SUBJECT: General Information
1. The Army Corps of Engineers briefed Congressman McCarthy this morning at Isabella Dam. In
attendance were several Corps staff, Congressman McCarthy and three of his staffers,
Supervisor McQuiston, two TV news stations, Florn Core, and the Kern River Interests
consultant. The briefing did not reveal anything new on the investigation front. There were two
noteworthy items - a schedule that has been stretched out two years, to 2016, and an estimate
of the potential construction costs of $782,000,000!
The stretched schedule was a surprise because we had been assured of a quickened pace of
investigation and design by the Washington chief of the Corps and we were tuned in to a late
2013 or early 2014 completion. The money to complete construction was not a real surprise,
though this was the first time it was revealed. Now that a cost estimate is known, Congressmen
McCarthy and Costa can start the advanced requests for funding of the project.
2. Staff is sending out a survey to the residents in the Kimberly area (Annexation 593 — Kimberly
#1) as a follow-up to the neighborhood meeting held back in May to determine the resident's
level of interest in annexation. Staff is also sending the enclosed memo to all of the residents
that answers the relevant issues raised and questions asked at the neighborhood meeting. A
sign-in sheet was collected at the neighborhood meeting and we are also sending a copy of the
memo to anyone in attendance that is not a resident of the area.
3. Upcoming concerts at the Park at River Walk include the Bakersfield Symphony on Saturday,
September 8 and Peter Frampton/Doobie Brothers on Sunday, September 9th. Future concerts
will include The Grass Roots and Weird Al in October.
4. The Streets Division work schedule for the week of August 20th is enclosed.

The City of Bakersfield held a neighborhood meeting at the Olive Drive Elementary
School Multi-purpose Room on Wednesday, May 31, 2007 at 6:30 p.m. to discuss
annexation with the residents and property owners of the Kimberly#1 area. Many of
the residents raised questions and issues about traffic and the installation of sewer
infrastructure, connections, and service. The following are responses to the relevant
issues raised and questions asked at the meeting.
1. What are the City's and County's plans to resolve the congestion issues on
Olive Drive?
Currently, Olive Drive is a four lane road with on-street parking. City staff
explained that the City and County have the same General Plan, and pursuant to
the General Plan, Olive Drive is designed as an arterial street and is slated to be
a six (6) lane road. The County does not plan to stripe a third lane in each
direction in the near future since that would eliminate the on-street parking.
City staff shared with residents that plans are in the works to relieve some of the
congestion of Olive Drive, including: Snow Rd and 99 interchange, Hageman
Flyover, and a dual-lane on-ramp for eastbound Olive Drive onto southbound 99.
Andy Richter, Kern County Roads Department, said should the Kimberly area on
the south portion of Olive Drive be annexed, the County would request that the
City not include the Olive Drive roadway as part of the annexation. City staff
indicated that should County staff request that the roadway remain under county
jurisdiction they would concur with the County's request.

2. Where will the sewer lines run?
City staff explained the City can make a connection to the existing sewer line
running along Olive Drive. From the connection point at Olive Drive, a line will
run south along Urner to Hooper. Lines will then radiate east and west along
Pembroke, Kimberly, and Hooper, and north from Hooper along Brooks. Actual
sewer hook-ups may vary depending on the location of other utilities and the
location of existing septic systems for properties that desire service.
3. Which lines will residents that front Olive Drive connect to?
There are two options the City may consider for the line that will connect the
residences fronting Olive Drive depending on the location of a septic tank. If a
majority of the septic tanks are located in the front yard, the residences may
connect to the existing line along Olive Drive. If a majority of the septic tanks are
located in the back yard, the residences may connect to a line to be installed in
the alley to the south if possible.
4. If the area decides not to annex, what is the process to form an assessment
district to receive sewer service from the County?
The property owners may petition the County to form an assessment district to
pay for the construction of the sewer infrastructure. All of the property owners
will be given an opportunity to vote to form the assessment district. A simple
majority in favor of the assessment district will move it forward to be formed.
Once formed, all properties located in the assessment district will be required to
pay the assessment.

5. If the area remains unincorporated and the County provided sewer service
to the area, what costs, fees, charges, etc. will be assessed?
The County has estimated each property's share of the cost for the County to
build sewer infrastructure for this area to be $16,000 to $20,000. Once the
County has formed an assessment district, the owner of each property will be
required to pay this assessment even if they do not hook-up to receive sewer
service.
Property owners must follow a similar process for constructing laterals and
abandonment of septic systems as outlined in question 7 below. The cost of a
permit may be slightly different from the County than from the City.

For those properties that hook-up to receive sewer service, an annual sewer
service fee of $155 plus an additional County operations and maintenance
charge will be collected on the property tax bill.
Overall the process to hook-up to sewer in the County may cost approximately
$19,000 to $23,000.

