above-described Segment, an Initial conducted, and it was determined that the proposed would not have a significant effect on the environment, JEWETT LANE PARTNERSHIP has applied to change the land use designation on 12.7 acres located east of "K" Street and west of Jewett Avenue between 38th Street on the south and 40th Street right-of-way on the north from Industrial to High Density Resi- dential (17 to 45 dwelling units per gross acre), as shown on map. Final site plan approval will include design revisions regarding access and parking to encourage traffic usage of "K" Street and Jewett Avenue for principal exit to Columbus Street and 34th Avenue. Access to North Chester Avenue shall be discouraged at 40th Street. that mitigation measures included in the project description above and agreed to by the applicant would avoid the effects or mitigate the effects to a point where clearly no significant effects would occur, and there is no substantial evidence before the City that the project as revised may have a significant effect on the environment and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepara- tion and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 132-83 have been duly followed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 86-83 on December 15, 1983, the Planning Commission recommended approval and adoption of Segment V by this Council; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearinq on January 18, 1984, on the above-described Segment V of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield California, a newspaper of general circulation. NOW, THEREFORE, BE IT HEREBY RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment V is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 2o 4. The City Council hereby approves and adopts the above-described Segment V of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan. 5. That this Segment V of the proposed amendment to the Land Use Element be combined with other segments approved and adopted by this City Council, as set forth in separate resolutions, to form a single Land Use Element Amendment, 2-83. .......... o0o ..........
