SUBJECT: General Information
1. The land refinancing for the arena debt that has experienced some delays is back on
track. We are projecting Council action on documents at the February 22nd meeting.
This will generate money for capital upgrades at the convention center and arena by
taking advantage of interest rate improvements.
2. Pat Flaherty, who has served as our risk manager since 2001, has accepted a position
with the City of Sacramento. He has done an excellent job and will be missed. We wish
him well as he moves on to his new endeavors.
3. Human Resources Manager Carroll Hayden will be out of the office for approximately six
weeks, beginning February 6th, to recuperate from knee surgery.
Both Pat and Carroll are division heads in the City Manager's Office. With Pat's
resignation and Carroll's absence, staff will be experiencing an increased workload, so it
is likely there will be delays in requests for information, research of issues, etc.
4. To clarify the information we provided you last week regarding the KernCOG Regional
Awards of Merits event, is will be held on Thursday, March 2nd. The press release
indicated it was the 3rd
5. Bright House Networks will be implementing a rate change as of March 1 st. We received
the enclosed notification this week. Bakersfield customers will experience an average of
a 3.2% increase.
6. The "Family Fun Factor" is a new event being introduced by the Recreation and Parks
Department on February 25th at University Park. Family teams will have the opportunity
to compete in challenging games for prizes. The attached flyer has additional details.
7. Recreation and Parks' activity report for January is enclosed.
8. The Streets Division work schedule for the week of February 61h is attached.

Dear Ms. Smiley:
Bright House Networks will adjust pricing beginning March 1, 2006. The new rates reflect the company's increased
technology, programming and general operating costs. Customers of the Bakersfield Division on average will see a
3.2%increase depending on the products and services they receive. The average increase over the last twelve months
compares favorably to the US Consumer Price Index which is up 3.4% over 2004. Customers subscribing to our
Advantage level of service will see a 5.2%increase.
Your constituents will receive the attached rate change notice starting in the next few days.
Limited Basic service will increase from $11.50 to $12.10; Expanded Basic changes from $30.25 to $31.85. As a
result,Advantage Service moves from$41.75 to$43.95.
Prices for most Bright House Networks products will not change,including pricing for high speed Internet service.
Some customers will see some of their rates decrease. The rate for our Digital Sports Tier is dropping from$3.95 to
$3.00 while digital additional outlets decline$1.00 from$8.96 to$7.96.
We are committed to maintaining the highest levels of quality programming and services for our customers.
Enhancements in 2005 included additional programming such as Azteca America, Universal HD, and most recently
KBAK(CBS 29) in HD. In addition, we continued to expand the variety of programming available Free On Demand
with our digital service.
Our commitment to customer service remains strong with several new features, including web access to statements
and improved recurring payment options.
This year you can expect that Bright House Networks will continue to bring value to our customers. Most
importantly, Bright House Networks continues to expand its civic involvement, charitable commitments, and
outreach to residents to improve the quality of life in our neighborhoods and schools.

