1 . Per the enclosed update from Donna Kunz, in the next few months EDCD is
expecting to receive the grant and Section 108 monies that have been approved

acquisition of their properties during the next few months. EDCD will also be
releasing a new RFP at the end of January to solicit development proposals for the

10 acre project, which will include 85 high rise apartments, 35 condos and 65,000
square! feet of commercial . There is high interest in the project, with over 60
developers on the current interest list. We look forward to advancin g the South Mill
Creek project, as it will be a major boost to our downtown revitalization efforts!
2. Attached for your information is a memo from Ralph Korn outlinin g the time line for
the RFP for administration of third party liability claims.

4. Next Monday, January 8th, a new staff member will be added in the City Manager's

Office. Rick Kirkwood will begin duties as our new Management Assistant. He will
work on a variety of referrals and special projects and will be attendin g a wide
array of meetings for the next few months to get background information.
5. The 2nd Annual Polar Bear Plunge at McMurtre A '
g y Aquatic c Center on New Year's
Day was a huge success again. There were over 260 attendees with 103 taking
the plunge, as compared to 62 brave ones last year. The event received very good
coverage in the media, with one of the local television reporters even takin g the
plunge during his morning weather report. All who attended had a reat time;

many said they would be back next year and plan to bring more artici ants with
them.

6. Approximately 75 people attended the Kwaanza celebration at Martin
Luther King,
Jr. Center on December 21st. Attendees enjoyed the event which included local
entertainers presenting dance, poetry readings, and story .tellin g

7. We are pleased to announce that the Park at River Walk has been selected by the
California Park and Recreation Society for an Achievement Award in the category
of Park Planning for a community in the population category of 100,001 and up.
8. The list of "High Five" award recipients for the fourth quarter of 2006 is enclosed.
As always, we congratulate them all on their job performance and recognition.
9. The Streets Division work schedule for January 8 through 12 is enclosed.

SUBJECT: Update on South Mill Creek Redevelopment Project
In the fall of 2005, EDCD applied for and received a nationally competitive Brownfield Initiative
grant in the amount of $750,000 to be used for the mixed use development called South Mill
Creek. The grant required the use of a companion Section 108 loan in the amount of
$3,750,000, which has also been approved. The grant and loan funds were approved b the
pp Y
City Council and Redevelopment Agency and have been earmarked for the acquisition of
property, environmental cleanup and demolition of bighted structures located on the select
properties required for the project. This month we received the documents to complete the
funding of the approved loan and grant and expect to receive most of the proceeds by February
or early March 2007.
EDCD will spend the next few months negotiating with several property owners located within the
proposed project for acquisition of their properties. The project will be located between the rail
tracks, Q Street on both sides of the canal and south to California Avenue. To date, 5.5 acres
have been secured and approximately 5 additional acres containing 5 businesses will need to be
assembled. The Brownfield Loan and grant funds, along with proceeds from the sale of a
portion of the Redevelopment Agency controlled 5.5 acres that is required for Right of Way for
the Centennial Freeway will be used to fund the purchase of the remaining properties, the
business relocations and the site cleanup.
You are aware that the development agreement with Lennar has long expired. A new Request
for Development Proposals (RFP) has been prepared and will be released to the p ublic and
developers at the end of the month for the scaled back 10 acre development. The p
concept Ian
for the project provides for 85 high rise apartments, 35 condos and 65,000 square feet of
commercial development. The project is planned to have neighborhood service retail and
restaurants to support the new neighborhood and other community recreational facilities.
There are currently over 60 developers on our list that have expressed an interest in this ect.J

These developers will be sent the RFP and it will also be placed on the City's web site. Due to
the complexity of the project, we expect to allow 90 days for proposal submittals and then an
additional 9-12 months to negotiate a final redevelopment agreement. Durin g negotiation

SUBJECT: Claims Handling RFP
The City has had a contract with Acclimation Insurance Management Services, Inc. (AIMS) for
the past two (2) years to investigate and adjust liability claims which are filed against the City.
The contract contained an option for a third year. Over the past year, the City also has had a
contract with Bragg & Associates (Bragg) for investigation and adjustment of the more complex
claims such as those arising out of Police activities or employment related issues. AIMS has
handled the more mundane claims such as potholes and fender-benders. We are very pleased
with the service that Bragg has provided.
The City has issued a RFP for claims handling services that is directed toward the less complex
claims. The RFP was sent to AIMS, Tri-Star, Bragg and Frontier Adjusters, all of which have
public entity adjusting experience. Tri-Star is a rapidly growing claims administrator having
offices in California. Frontier is a national firm with an office in Bakersfield. We will require
that the successful bidder either maintain a twenty-four (24) hour service office in Bakersfield or
have a subcontractor arrangement with a Bakersfield office.
The timeline for the RFP is:
• 12/22/06 RFP sent to potential bidders.
• 02/01/07 Responses due from bidders.
• 02/15/07 Complete evaluation of proposals.
• 02/23/07 Get contract signed by successful bidder.
• 02/28/07 Submit contract to City Council.
• 03/01/07 Begin new contract.
The current AIMS contract expires on February 5, 2007. AIMS has agreed to extend the contract
on a month-to-month basis at the existing rates.

Councilmember Couch requested staff respond p correspondence from Brad Henderson,
of BFCG, regarding RFQ requirements and sole-negligence clause for professional
design services.
Staff is aware of the new law (AB 573 that went in) to effect January 2007. It add
Section 2782.8 to the Civil Co y s
Code, and provides that all clauses in a contract that purport
indemnify public entity a des p port to
y y design professional are unenforceable except for claims that arse
out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the design
A "design professional" is defined to include a licensed architect, licensed landscape
architect, licensed professional engineer, or licensed land and surveyor.
The new law applies to all contracts and amendments Jan � thereto entered into on or after
January 1, 2007, by the City with a "design professional" as g p described above.
In summary, staff is aware of the change in the law
g and has taken appropriate steps to
ensure that all City contracts comply with these new rovisi
p ons.

SUBJECT: CREATION OF QUIET ZONES MEETING
COUNCIL REFERRAL NO. 1677
COUNCILMEMBER BENHAM REQUESTED STAFF SET UP A MEETING AS
SOON AS POSSIBLE WITH CHARLES HAGOOD AND MR. GARDNER TO
DISCUSS THE READING OF THE CITY'S REGULATIONS.
Pursuant to Councilmember Benham's request,q a meeting was held with Associate Attorney
Michael Richards, Dean Gardner and Charles Ha good g od via conference call the week of
December 18 2006. It was confirmed that the City's understanding derstanding Of quiet zone creation is
correct. The initial notice is a notice of intent. This does not
cause the train horns to cease.
It merely gives the Railroad companies and the P.U.C.
time to offer input as to what should
be done during the creation of the zone. Then a diagnostic review is done, which is followed
by the actual construction of an improvements needed Y p . After all that, the application is sent
to the F.R.A. or the zone is unilateral)y declared by the city. Finally, a notice of
establishment is sent out. The final notice official)y creates the quiet zone. Further, Mr.
Hagood agreed that the R.C.L. engineer's estimate of
g a minimum of 18 months for quiet zone
creation is correct and that Richmond had taken at least two years to create their small quiet
zone.
