A RESOLUTION TERMINATING THE IMPROVEMENT
AGREEMENTS 08-201 AND 08-202 WITH THE
COMMUNITY ACTION PARTNERSHIP OF KERN FOR
THE IMPROVEMENTS IN THE CITY RIGHT OF WAY
FOR PARCEL MAP 11782.
RECITALS
WHEREAS, Improvement Agreements 08-201 and 08-202 with the Community
Action Partnership of Kern for Parcel Map 11782 were approved by the City Council on
November 19, 2008 for the installation of public improvements; and
WHEREAS, The Community Action Partnership of Kern is a not for profit agency
and has requested that their agreements 08-201 and 08-202 be terminated due to
economic hardship; and
WHEREAS, the Public Works Director has reviewed their request and concurs
with the Community Action Partnership of Kern that the agreements should be
terminated.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Bakersfield, as follows:
1. The foregoing recitals are true and correct and are incorporated herein.
2. The City Council hereby terminates Agreements 08-201 and 08-202 with the
Community Action Partnership of Kern.
3. It is the intention of the City Council that any future improvements for the
area covered by said agreements will require either a new improvement
agreement or will be approved by the appropriate permits issued at the
discretion of the City Engineer.
