HomeMy WebLinkAboutRES NO 33-84RESOLUTION NO. 33-84 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGMENT IV OF PRO- POSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 1-84). WHEREAS, Segment IV of a proposed amendment to the Land Use Element Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, in accordance with Code, held a public hearing on April 19, 1984, on Segment IV of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such the Land Use Element of Plan is as follows: the Council of the City of Bakersfield referred of the the Planning Commission of the City of Bakersfield, the provisions of Section 65351 of the Government SEGMENT IV: Segment IV of the proposed amendment to the Bakersfield Metropolitan Area General THE CITY OF BAKERSFIELD has applied to amend the land use designation on approximately 6.55 acres of an existing commercial shopping center from Low Density Residential to Commercial located east of Wible Road, approximately 950 feet north of Ming Avenue. Study was measures incorporated in the project the proposed not have a significant effect on the environment, Declaration was prepared; and WHEREAS, for the above-described Segment, an Initial conducted, and it was determined that with mitigation project would and a Negative WHEREAS, the law and regulations relating to the prepara- tion and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 132-83 have been duly followed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 45-84 on April 19, 1984, the Planning Commission recommended approval and adoption of Segment IV by this Council; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on June 6, 1984, on the above-described Segment IV of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a newspaper of general circulation. NOW, THEREFORE, BE IT HEREBY RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment IV is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The City Council hereby approves and adopts Segment IV of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan. 5. That this Segment IV of the proposed amendment to the Land Use Element be combined with other segments approved and adopted by this City Council, as set forth in separate resolutions, to form a single Land Use Element Amendment, 1-84. .......... o0o ..........
