It is a big positive that the County came forward with a preliminary action regarding financial participation in the TRIP project. Their potential participation is listed at $36 million for 7th Standard Road and $72 million for a County contribution to TRIP generally. This contribution is a welcome addition to the City of Bakersfield's commitment for the statutory match and unfunded but required legs of projects of over $400 million. Hopefully CalTrans will also become a financial participant as well. 2. More on the Plaza bricks. We will only remove bricks that have engraved names which we believe could be a tripping hazard for high heels and the like. An inspection this week showed only a small number of the total engraved bricks are damaged to this degree. Every effort will be made to keep the names and even the damaged bricks. When possible, we will attempt to have the name of a vendor who can engrave bricks for those who wish to pay for replacements. Please call if you have questions or concerns. 3. The 1St Point litigation resulted in the court finding that the River was fully appropriated but that water had been forfeited (90,000 acre feet). The court went to great lengths say that it was up to the State Water Resources Control Board (SWRCB) to appropriate the forfeited water. That is where we are now. The SWRCB has scheduled an initial hearing to hopefully determine that in light of the 1St Point case, there is an unappropriated river. This is the first step in a long process. Assuming the SWRCB says yes — there is forfeited water to be appropriated — then we go to a second hearing and argue that the City of Bakersfield has municipal preference over the forfeited water. 4. Water Resources is reporting the recent storm activity has kicked off the snowpack season on the Kern River. Although the storm failed to live up to promises locally, activity did occur over the Kern River watershed. Remote gauging sensors indicate snow is accumulating at several stations, which is encouraging, but will remain below normal for this time of year. Upwards to ten storms of this magnitude or greater are needed for the remainder of the season, extending through April, to achieve a normal yield for next spring and summer. Enclosed is a letter from CalTrans regarding delegation of CEQA Lead Agency status to the City for certain projects on the state highway system. The CEQA lead is resolved on all but one project where discussions are continuing. 7. The Graffiti Unit statistics and Special Enforcement Unit's monthly report for November 2007 are enclosed. 8. The Streets Division work schedule for the week of December 10th is enclosed. 9. This weir is located on the Carrier Canal just `- , •*. west of Chester Ave. on the river. The weir was originally built in the mid 1930's by the Kern County Canal & Company Water and has had several upstream view of reconstructed Upstream view of Famers-Stine- modifications over the Famers-Stine-Anderson Weir Anderson weir prior to rehabilitation years, the last being in 1967. It is a major control structure for safely diverting Kern River water through Bakersfield. The weir was acquired by the City of Bakersfield as part of the 1976 Kern River purchase. An extensive engineering review of the structural integrity of the weir allowed the City to rehab the structure rather than completely rebuild. The rehabilitation project consisted of replacing all steelworks including water control gates, increasing the width of the upper deck concrete walkway, replacing and strengthening the lower service deck, restoring the ,. ,4Novi old weir floor with a 6 inch concrete �!1 >' + cap, and adding 6 inches of reinforced Downstream view of rehahilitated weir ' concrete to the walls. New safety rails and fencing were also installed. The I. I` resultant project replaces the old structure ucture with anew up-to- view of extended walkway date weir at half the cost of constructing a new weir. The total cost of the project was $535,000.00. CEQA Lead Agency Status is granted to the City of Bakersfield on Oak Street/24th Street Interchange and 24th Street widening as the City of Bakersfield and Caltrans are currently working in partnership on the relinquishment of this section State Route 178. The Department,as assigned by the Federal Highway Administration, will retain lead agency status under the National Environmental Policy Act(NEPA),and will carry out the environmental review,consultation and any other action required in accordance with applicable Federal laws. These documents will be formatted as"blended"CEQA/NEPA documents, and must adhere to all guidance and annotated outlines described in the Standard Environmental Reference found on the Department's website(http://www.dot.ca gov/sera. Staff toured the 300-400 block of Montclair Street to find that behind the houses is an alley, a dirt path (approximately 35' wide) with three oil derricks and a school. The problem seems to stem from traffic on the dirt path related to the oil derricks. One of the oil derricks is located behind 401 Montclair Street, which is the reporting party's address. This issue has been referred to Code Enforcement to investigate and determine if the area around the oil derricks is being properly maintained.
