RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD
APPROVING AND ADOPTING SITE PLAN REVIEW POLICY
ADOPTED BY THE PLANNING COMMISSION REQUIRING MAJOR
RETAIL PROJECTS TO PAY SHARE OF COSTS OF PUBLIC
FACILITIES THE NEED FOR WHICH IS WHOLLY OR PARTIALLY
ATTRIBUTABLE TO SUCH PROJECTS, AND ESTABLISHING
PROCEDURE THEREFOR.
WHEREAS, on June 22, 1983, this City Council referred
to the Planning Commission a proposed ordinance amendment which
would have required that major retail projects, as therein defined,
be permitted only upon approval of conditional use permits in
order that the impacts of such pro3ects upon the demand for new
or upgraded public facilities be mitigated by conditions attached
to such permits; ann
WHEREAS, on July 7, 1983, the Planning Commission held
an advertised public hearing on the proposed ordinance and, at
the conclusion thereof, referred the matter to a special zoning
ordinance committee; and
WHEREAS, that committee, after considering the matter
at six meetings, including three meetings with representatives of
the development community, recommended to the Planning Commission
that it recommend to the City Council that the City Council not
adopt the referred ordinance but, in lieu thereof, that the
Planning Commission and the City Council adopt and approve the
site plan review policy set forth in Planning Commission Resolution
No. 55-83; and
WHEREAS, at its regular meeting held August 18, 1983,
the Planning Commission, by its Resolution No. 55-83, adopted a
site plan review policy which requires major retail projects to
pay their share of the costs of public facilities the need for
which is wholly or partially attributable to such pro3ects and
which establishes a procedure therefor, subject to the condition
precedent that the City Council authorize and direct the City
Engineer to contract with a consultant to assist staf~ and Planning
Commission committee in establishing parameters for application
of the policy, and forwarded such Resolution to this City Council
for approval in accordance with Section 17.53.051 of the Bakersfield
Municipal Code; and
WHEREAS, the City Council has considereG the resolution
and recommendation of the Planning Commission, concurs therein, and
has authorized the City Engineer to contract with such consultant.
NOW, THEREFORE, BE IT RESOLVED as follows:
The site plan review policy adopted by the Planning
Commission in its Resolution
adopted by this City Council,
pro3ects, as defined therein,
No. 55-83 is hereby approved and
to be applicable to all ma3or retail
as to which detailed final construc-
tion drawings and other related documents have not been submitted
for plan check and buildiny permit prior to September 1, 1983.
