A RESOLIJTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING THE PUBLIC WORKS
MANAGER TO SIGN AN APPLICATION BY THE CITY
OF BAKERSFIELD 'FO THE PUBLIC UTILITIES
COmmISSION OF '?HE STATE OF CALIFORNIA
FOR AN ORDER AUTHORIZING CONSTRUCTION
OF THE SEPARATION STRUCTURE UNDER THE
MAIN LINE TRACK OF THE ATCHISON, TOPE~
& SANTA FE RAILWAY ON "H" STREET.
WHEREAS, the Cily of Bakersfield, in cooperation with the
Greater Bakersfield Separation of Grade District, proposes to construct
a railroad crossing at separated grades between "H" Street and the rail-
road tracks of the Santa Fe Railway; and.
WHEREAS, the City of Bakersfield will arrange financing with
its own funds, California State Grade Separation funds, Greater Bakersfie]d
Separation of Grade District funds, and a contribution from the Railway;
and
WHEREkS, the tracks are the property of The Atchison, Topeka
& Santa Fe Railway Company; and
WHEREAS, no public road, highway or street may be constructed
across the track of any railroad corporation without first having secured
the permission of the Pub]ic Utilities Commission.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield, as follows:
1. The Public Works Manager is hereby authorized to sign, on
behalf of the City of Bakersfield, an Application by the said City to
the Public Utilities Commission of the State of California for an Order
authorizing construction of a separation structure under the mainline
track of The Atchison, Topeka & Santa Fe Railway Company on "H" Street.
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield,
hereof held on the 19%h day of December
