ARESOLUTION 0FTHECOUNCILOFTHECITY(~BAKERSFI~
ORDERING THE VACATION OF A PORTION OF THE TWENTY-
FOOT ALLEY SOUTH OF HILTON HEAD WAY AND WEST OF
MOFFITT WAY IN THE CITY OF BAKERSFIELD.
WHEREAS, on the 8th of June, 1983, the Council of
the City of Bakersfield, pursuant to the provisions of the
"Public Streets, Highways and Service Easements Vacation Law," being
Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of
the State of California, passed and adopted its Resolution of Intention
No. 971 declaring its intention to order the vacation of a portion of
the twenty-foot alley south of Hilton Head Way and west of Moffitt Way
in the City of Bakersfield, County of Kern, State of California; and
WHEREAS, said Council did fix a time and place for
hearing all persons interested in or objecting to said proposed
vacation, which said hearing was held on the 13th day of 3uly, 1983,
after notices were duly published and posted as required by law; and
WHEREAS, this Council after duly considering the
matter, does hereby find and resolve as follows:
1. That a portion of the twenty-foot alley south of
Hilton Head Way and west of Moffitt Way in the City of Bakersfield,
County of Kern, State of California, more particularly described in
Exhibit "A" attached hereto and made a part hereof, is unnecessary
for present or prospective public street purposes.
2. That a portion of twenty-foot alley south of
Hilton Head Way and west of Moffitt Way in the City of Bakersfield
be and the same is hereby closed up, vacated and abandoned for
public street purposes, subject to and in conformity with any reser-
vations and exceptions contained in and contemplated by Resolution
of Intention No. 971. Reference to said Resolution of Intention is
hereby made for further particulars.
3. That the City Clerk shall certify to the passage
of this Resolution and shall cause a certified copy hereof, attested
by the Clerk under the seal of the City, to be recorded in the office
of the County Recorder of the County of Kern, California.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 13th day of July, 1983, by
the following vote:

VACATION OF A PORTION OF THE 20 FOOT ALI,E'x LOCATED
SOUTH OF HILTOY HEAD WAY AND WEST OF ~OFFITT WAY
A portion of the 20 foot alley adjacent to Lots 50 and 51 of Tract 4564
recorded June 26, 1981 in Map Book 51 at pages 27 and 28, in the Office of
the County Recorder, all within the City of Bakersfield, County of Kern,
State of California being a portion of Section 9, Township 50 South, Range 27
East, M.D.B.&M., more particularly described as follows:
Beginning at the southeast corner of said Lot 31, said corner being a
point on the west right of way line of Moffitt Way, and the Point of Beginn-
ing for this description;
Thence (1) South 00° 35' 13" West along the west right of way line of Moffitt
Way a distance of 7.65 feet to a point onatangent curve concave to the north-
west having a radius of 25 feet;
Thence (2) Southwesterly along the last named curve through a central angle
of 29° 5S' 31" an arc length of 12.91 feet;
Thence (5) Departing from the west right of way line of Moffitt Way North
89° 24' 47" West a distance of 129,87';
Thence (4) North 00° 35' 13" East a distance of 20 feet to a point on the
South line of said Lot
Thence (5) South 890 24' 47" East along the last named south line and the
south line of said Lot 31 a distance of 133.13 feet to the Point of Beginn-
ing.