Subject: January 2006 Highlights
Administrative Division
• Received over 30 inquiries on the Memorial Bench program at The
Park at Riverwalk after the winter brochure arrived in homes.
• Continue to work with the Tree Foundation and the Kern River
Parkway Foundation and the Breakfast Rotary to create the Memorial
Grove.
• Approved the contract with Purkiss — Rose to begin the Master Plan
process.
• Approved the contract with Total Landscape Architects to develop
the concept plan for Mesa Marin Complex.
• Staff participated with other departments on the consultant
presentations for the Mill Creek Project.
Parks Division
• Over 24 trees were planted in the Silver Creek vicinity, after removing
4 in the Wilderness and Reliance areas.
• Staff continues to research the best ways to use plant material to
deter graffiti.
• The Park at Riverwalk is receiving final touches including bench
seating at the Bright House Networks Amphitheatre, skate guards on
railings and benches, and sealers on the benches and picnic areas.
• Park staff assisted the water department with native plant species
near the Calloway Weir.
• Only 19 shelter reservations this month, due to winter weather.
Martin Luther King, Jr. Center
• Councilmember Carson hosted a special breakfast in honor of Martin
Luther King, Jr. Over 300 people attended, and the proceeds from the
event will go toward more programming at the center.
• Thanks to donations from the I.T. Department, staff was able to set
up a new computer lab. A mostly senior class was offered free to the
public, and since it filled quickly, there are now two classes.
• Total attendance was 1,926.
Silver Creek Center
• Attendance at Silver Creek was 1,705 with 640 being in the After
School program.
• Roof damage was repaired by General Services, along with ceiling
tiles.
• We are working to replace fixtures and lights in the restrooms.
• Security cameras will be installed soon, which should assist in
controlling the graffiti issues at Silver Creek.
Athletics
• Spring brochure was mailed to over 100,000 households in mid-
January. Preparing for the large summer brochure to be mailed in
April.
• Adult Softball Tournament was held on January 21 with 8 teams.
• Preparing for new programs to start later this year including adult
kickball, Rallyball tennis, golf classes, youth volleyball and wrestling.
• Pee Wee Sports program will start in February at Silver Creek Park.
McMurtrey Aquatics
• The Polar Bear Plunge on January 1St was a huge success with 76
people taking the New Year Plunge, and 200 more spectators. It will
be an annual event at McMurtrey.
• High school teams began their practices at McMurtrey and Silver
Creek on January 31St. High school diving continues as well.
• Bakersfield Swim club continues to use McMurtrey for practices.
• New program started with lap swimmers, encouraging them to join
the 100 mile club. Those reaching 100 miles will receive recognition
and incentives.
• Total attendance was 1,237; an increase of 270 over January, 2005.
Special Event
• We are in the recruitment process for a special events manager.
• Staff is planning a huge opening event for The Park at Riverwalk for
April 28, 29, 30. More details to follow.

TRAFFIC LIGHT TIMING AT ALLEN ROAD AND STOCKDALE HIGHWAY AND ALSO
BUENA VISTA AND RIVER RUN.
The traffic signal at the intersection of Allen Road and Stockdale Highway were recently
returned to normal operation after having been disabled for several months. The sewer
project along Stockdale Highway, that was recently completed, had destroyed the
vehicle loop detectors in the paving at the intersection. The signal had been operating in
a temporary "split phase" mode until about two weeks ago when all the loop repairs had
been completed and the signal returned to normal operation and timing.
The traffic signal at the intersection of Buena Vista and River Run has been
experiencing hardware problems that affect the vehicle detection, not timing. Some of
the problems are being resolved on a temporary basis. The solution requires some of
the hardware to be upgraded and/or replaced. The General Services Division will be
replacing old detection hardware devices over the next year at several locations. The
new hardware is expected to solve most, if not all, the problems at this location.

UTILITITY POLE PLACED AT THE NORTH EDGE OF THE WESTBOUND TRAFFIC LANE
ON HOSKING AVENUE COULD CREATE A DANGEROUS SITUATION. STAFF TO
PROVIDE A RESPONSE AND PROVIDE A COPY TO COUNCILMEMBER COUCH.
The Traffic Engineer reviewed the letter from the Whitakers and the situation on
Hosking Road.
The roadway being built is part of a subdivision improvement by a developer for the
adjacent tract 5362 and is not a City CIP project. The traffic lane is 12 feet wide with a 4
foot paved shoulder for a total of 16 feet. The utility poles are existing and are located
near, but outside of, the paved shoulder area. The roadway design by the developer's
engineer follows the requirements of the Caltrans Highway Design Manual. Section 309
of the Manual requires that obstructions, such as a utility pole, be located at least a
minimum width of four feet from the travel lane or the minimum width of the paved
shoulder, whichever is greater. The travel lane is 12 feet wide and the shoulder width is
4 feet wide, so the utility pole location with respect to the travel lane meets the
requirements of the Caltrans Highway Design Manual, Section 309, and no changes are
required.
To mitigate the concern expressed by the Whitakers, the Traffic Engineer recommends
placing curbing along the shoulder as a barrier until such time as the utility relocates the
poles to make way for other developments. This is allowed in the Caltrans Highway
Design Manual, Section 309. The curbing would be placed 1.5 feet away from the pole,
leaving 2.5 feet of shoulder with a 12 foot travel lane. This information will be given to
the Public Works' Construction Inspection Division for implementation by the
developer's contractor.
A letter, with copy to the Council, will be sent to the Whitakers with this information.

