HomeMy WebLinkAboutRES NO 91-84RESOLUTION NO. 91-54 RESOLUTION OF APPLICATION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 293 (CHESTER NO. 1). WHEREAS, the City of Bakersfield desires to propose a change of organization, to wit, the annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 35140 of the Government Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that it hereby finds and determines as follows: 1. That the City of Bakersfield hereby proposes the annexation to the City of Bakersfield of the territory described in Exhibit "A", attached hereto and made a part of this resolution as though fully set forth herein. 2. That a map of the territory proposed to be so annexed, marked Exhibit "B", is attached hereto and made a part of this Resolution as though fully set forth herein. 3. That a Plan for providing services within the affected territory of the proposed annexation, in accordance with the provisions of Section 35102 of the GovernmeDt Code, is marked as Exhibit "C", attached hereto add made a part hereof as though fully set forth herein. 4. That this proposal for change of organization, to wit, annexation, is made pursuant to the Municipal Organization Act of 1977 (Part 2 of Division 2 of Title 4 of the Government Code of the State of California, commencing with Section 35000 thereof), and it is requested that annexation in accordance therewith. 5. That the reasons for proceedings be authorized for the proposed change of organiza- tion are that the owners of the affected territory desire to receive municipal services from the City of Bakersfield, and the City desires to receive tax revenues for benefits given given to the territory proposed to be annexed. 6. be considered environmental and to be That zoning upon annexation of Chester No. 1 shall in separate proceedings, including analysis of impacts, and that the environmental impacts of the annexation will be evaluated by the Local Agency Formation Commission of Kern County, as lead agency, during its proceedings. 7. Streets Construction/Maintenance Sweeping Lighting The City corporation yard on Truxtun Ave. Ex- tension W. of Freeway 99 will provide necessary facilities, personnel & services to acc~modate Public Works Department efforts. Maintenance personnel will be dispatched fro~ the City corporation yard on a regular basis for preven- tive maintenance'and "as needed" repair in- cluding street construction and maintenance, sweeping of street, and street light maintenanc( Sewer Other The area is already connected to City sewer system which is located about 130 feet W. of Chester Avenue. Effluent will be treated by City Waste Water Treatment Plant #2. List city services that area will directly or indirectly benefit from such ds decrease in fire insurance rate, shorter emergency response time, use of com- munity facilities, etc. City Police should be able to respond in a more timely manner than present County Sheriff service. Current City Police standard is 1.65 swqrn officers per 1,000 population compared to County standard 1.15. The City Fire Station No. 4 is about i mile to the east which can respond in 3 minutes or Jess. Ihe area is also served with City sewer. Other services such as street maintenance/construction, street sweeping, planning, street lighting, etc. will be provided upon annexation. The area will directly benefit from the city services and would help the delivery of urban services to the area more economical and efficient than its present situation. VIII. A. Please provide the following information relative to city and county taxes: List existing tax rate(s) in area. The existinQ tax rate in the area eq.al~ 1.047719 percent of assessed market value. This represents the total propert~ tax rate. When annexed, approximately 30 percent of the total property tax of the area will accure to the City and the remaininq, to the County for pro- viding health care and social services. When annexed, the rate will be increased fn 1 856437 percent of assessed market value which equals the City bend rate nf percent and the total property tax rate of 1,047719 percent (See A abnve). C. How will the difference in tax rates affect a house with a market value of ~50,000 If the house is used as the principal residence it will h~ ~mp~ed from tax for a value equal to $7~000; which leaves the house with a market value of $43,000 for taxinq purposes. Since there is no difference in the property tax rate w~hether the house is in the City or the County, the onl~ difference whi~ch m~a~ result form the annexation would be the ciiky bend rate of 0.008718 percent.
