budget within the Old Town Kern Redevelopment Project Area Fund for Mill Creek
project infrastructure, utilities, and undergrounding. (Ward 2)
RECOMMENDATION:
Staff recommends approval.
BACKGROUND:
The Mill Creek Area project located between Golden State Highway, California and Union Avenues, and
"N" Street is under construction and will require infrastructure, utilities, and undergrounding improvements
These improvements will be located within the Old Town Kern-Pioneer Redevelopment Project Area.
On April 1, 2009, City Council appropriated $147,500 from Old Town Kern Redevelopment Project Area
Fund Balance, to the operating budget within the Old Town Kern Redevelopment Project Area Fund for
Mill Creek Area project infrastructure, utilities, and undergrounding. These improvements will be located
within the Old Town Kern-Pioneer Redevelopment Project Area.
On May 21, 2008, the City Council adopted Resolution 076-08 establishing the South Mill Creek
Underground Utility District, District 2, Division 32, under PG8~E Rule 20A and California Public Utility
Commission regulations to underground the electrical service for the Mill Creek Area project. The utility
company will remove their overhead facilities when the underground work is done; and the Rule 20A fund
allows for electrical service panel conversions for each commercial and residential customer.
Funds will be used to reimburse PG&E for $105,190.20 attached as "Exhibit A" for work completed to
date. In addition, the balance $42,309 will be used to reimburse ATBT for $38,858.02 attached as Exhibit
"B" for additional infrastructure and utility related improvements in the Mill Creek Area.

SUBJECT: Amendment No. 1 to Agreement No. BRDA07-007 with Overland, Pacific 8~ Cutler, Inc. for
$13,675 to provide additional relocation services for the South Mill Creek Mixed-Use
Project.
RECOMMENDATION:
Staff recommends approval.
BACKGROUND:
On September 17, 2007, the Bakersfield Redevelopment Agency entered into Agreement No. BRDA07-
007 with Overland, Pacific 8~ Cutler, Inc. for $36,225 to provide relocation services for the South Mill Creek
Mixed-Use Project. The relocation of Rick's Recycling and Dave Cross, Architect has been tedious,
detailed and extended due to minimal cooperation at times from both business owners. As a result,
Overland, Pacific & Cutler was required to provide additional documentation of relocation efforts in
addition to extensive consultations with legal advisors regarding condemnation proceedings to ensure the
Agency has negotiated the relocation of the businesses in good faith to the maximum extent feasible. The
additional relocation referrals, documentation of relocation efforts, and legal consultations has resulted in
additional costs to the project in an amount of $13,675. Staff is requesting that the Bakersfield
Redevelopment Agency approve Amendment No. 1 to Agreement No. BRDA07-007 for $13,675 for the
additional relocation efforts required for this significant mixed-use project located in the Southeast
Redevelopment Project Area. Compensation for all work, services or products called for under this
Agreement shall not exceed a total payment of $49,900.
