HomeMy WebLinkAboutRES NO 66-84RESOLUTION NO. 66-84 A RESOLUTION OF THE COU~CIL OF THE CITY OF BAKERSFIELD AUTHORIZING THE FILING OF AN APPLICATION WITH THE KERN COUNTY COUNCIL OF GOVERNmeNTS FOR ALLOCATION OF TRANSPORTATION DEVELOPMENT ACT FUNDS FOR FISCAL YEAR !98~- 85. WHEREAS, th~ Transportation Development Act of 1971 provides for the disbursement of funds from the Local Transportation Fund held in trust by the Kern County Auditor-Controller for use by eligible claimants for the purpose authorized by Article 8, Section 99400(a) ~ Streets and Roads and Article 4, Sectinn 99260 (a), Public Transportation; and WHEREAS~ an eligible claimant wishing to receive an allocation from the Local Transportation Fund must fila its application with the Kern County Council of Governments pursuant to the rules and regulations that have been adopted by the Secretary of the Busioes~ and Transportation Agency of the State of California in accordance with the provisions of the aforementioned legislation; and WHEREAS, funds from the Local Transportation Fund will be raquired to maintain the street and road system and provide publi~ transportation. NOW, THEREFORE, BE IT REEOLVED by the Council of the City of Bakersfield as follows: 1. That the Director of Public Works is authorized to execute and file an appropriate claim pursuant to the terms of the Transportation Development Act of 1971~ as amended, and pursuant to applicable rules and regulations promulgated thereunder, together with all necessary supporting documents, with the Kern County Council of Governments for fiscal year 1984-85 Transportation Development Act monies. 2. That a copy of this resolution be transmitted to the Kern County Council of Governments in conjunction with the filing of the claim; and the Kern County Council of Governments be requested to concur in these findings and grant the allocation of funds as specified on the Article 8 claim. .......... 000 .......... OF THE CITY OF BAKERSFIELD F_~NDING THERE ARE NO UNMET PUBLIC TRANSPORTATION NEEDS WHICH COULD BE REASONABLY MET. WHEREAS, the Transportation Development Act of 1971 provides for the disbursement of funds from the Local Transportation Fund held in trust by the Kern County Auditor-Con~roller for use by eligible claimants for the purpose authorlzed by Article 8 Section 99400(a), Streets and Roads and Article 4, Section 99260(a) ~ Public Transportation~ and WHEREAS, an eligible claimant wishing to receive an allocation from the Local Transportation Fund must receive written and oral testimony regarding transit needs and, after considering the evidence presented at the meeting, and its own knowledge of public transportation needs within the City of Bakersfield; must find that transit n~eds are being met; and WHEREAS, a duly noticed public hearing was held before the City Council of the City of Bakersfield, wherein written and oral ~estimony regarding transit needs were received; and WHEREAS, the City Council considered the evidence presented at the public hearing, along with its knowledge of public transportation ne~ds within the City of Bakersfield; and WHEREAS, funds required ~o m~intain the ~OW~ THEREFORE, from the Local Transportation Fund will be street and road system. THE CITY COUNCIL OF THE CITY OF BAKERSFIELD HEREBY FIND~ AND DECLARES AS FOLLOWS¢ 1. There are no unmet public transportation needs which could be reasonably met by expansion of existing transportation systems or by establishing new systems. 2.
