HomeMy WebLinkAboutRES NO 213-08RESOLUTION NO. 2 1 3 ~ A RESOLUTION DETERMINING THAT THE HAZARDOUS MATERIALS RESPONSE VEHICLE CANNOT BE REASONABLY OBTAINED THROUGH THE USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFOR, NOT TO EXCEED $546,234.00. WHEREAS, the County of Kern is the designated sub-grantee for Homeland Security Grants on behalf of the Kern Operational Area; and WHEREAS, the City of Bakersfield (CITY) is part of the Kern Operational Area; and WHEREAS, the Approval Authority of the Kern Operational Area has approved an allocation of grant funds to procure equipment, software, training or other professional services on behalf of the CITY, a local government within the Kern Operational Area, to partially fund the CITY's Hazardous Materials Response and Readiness Project ("HAZMAT PROJECT"); and WHEREAS, the CITY desires to expedite the purchase of a Hazardous Materials Response Vehicle to leverage the grant funds made available and take full advantage of available pricing prior to the end of the 2008 calendar year; and WHEREAS, Pierce Manufacturing, Inc. is the leading manufacturer and supplier for said Hazardous Materials Response Vehicle; and WHEREAS, there is no known substitute or grant approved equivalent for the Hazardous Materials Response Vehicle manufactured and sold by Pierce Manufacturing, Inc.; and WHEREAS, due to the grant funding source, the CITY has obtained preferred pricing through General Services Administration (GSA) pricing schedules for this type of equipment; and WHEREAS, the Fire Department requests the Council find that said Hazardous Materials Response Vehicle can only be reasonably obtained from Pierce Manufacturing, Inc., and because of restricted availability, recommends that the Council authorize dispensing with bidding requirements in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and incorporated herein by reference. 2.
