HomeMy WebLinkAboutRES NO 26-84RESOLUTION NO. 28-84 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD SUPPORTING SENATE BILL 575 (TORT LIABILITY - LIMITS ON JOINT AND SEVERAL LIABILITY) WHEREAS, under present tort liability laws in the State of California, a party which is found 1% responsible for plaintiff's injury can be held responsible for payment of 100% of plaintiff's damages; and WHEREAS, the City of Bakersfield's self-insurance program can be put in jeopardy by the present tort liability rules; and WHEREAS, Senate Bill 575 proposes to limit a defendant's liability so that a defendant is only liable for a percentage of responsibility for noneconomic damages such as pain and suffering; and WHEREAS, Senate Bill 575 does provide a greater degree of equity than currently exists; and WHEREAS, without the passage of Senate Bill 575 the City could be exposed to hundreds of thousands of dollars of unjustified liability. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that the City supports Senate Bill 575 and urges the State legislature to adopt Senate Bill 575. .......... 000 ..........
