Attached is the Mill Creek presentation that was shown to staff at your last meeting. We are sending it to the GSA for their consideration while they evaluate our offer of 2.5 acres of Central Park to house the Federal Courthouse. 2. 1 will be on vacation Thursday, November 30`h and Friday, December 1s`, during which time John Stinson will be in charge. Kane Director, San Francisco Service Center (9PF) Public Building Service U.S. General Services Administration 450 Golden Gate Avenue San Francisco, California 94102-3434 Dear Mr. Kane: Please find enclosed a descriptive PowerPoint presentation of the Mill Creek Redevelopment Project, a new 1.5 mile linear park and redevelopment project planned for downtown Bakersfield. This new amenity will surround Central Park and the area we previously identified to you as a potential location for the federal courthouse. The Mill Creek Redevelopment Project will transform 1.5 miles of the banks of the existing Kern Island Agricultural Canal into a "natural" creek, with walking and biking paths, public art, creation of a viewing pond in Central Park, and construction of a replica water mill and a plaza. In the PowerPoint presentation we have also included a slide of Central Park depicting a lake and the eastern park area offered for the Courthouse plan. The hexagons displayed on the slide represent two federal facilities and are not meant to depict the actual shape or design of a courthouse or any GSA structure. I hope you find this information useful in your evaluation when considering downtown as a suitable location for the planned GSA facility. GRADY, DEVELOPMENT SERVICES DIRECTOR DATE: November 21, 2006 SUBJECT: HOME OCCUPATION STANDARDS Council Referral No. 1654 COUNCILMEMBER COUCH REQUESTED STAFF RESPOND TO CORRESPONDENCE FROM EDUARDO C. MERJIL REGARDING HOME OCCUPATION OPERATING STANDARDS FOR RESIDENTIAL BUSINESSES IN BAKERSFIELD. Councilmember Couch referred a letter from Mr. Eduardo Merjil to staff concerning the City's home occupation permit (HOP) standards and their applicability to the sales of firearms from his residence. Mr. Merjil recently applied for a firearms license from the Federal Alcohol, Tobacco and Firearms agency (ATF) but was denied a permit since the city does not allow the exchange of merchandise from the home. One of the requirements of ATF is that the transfer of a firearm must occur at the place of business, in this case, the residence of the applicant. However, when ATF contacted staff asking if buyers could come to a home to pick up firearms, staffs response was negative. By ordinance, the City's HOP standards allow one customer to be invited to a residence by appointment only to obtain ".service, tutoring or training." By definition, service is considered as an act of help or assistance as opposed to handling merchandise. Before May 1997, the City prohibited all customers from visiting the HOP holder's residence. Changes made to the ordinance in 1997 were done initially in response to a teacher that wanted to give piano lessons at her residence. The ordinance was expanded to allow a customer to make an appointment for a particular service or tutoring. The nature of these types of services is that they usually require time to provide (i.e. legal consulting, accounting, tutoring, etc.), so that the number of clients visiting a home are infrequent. Product exchange orjust picking up merchandise is not the same. Multiple visits can occur over a much shorter period that could be disruptive to a neighborhood with increased traffic and more unfamiliar persons. The intent of a home occupation is that it be an incidental use that unobtrusive to a neighborhood. Limiting product exchange to certain types of merchandise would be difficult to enforce. Additionally, concern may arise because this particular product deals with firearms and ammunition being exchanged in a neighborhood setting. However, the applicant has noted that the selling of firearms is specialized and highly regulated at both the State and Federal levels. Therefore, if the City Council wishes to add language specific to firearms being exchanged under the provisions of an HOP, they may direct staff to amend the ordinance as necessary. Regarding the existing licenses issued in the past by ATF, staff notes that this was the first instance where ATF asked for written confirmation of actual product exchange. Since handling general paperwork is allowed under an HOP and that ATF must deal with many different jurisdictions' ordinance requirements, it is possible that these existing permits were issued under the belief that compliance with local ordinance was being satisfied, or that the sales and exchange of firearms were restricted through authorized gun shows.
