Enclosed is an update on the time frames and issues on select major capital improvement projects. We will do an update at a Council meeting — probably in January. 2. Central Park is being fenced off starting today, October 19th due to construction of Phase I of the Mill Creek Project. The Art Museum and Senior Center areas will remain open during construction. The work in the water way itself has to occur during the December maintenance shutdown of the Kern Island Canal. Other elements will follow. 3. 1 will be going on vacation from noon Thursday the 25th until Tuesday November 6th. John will be in charge and the office will have my contact information should it be necessary. 4. Enclosed are flyers for the Good Neighbor Festival at Dr. Martin Luther King Jr. Park on October 20th and the Fall Festival in The Park at River Walk on October 27th and 28th. The Good Neighbor Festival will include a ribbon cutting project. at 1:00 p.m. for the Children's Community Garden 5. The Streets Division work schedule for the week of October 22nd is enclosed. 6. We are resurfacing 25th Street and some other streets in the area this month. They have already been prepared by having the pavement ground along the gutters and at the pavement limits. The grinder was too big to work in the alley. The Contractor will be bringing in their small grinder to grind the alley. This will be done this month to allow paving of the alley at the same time that streets in this area are being paved. Staff contacted Bright House Networks for the background related to Mr. Suorez' concerns about the transition of his cable account from Suddenlink to Bright House Networks. Mr. Suorez was concerned about the difference in rates and cable packages. The Director of Customer Service at Bright House has spoken to Mr. Suorez about the transition of cable service from Suddenlink to Bright House. His concerns have been alleviated, and he has been informed as to when a cable package similar to the one he previously had will be available for his neighborhood. Attached for your information is a letter from Bright House Networks explaining the issues involved with the migration of customers to the Bright House physical line up and rate structure. Mr. Suorez is a customer who was previously served by Suddenlink and is now a Bright House Networks customer. He currently receives channels 2-25 and pays a total of$27.36 a month.The Bright House Networks published rate card for the similar service (channels 2-22) is $12.95 a month. Becky Mitchell, our Director of Customer Service, contacted Mr. Suorez directly and resolved his concern. Although the Bright House Networks acquisition of Suddenlink has closed, we are still in the process of migrating customers to our physical lineup and rate structure. Until this process is complete, former Suddenlink customers will continue to receive their former Suddenlink lineup and corresponding rate.This is a systematic process that requires a great deal of both physical and "back office" preparation. Because Suddenlink operated on different cable plant, infrastructure and technical platform, there are a considerable number of steps that need to be taken to migrate those customers onto the equivalent Bright House Networks systems. While we are expediting this process as much as possible,this will take a few months due in no small part to our determination to do it right the first time and with minimal customer impact and/or disruption of services. Some of the steps that need to occur include: ❑ Physically moving cable lines from Suddenlink's cable plant to our cable plant ❑ Migrating customers billing information to our billing system ❑ Reconciling customer rates once they are moved to our cable plant All of this must be done with the highest level of customer focus on issues like maintaining continuity of customer history in our billing system,making sure that services are not interrupted, transferring pertinent information like HSD data and recorded programs on DVRs, etc. Although the physical migration of these customers is complicated, our biggest effort continues to be making it as seamless as possible. Our primary goal is to keep customers informed at every turn and some of those communication pieces have included: • Newspaper ads run in the Californian • Mailers sent directly to customers • Radio commercials ❑ BilIboards ❑ Personal phone calls to customers ❑ Automated reminder calls ❑ Informational video which runs on a dedicated channel(Channel 22) ❑ Weekly updates to our website We have developed extensive communication plans to let customers know of changes each step of the way. And, as always, our customer service representatives are happy to assist with individualized customer questions or concerns.I am personally delighted to answer any questions you or the Council may have. The City's speed limits are set based on the requirements of the California Vehicle Code. The County, and the rest of California, is also subject to the same requirements for setting speed limits. The basic speed laws in the Code allow the local jurisdiction to reduce the speed limits down from 65 miles per hour, for major roads, or up from 25 miles per hour for local streets. An engineering study, performed in accordance with State law, is used to set a speed limit of other than 65 or 25 miles per hour. These studies are required to be done every five years to maintain a legitimate speed limit for police enforcement. Traffic Engineering staff study approximately 150 road segments per year for speed limit updates or new speed limits. If there are specific roads or streets in the City that are of concern, the Public Works Traffic Engineering staff will perform a traffic speed study to confirm the speed limit. If the study shows that the speed should be raised or lowered to conform to State law, it will be sent to the City Council for approval and the signs will be posted at the new speed limit. They also reported vandalism to the rubberized play surfacing near the play equipment. City staff removed numerous types of graffiti from the play equipment, picnic shelter area, picnic tables and other park furnishings. A portion of rubberized surfacing near one of the playground equipment components was set on fire and attempted to burn. Fortunately the damaged area was not in the "fall zone area" but an access point to get on and off the play equipment. The entire play area is still totally safe. Staff is currently assembling a contract to have the damaged rubber surfacing repaired at Bill Park Greens as well as several other park sites that need repairing in the city. We anticipate these repairs beginning in about forty-five (45) days. Marilyn L. However — there are still some items of concern. l have taken the liberty of photographing the situation for you to review in hopes that maintenance crews or who ever is responsible can remedy this sad situation. The photos show the long standing damage to the play mat but most of all the graffiti on the tables is just unacceptable to any reasonable person. Thank you for your continued assistance. This letter is a follow-up to our conversation concerning the incidents you described involving Quilters Haven, one of the local businesses in Bakersfield. We have reviewed California Civil Code Sections 54 et seq, that apply to your situation. We do not have sufficient information regarding whether the dog in question qualifies as a service dog. We did contact Quilters Haven by telephone, but they did not wish to comment and indicated they had retained an attorney. I obtained no further information regarding the incidents. We also agree with Congressman McCarthy that should you wish to pursue this civil matter, you may want to seek legal counsel from Greater Bakersfield Legal Assistance (GBLA) or from a private attorney.