Dear Mr.Tandy:
We are homeowners at 3120 Hosking Avenue, near the intersection of Hosking Avenue and Wible
Road in Bakersfield. We have lived in this location for over 30 years and have seen the city grow
around us at an alarming pace, especially during the last 2 years. Currently,construction is under way
on the widening of Hosking Avenue,directly in front of our home. This construction is being performed
in conjunction with the development of Tract 5362 by Dewak Corporation. In observing this
construction,a situation has become evident which we feel warrants your attention.
While an expanded street right of way has been obtained from the developer on the south side of
Hosking, the north right of way in front of our horse remains at 30 feet.A 25400t wide center median
has been installed in the center of the street and a 16-foot wide westbound traffic lane is being placed
in the remaining space between the north edge of the median and the north right of way line. Also
contained within this right of way are several utility poles. Since these poles are being left in place two
of these poles will ultimately sit on the north edge of the westbound traffic lane after construction is
complete. During the time that we have lived in our home, we have witnessed numerous traffic
collisions with these poles. Now that traffic is being pushed to within inches of them,it is our contention
that the City has knowingly created a hazardous situation in which the public health and safety is
threatened.
By requiring the developer of Tract 5362 to construct a full center median and corresponding street
improvements on the north side of Hosking Avenue before obtaining the appropriate right of way to
accommodate the safe installation of these wripmvements, the City is putting itself at risk.There is no
provision in the City's development standards which would allow for the placement of a utility pole at
the edge of a traffic lane.This dangerous design has been approved by City staff.
It should also be pointed out that drainage from the north side of Hosking is being muted to a low point
on our neighbor's property to the west A similar condition exists on our nights property to the east
There is no place for the water to go.Any significant rain will result in a flooded street, further adding to
the danger of this now hazardous stretch of road. This condition has also been approved by City staff.
By Dewaft Corporations own admission,this is a bad design.
We do not presume to have the power to dictate how the City gooses to develop within its rights of
way_ However,we feel it is our responsibility as citizens to make the City aware of public hazards that it
Creates.A response would be appreciated but is not expected.We vril be sure to keep you updated on
future accidents and fahalities that we observe from our living room.

Councilmember Hanson requested staff reply to correspondence from Mr. Evan
Jones regarding fog developing as a result of watered lawns in the cold weather.
Limiting watering times is not something the City is considering at this time. Some
property owners need to water at night because watering in the daytime would be
inconvenient to customers or even detrimental to their business. Others may need to
water at night because of water pressure variances in particular areas of town due to
heavy usage during the day. As indicated, differing conditions and circumstances
throughout town make it difficult, if not impossible, to impose such regulations on local
businesses.
Staff sent correspondence to Mr. Jones thanking him for his input and explaining the
City's approach on the issue.

CONCERNS OF STREET LIGHTS NOT ON AT THE GATE LOCATED AT CAMPUS PARK
AND OLD RIVER.
General Services repaired two street lights on Campus Park between Old River and
Mountain Vista. There are two street lights that appear ready for service but have not
been inspected, numbered or energized by PG&E. There are two street light poles
along the south side of Campus Park between Jameson and Old River that are part of a
new subdivision that the construction is not completed and there is no power available
to service the lights.
General Services will continue to research and follow-up on those street lights that are
not ready for service and apply for service from PG&E as soon are they are ready and
given a final inspection approval.

Council Member Sullivan requested the police department enforce speed limits in the vicinity
of Valhalla and Ming Avenue.
Staff has been conducting speed enforcement and general vehicle code violation enforcement in the
area of Valhalla and Ming Avenue on a regular and continuing basis. The Reserve Unit has also
provided three two-officer units to provide more enforcement on the weekend nights.

COUNCILMEMBER SCRIVNER REQUESTED STAFF INVESTIGATE THE FEASIBILTY OF
PLACING THE POTHOLE HOTLINE ON THE SIDE OF CITY TRUCKS.
The patch trucks are designed so that every inch of the truck is utilized. One side of the
truck is used to carry the spray wane and hoses and the other side is used to carry the
propane burner that is used to dry wet areas or potholes. Tools are also carried on both
sides of the patch truck. The sides of the patch truck get messy when the crew goes to
pick up asphalt material.
However, staff will look into the possibility of placing the Pothole Hotline number
somewhere on the patch truck and if a spot can be found the number will be installed.