6. What does the City's annual Sewer Residential Rate of$155 pay for?
Upon annexation, only residences that have hooked-up to the City's sewer
system pay the annual fee of $155. This fee pays for the operation and
maintenance of the City's sewer collection system and treatment plant.
7. Upon annexation, what will the costs be to hook-up to sewer at each step
of the process? Will each residence be required to obtain a permit to
abandon the septic tank, hook-up to the lateral, fill the septic tank, etc.?
Upon annexation, if enough residents are interested in receiving sewer service,
the City will design and construct the sewer mains and laterals to the property
line. Once construction of the sewer main and City portion of the lateral system
is in place, individual properties may connect at their expense as follows:
1. The property owner must obtain a permit from the City Building
Department to connect the house to the lateral located at the property line.
The cost of this permit is $55.
2. At the time this permit is issued, the property owner must choose how they
would like to repay the Connection Cost for its connection to the plant, the
trunk line fee, and cost for the property's share of the sewer infrastructure:
i. Pay the entire amount at the time the building permit is issued, or
ii. Spread repayment of this fee over 5 years, with no interest, to be
collected on the property tax bill.
The City estimates the Connection Cost to be $11,235.76.
3. The property owner must obtain a permit from the City Building
Department for the abandonment of the septic tank. The cost of this
permit is $55.
4. Once this permit is issued, the property owner may install the lateral from
the right-of-way line to the house and disconnect the existing septic tank.
This step will typically cost approximately $1,900.
5. The existing septic tank must be pumped before it is abandoned. This
work must be verified by showing the pumping receipt to the inspector.
This step will typically cost approximately $300.
6. The existing septic tank (now dry) must be filled with sand and the process
is complete. This step will typically cost approximately $500.
Overall the process to hook-up to sewer in the City will cost approximately
$15,000.

8. Upon annexation, what charges for C.S.A.s will be removed from my
property tax bill?
The charges that currently appear for C.S.A.s 10.6 (fire hydrants), 10 (street
lighting), 71 (sewage disposal system) and 71.5 (street sweeping) will be
removed from your property tax bill. The City will assume the responsibility of
maintaining the existing street lights and fire hydrants at no charge. The City will
provide street sweeping at least once a month as part of the Residential Refuse
Rate.
9. If a residence abandons a septic tank and hooks-up to sewer, will the
County Assessor reappraise or reassess the property value?
James W. Fitch, Kern County Assessor-Recorder, responded to this question in
a letter dated June 8, 2007 to the City of Bakersfield. The letter states that,
"...the replacement of one type of system to another type of system does not
constitute a change in value of the property. The conversion from a septic
system to a sewage collection system is not considered a change in use of the
property. The Assessor will not assess property for new construction as a result
of a septic system being abandoned and a new sewer connection being
established in its place." If you have any questions or would like more

The two fundamental questions that residents and property owners have when they
learn that a city is considering whether to annex their area are:
1. "Will I and my family be better off if the City annexes my area or if my area
remains in the County?" and
2. "Will my neighborhood be better served by the City or the County?"

' SEWER SERVICE:
• Upon annexation, the charge for C.S.A. 71 will be removed from your
property tax bill.
• If you choose to connect your home to City sewer, the City offers an
option to spread repayment of the total connection cost over 3 to 5 years
that will be collected on your property tax bill.
2 TOTAL CONNECTION COST:
• Upon annexation, the City does not require property owners to connect to
the sewer system as long as an existing septic tank is operating properly
and does not violate State health and building codes.
• Each property owner may choose to connect to the City's sewer system
for this one-time cost per home composed of the cost to construct the
sewer infrastructure, the Sewer Connection Fee, and the Trunk Line Fee.
• As of July 1, 2007, the current Sewer Connection Fee will be $3,100. The
Sewer Connection Fee recovers the City's cost of providing sewer
connection service and upgrades and expansion of the sewer treatment
plant.
• As of May 30, 2007, the estimated Trunk Line Fee is $967.18. The Trunk
Line Fee recovers the City's cost to construct trunk sewer lines.
• These are one time fees.
3 STREET LIGHTING:
• Upon annexation, the charge for C.S.A. 10 (street lighting) will be removed
from your property tax bill.
• The City will assume the responsibility of maintaining the existing street
lights.
4 STREET SWEEPING:
• Upon annexation, the charge for C.S.A. 71.5 (street sweeping) will be
removed from your property tax bill.
• The City provides street sweeping at least once a month as part of the
Residential Refuse Rate.

It is my understanding that some residents have inquired as to whether the assessed value ofproperty
that has fisrrnerly been served by a septic system is automatically add usted upward with a resulting
increase in property value for assc.:sment purposes when that septic system is abandonetl and the
fm)perty is then served by a sewage collection system.
Under the provisions of Proposition 13,adopted by California voters in 1978,property may only be
reassessW.at .fair market value Macon change in ownership or upon the completion ofeertain new
construction that adds value to the property. Private sewage systems and connections are considered
new construction sutd arc wLwssable.however,the replacement of one typo,of system to another type
Of system does not constitute a change in value. Tht conversion front a septic system to a se.%fagt
