RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 293
(CHESTER NO. 1).
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 35140 of the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that it hereby finds and determines as follows:
1. That the City of Bakersfield hereby proposes the
annexation to the City of Bakersfield of the territory described
in Exhibit "A", attached hereto and made a part of this resolution
as though fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a part
of this Resolution as though fully set forth herein.
3. That a Plan for providing services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 35102 of the GovernmeDt Code, is marked
as Exhibit "C", attached hereto add made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is made pursuant to the Municipal Organization
Act of 1977 (Part 2 of Division 2 of Title 4 of the Government
Code of the State of California, commencing with Section 35000
thereof), and it is requested that
annexation in accordance therewith.
5. That the reasons for

tion are that the owners of the affected territory desire to
receive municipal services from the City of Bakersfield, and the
City desires to receive tax revenues for benefits given

CHESTER NO. 1
A parcel of land situated in the County of Kern, State of California,
being a portion of Section 19, Township 29 South, Range 28 East,
M.D.B. ~ H., more particularly described as follows:
Buginning at a point on the Existing Corporate Boundary of the City of
Bakersfield, which point is the intersection of the westerly extension
c:l the north right-of-way line of 34th Street, with the northeasterly
r7qnt-of-way line of the Southern Pacific Railroad Company, as shown
,Jr. the Map of the City of Bakersfield, filed April 19, 1904 in Hap
B,~ok 1, at page 13 in the Office of the Kern County Recorder;
Thence (1) Depart!ng from the Existing Corporate Boundary North 47°36'16"
West along the northeasterly right-of-way line of the Southern Pacific
Railroad Company a distance of 180.94 feet;
Thence (2) North 90°OO'OO" East a distance of 557.22 feet to a point
on the westerly rlght-of-way line of Chester Avenue;

tive maintenance'and "as needed" repair in-
cluding street construction and maintenance,

located about 130 feet W. of Chester Avenue. Effluent will
be treated by City Waste Water Treatment Plant #2.

What effects, if any, would annexation of this territory have on existing level
of city services (i.e., need for additional emergency service personnel or con-
struction of new facilities, etc.)? The annexation of this territory will not

Would city require any upgrading or change in facili{ies to serve affected terri-
tory (roads, fire hydrants, mains, etc.)? If so, would city or residents be

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc.) The proposed prezoninq or Zoning Upon Ann~xatinn will h~
M-2 (General Manufacturing Zone). Since the existing commercial u~e i~ permitted
under both ~ity M-2 or Count~v M-1 7nne. th~ pr~nnino would have little eff~rf
on present [and use ~nd it is consistent with the Bakersfield Metropolitan Ar~a
General Plan (BMAGP) Land Use Element.

List city services that area will directly or indirectly benefit from such ds
decrease in fire insurance rate, shorter emergency response time, use of com-
munity facilities, etc. City Police should be able to respond in a more timely
manner than present County Sheriff service. Current City Police standard is
1.65 swqrn officers per 1,000 population compared to County standard 1.15. The
City Fire Station No. 4 is about i mile to the east which can respond in 3 minutes
or Jess. Ihe area is also served with City sewer. Other services such as street
maintenance/construction, street sweeping, planning, street lighting, etc. will
be provided upon annexation. The area will directly benefit from the city
services and would help the delivery of urban services to the area more economical
and efficient than its present situation.

A.
Please provide the following information relative to city and county taxes:
List existing tax rate(s) in area. The existinQ tax rate in the area eq.al~
1.047719 percent of assessed market value. This represents the total propert~
tax rate. When annexed, approximately 30 percent of the total property tax
of the area will accure to the City and the remaininq, to the County for pro-
viding health care and social services.

List city tax rate(s). When annexed, the rate will be increased fn 1 856437
percent of assessed market value which equals the City bend rate nf
percent and the total property tax rate of 1,047719 percent (See A abnve).
C. How will the difference in tax rates affect a house with a market value of
~50,000 If the house is used as the principal residence it will h~ ~mp~ed
from tax for a value equal to $7~000; which leaves the house with a market
value of $43,000 for taxinq purposes. Since there is no difference in the
property tax rate w~hether the house is in the City or the County, the onl~
difference whi~ch m~a~ result form the annexation would be the ciiky bend rate
of 0.008718 percent. For this house, the difference in total prop*rt~ tax
equals O.00~7__l_8_gercent x $43,000 or $3,75 per year.
