HomeMy WebLinkAboutRES NO 89-94R~SOLUT~ON NO. 89-8~ A RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY OF THE CITY OF BAKERSFIELD REQUIRE THE CONSTRUC- TION OF ADDITIONAL PARKING AT THE BAKERSFIELD CIVIC AUDITORIUM AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF CERTAIN REAL PROPERTY, AND FURTHER DECLARING THE INTENTION OF THE CITY OF BAKERSFIELD TO ACQUIRE SAID PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS. WHEREAS, the Bakersfield Civic Auditorium is the only major indoor auditorium in the City of Bakersfield and the County of Kern; and WHEREAS, the Bakersfield Civic Auditorium provides the only indoor facility capable of providing certain forms of enter- tainment and civic events for the public use of residents of the City of Bakersfield and Kern County; and WHEREAS, there presently exists a shortage of public automobile parking areas at the Civic Auditorium; and WHEREAS, the City of Bakersfield desires to proceed with a project to provide additional public parking; and WHEREAS, that property located between "P" and "O" Streets, located at 1500 "O" Street described as: All of Lots 5, 6, 7 and 8, inclusive, of Block 332, City of Bakersfield, County of Kern, State of California is best situated to provide the necessary additional parking required for the Civic Auditorium; and WHEREAS, section 1240.010 of the California Code of Civil Procedure authorizes municipalities to exercise the right of eminent domain to acquire property necessary for public use; and WHEREAS, an September 25, 1980, and April 10, 1984, the City of Bakersfield made an offer to purchase the property at 1500 "©" Street, pursuant to Government Code section 7267.2, which offer has not been accepted. NOW, THEREFORE, City of Bakersfield that as follows: 1. The property taken for the BE IT RESOLVED by the Council of the the Council finds, determines and orders to be acquired, as described herein, purpose of providing public parking to support the Bakersfield Civic Auditorium, Procedure, section 1240.010. 2. The property to be acquired is located at 1500 "Q" Street, and more particularly described as follows: All of Lots 5, 6, 7 and 8, inclusive, of Block 332, City of Bakersfield, County of Kern, State of California. 3. The public interest and necessity require the addition of parking to the Civic Auditorium and the acquisition of good and the least private injury. 5. For the purpose of preparing, commencing and conclud- ing said proceedings, the City Attorney is authorized to retain and hire experts and employ and use any other professional service the City Attorney deems reasonably necessary for the commencement, prosecution and conclusion of said proceedings. .......... o0o ..........
