HomeMy WebLinkAboutRES NO 90-84RESOLUTION NO. 90-54 RESOLUTION OF APPLICATION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 292 (GARNSEY/. WHEREAS, the City of Bakersfield desires to propose a change of organization, to wit, the annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 35140 of the Government Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that it hereby finds ~nd determines as follows: 1. That the City of Bakersfield hereby proposes the annexation to the City of Bakersfield of the territory described in Exhibit "A", attached hereto and made a part of this resolution as though fully set forth herein. 2. That a map of the territory proposed to be so annexed, marked Exhibit "B", is attached hereto and made a part of this Resolution as though fully set forth herein. 3. That a Plan for providing services within the affected territory of the proposed annexation, in accordance with the provisions of Section 35102 of the Government Code, is marked as Exhibit "C", attached hereto and made ~ part hereof as though fully set forth herein. 4. That this proposal for change of organization, to wit, annexation, is made pursuant to the Municipal Organization Act of 1977 (Part 2 of Division 2 of Title 4 of the Government Code of the State of California, commencing with Section 35000 thereof), and it is requested that proceedings be authorized for annexation in accordance therewith. 5. That the reasons for the proposed change of organiza- tion are that the owners of the affected territory desire to receive municipal services from the City of Bakersfield, and the City desires to receive ta~ revenues for benefits given and to be given to the territory proposed to be annexed. 6. That zoning upon annexation of Garnsey shall be considered in separate proceedings, including analysis of environ- mental impacts, and that the environmental impacts of the annexation will be evaluated by the Local Agency Formation Commission of Kern County, as lead agency, during its proceedings. 7. Sweeping Lighting Sewer Most of the area is on septic tanks. However, City sewer connections are available at several locations such as on Stockdale Hwy., Real Road, Garnsey L~ne and Mira Loma Driw Additional sewer services to the area wi11 depend on the formation of a service assessment district. Present refuse collection service is provided by a fran- chise refuse collector. When annexed service will ibe provided by the City with Contracts with the same collecto~ if at all possible. Other Refuse 24-hr. patrol will be provided for this annexation. First priority response is approximately 7.5 minutes or less. Fire protection i~ provided on a 24-hr. basis with response time of 3 minutes or less. The annexation will not affect the capacity of City Fire protection service. 'City parks are available to citizens at reasonable hours, N/A lhere will be no reduction in the range or apacity of the City to provide the necessar F~blic works services to this area. Service~ ~ill be on a regular basis and "as needed." Adequate capacity exists. City garbage pickup is twice a week. VII. List city services that area will directly or indirectly benefit from such a's decrease in fire insurance rate, shorter em:zrgeney responge time, u~e of com- munity facilities, etc. City police should be able to respond in a more timely__ manner than present County Sheriff service. Current City Police standard is 1.65 sworn officers per 1,000 population compared to County standard 1.15. The City Fire Station No.'3 is about 1/4 mile to the east on Pal.~.Street in qaundPrq Park which can respond in 3 minutes or less. Certain areas within the annexation boundaries hmve already obtained City sewer service. Other services such as street maintenance/ __ construction, street sweeping, planninq etc. will be provided upon annexation. The_ area will directly benefit from these services and would help th~ dMiwry nf services to the area more economical and efficient than its present situation VIII. Generally located at the NE corner of N. McDonald Way and Stockdale Highway. County R-2 zoning is intended for two home occupations (ie. Clark Con- struction and Martha's Health and Beauty Salon) in the area. When annexed, they will be legal non- conforming uses in a City R-2 zone because of the differences in definitions between City and County R-2 zones. 12. Streets Total Opposite to R-2 district and generally located at the NW corner of N. McDonald Way and Stockdale High- way behind an existing office building. It is de- siqnated for parking use only. On both sides of Garnsey Ave. near Stockdale High- way. City R-3 zone can properly accommodate existing multi~family residential use. R-3-CH 0.93 A church use surrounded by County R-4 zone on the west- side of Garnsey Ave. City R-3-CH zone is proper for the existing church use. R-4 1.42 At the SE corner of the annexation area presently oc- cupied by the Henrietta Weill Memorial Child Guidance Clinic. The existing use is permited in City R-4 zone. C-O 0.59 At both NE and NW corners of N. McDonald Way and Stock- dale Highway presently occupied by office use, C-1 0.14 North of Stockale Highway and E. of Stine Canal. When annexed, the existing use (Stockdale Liquor and Deli. can be accommodated by a City C-1 zone. I C-2 0.36 Northeast corner of Stockdale and Garnsey Ave. The City prezoning is consistent with existing County zoning and land use for the Stockdale Auto Repair. P 0.24 tStreets 51.67 Acreage 172.23 Located to the west and adjacent to the Stockdale Liquor and Dell on the covered canal easement area which provides needed parking for the Liquor Store.
