A RESOLUTION DECLARING REAL PROPERTY
SURPLUS TO THE NEEDS OF THE CITY AND
AUTHORIZING THE FINANCE DIRECTOR TO
NEGOTIATE ITS SALE
WHEREAS, the City owns a fee simple interest in property north of Mall View
Road, east of the East Hills Mall; and,
WHEREAS, Gardens At East Hills, LLC, a California limited liability company
has requested the City sell this property described in Exhibit "A" and shown on Exhibit
`B" attached hereto to facilitate its new commercial development.
WHEREAS, Planning Department has found the sale of this property to be
consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government
Code Section 65402.
WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale
of City property deemed to be "surplus".
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:

The foregoing findings and recitals are true, correct, and incorporated
2. Real Property located north of Mall View Road, east of the East Hills Mall is
hereby declared surplus to the City's needs and the Finance Director is authorized to
negotiate its sale. The real property is more fully described in Exhibits "A" and "B"
attached hereto and incorporated as though fully set forth.

A parcel of land situated in a portion of the Northeast Quarter of Section 22, T. 29
S., R. 28 E., M.D.M. Said Parcel also being a portion of and wholly contained
within that parcel described in Director's Deed 72894-01-01 dated October 1989
and more particularly described as follows:
Commencing for reference at the north quarter corner of said Section 22;
Thence (1), along the west line of the N.E. Quarter of said section, SO°21'42"E.,
599.44 feet to the northerly boundary line of the land described in the deed to W.
R. Parker, et al, n~corded August 3, 1972 in Book 4707 at page 125, Kem County
Official Records, said line also being the northerly boundary of Parcel Map No.
8267 filed in Book 35 of Parcel Maps at Page 183;
Thence along said northerly boundary, also being the southwesterly boundary of
the land described in the deed to the State of California, recorded June 30, 1964
in Book 3740 at page 623, Kem County Official Records, the following courses:
(2), N79°42'11"E., 2.23 feet; (3), N89°53'51"E, 442.30 feet; (4), S61°03'34"E,
118.82 feet; (5), S61 °01'52"E, 127.49 feet; (6), S81 °03'53"E, 23.19 feet to a point
on the northerly boundary of that parcel described in said Director's Deed 72894-
01-01;thence along the north boundary of said paroel: (7), N34°23'39"E, 187.86
feet; (8), S88°18'03"E, 460.51 feet; and (9), S85°48'18"E, 37.90 feet to the
TRUE POINT OF BEGINNING;
THENCE (10), continuing. along the northerly boundary of said parcel described
in said Director's Deed 72894-01-01, S85°48'18"E, 502.06 feet to a point;
THENCE (11), along said northerly line, S81 °39'25"E, 94.35 feet to the northeast
comer of said panel;
THENCE (12), along the easterly line of said parcel, S24°39'42"1N, 365.42 feet to
the southeasterly comer of that parcel described in said Director's Deed 72894-
01-01;
THENCE (13), along said southerly boundary line S89°17'34"VU, 470.12 feet to a
point;
THENCE (14), departing from said southerly boundary line N04°11'45"E, 389.35
feet to a point on the northerly boundary of said panel described in Director's
Deed 72897-01-01 which is the TRUE POINT OF BEGINNING.

The above described parcel contains 4.49 acres, more or less.
There shall be no abutter's rights of access appurtenant to the above described
real property in and to the adjacent State freeway.
Reserving unto the State of California on the deed parcel the right of drainage
conveyance through pipeline(s) and on the remaining parcel, the perpetual right
and easement to discharge any and all drainage water thereon accumulating
from that portion of the adjacent and adjoining freeway right of way for State
Route 178, between Haley Street and Fairfax Avenue.
