A RESOLUTION DECLARING REAL PROPERTY
SURPLUS TO THE NEEDS OF THE CITY AND
AUTHORIZING THE FINANCE DIRECTOR TO
NEGOTIATE ITS SALE
WHEREAS, on July 22, 1908 the City acquired approximately 316.76 acres of land from
the Southern Pacific Railroad Company; and,
WHEREAS, Brandon Properties currently leases approximately 3.63 acres for its radio
towner has requested the City sell this property and an adjoining 9.7 acres described in Exhibit
"A" attached hereto to construct additional towers.
WHEREAS, on July 19, 2001 the Planning Commission will be asked to find the sale of
this property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to
Government Code Section 65402.
WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City
property deemed to be "surplus ".
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
The foregoing findings and recitals are true, correct, and incorporated herein.
2. Real Property located south of State Route 58 and approximately 1000 feet east of
Mount Vernon is hereby declared surplus to the City's needs and the Finance Director is
authorized to negotiate its sale. The real property is more fully described in Exhibit "A" attached
hereto and incorporated as though fully set forth.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on n nL 18 20 1

A parcel of land situated in the NW /4, Section 3, Township 30 South, Range 28 East, M.D.M.,
City of Bakersfield, County of Kern, State of California, more particularly described as follows,
Basis of Bearing; North 89 Degrees 51 Minutes 51 Seconds West, the North line of the NW /4,
Section 3, Township 30 South, Range 28 East, as shown on the Kern County
Surveyors Survey Investigation and Perpetuation Map 7 -1, Book 6, Page 89
Commencing at the North Quarter Comer of said Section 3;
TI4ENCE (1) South 00 Degrees 48 Minutes 54 Seconds West, along midsection line of said
section, a distance of 652.96 feet to the point of intersection with the southerly
right of way of State Highway 58 said point also being the TRUE POINT OF
BEGINNING;
THENCE (2) South 00 Degrees 48 Minutes 54 Seconds West, continuing along said
midsection line, a distance of 369.43 feet,
THENCE (3) North 89 Degrees 51 Minutes 54 Seconds West, a distance of 1375.15 feet,
THENCE (4) North 00 Degrees 55 Minutes 13 Seconds East, a distance of 469.32 feet to
the Southerly Right of Way of State Route 58, as described in Parcel A, book
5813 page 1424;
THENCE (5) South 86 Degrees 25 Minutes 33 Seconds East, along said Southerly Right of
Way of State Route 58, a distance of 510.01 feet to an angle point;
THENCE (6) South 85 Degrees 16 Minutes 48 Seconds East, along said Southerly Right of
Way of State Route 58, a distance of 866.65 feet to the TRUE POINT OF
BEGINNING;
