HomeMy WebLinkAboutRES NO 93-83RESOLUTION NO. 93-g3 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD DECLARING THAT IT HAS REVIEWED, EVALUATED, AND CONSIDERED THE INFORMATION CONTAINED IN THE FINAL EIR FOR A PROPOSED BAKERSFIELD AIRPARK EXPANSION PLAN, MAKING FINDINGS, AND CERTIFYING THAT SAID FINAL EIR HAS BEEN COMPLETED IN COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, THE STATE EIR GUIDELINES AND CITY COUNCIL RESOLUTION NO. 60-80. WHEREAS, the City had proposed the expansion and development of the Bakersfield Airpark including the following elements: 1. Acquisition of the existing Airpark facility by public body to insure continued operation. 2. Realignment of the runway. the aprons. 3. Extension of 4. Construction the runway. of new taxiways, holding aprons and parking walls. 5. Provision of new lighting and approach aids. 6. Erection of perimeter iencing and construction of buffer 7. Construction of new hangars and auto parking areas. Provision of access roads. ~.:ons;:ruction of an Airpark Control Tower. ~' :,i?EA.., a Draft Environmental Impact Report on the original propo:. ~ ~.~ .' ~ared by the C~ty of Bakersfield Development Services D~partmeni:, updated with current data by the Economic Development/Redevelopment Division of the City Manager's Office, circulated and distributed in accordance with the requirement of law and applicable regulations, the distribution list being included in the Final Environmental Impact Report; and WHEREAS, public and/or private agencies and/or individuals Report, as listed in the Final Environmental Impact Report; and WHEREAS, a duly noticed public hearing was held and conducted by and before the City of Bakersfield Planning Commission in accordance with the procedures required by City Resolution 60-80, on July 9, 1983, at which hearing the public was entitled to comment on the Draft Environmental Impact Report; and W~tEREAS, the City has responded in writing to all significant points raised by the public and private agencies and individuals in the review and public hearing process, and the Final Environmental Impact Report, consisting of the Draft Environmental Impact Report, comments and recommendations received on the Draft F~viron- mental Impact Report, including a list of persons or organizations and public agencies commenting on the Draft and the responses of the City as aforesaid has been completed by the Economic Development/Redevelopment Division of the City Manager's Office and placed on the Agenda of the Regular Meeting of the Planning Commission on July 9, 1983, for evaluation and consideration by said Commission; and WHEREAS, the City of Bakersfield Planning Commission, on the basis of the Bakersfield Airpark Expansion Plan EIR identifies a number of significant of potentially significant effects associated with the approval of the recommended Expansion Plan; and WHEREAS, the California Environmental Quality Act requires one or more of the following findings as to each significant effect: (1) Changes or alterations have been required in, or incorporated into, the project which mitigate or avoid the signifi- cant environmental effects thereof as identified in the Final EIR. (2) Such changes or alterations are within the responsi- bility and jurisdiction of another public agency and not the agency making the finding. Such changes have been adopted by such other agency or can and should be adopted by such other agency. (3) Specific economic, social, or other considerations make infeasible the mitigation measures or project alternatives identified in the Final EIR; and WHEREAS, such findings are supported by substantial evidence in the record summarized for each identified significant or potentially significant effect, below, accompanied by a statement of the facts supporting each finding: SOILS: Proposed runway extension and realignment may exceed allowable soil pressure limitations. All uses a high limitation for untreated steel pipe. Findings and Application: Finding (1), above, applies to area. Supporting Facts: Finding (1) applies to use with site specific soil testing for acceptable loadings and appropriate mitigation in allowed use, design or con- struction. GEOLOGY/SEISMOLOGY: Development subject to ground shaking, and flooding is possible in the event of the failure of the Lake Isabella Dam. The area has experienced subsidence during the 1926-70 period. Findings and Application: Finding (1) applies to the site and the proposed development. Supporting Facts: Finding (1) applies in the adherence to a uniform building code for all construction. Continue recharge of Kern River water and monitoring water withdrawl as subsidence mitigation. FLORA AND FAUNA: A loss of natural and agricultural vegetation and wildlife due to project. Findings and Application: Finding (1) applies to site as identified in the EIR. Supporting Facts: Finding (1) applies to the desig- nation of open space which will allow continued natural flora and fauna. LAND USE: Project will result in change of land use from vacant undeveloped land. Findings and Application: Finding (1) applies to this project. Supporting Facts: Development plan incorporates open space (for safety purposes) which will retain some of present land use character. CIRCULATION: Project will close portion of Planz Road (major arterial by county designation) and Madison Street will be improved and extended. An additional 6,500 ADT will be generated by the project. Findings and Application: Finding (1) applies to this project. Supporting Facts: Development plan outlines road extensions and funding sources for the proposed changes. The existing and proposed system can accommodate the additional traffic. NOISE: The project will result in an increase in noise e~f--~fs and a shift in location of noise contours in conjunction with runway realignment. Findings and Application: Finding (1) and (3) apply to this project. Suppgrting Facts: Proposed development plan calls for realignment which will change take-off and approach zones to clear areas thereby reducing the numbers of persons affected. Adopted land use plan for the area substantially reduces the population affected. Controls resulting from change in the operation of the facility have also reduced noise levels in the area. Finding (3) relates to the mitigation option of relocating the Airpark to another location. HEALTH AND SAFETY: Runway reorientation places departure further into the Meadows Field transition and holding zones. Extension of the runway puts PG&E tower within critical glide angle. Findings and Application: Finding (2) applies to this project. Supporting Facts: Take-off and landings, which are recommended to be to and from the west, and a limit for airpark traffic requiring maintenance below 1,400 feet MSL are within the purview of the Federal Aviation Administration. Recommendations for lighting on the PG&E Tower also would come from the offices of the FAA. POPULATION AND HOUSING: Area directly south of the project will be subject to greatest noise impact from the project. Findings and Application: Finding (2) applies to the project. Supporting Facts: Compliance with Title 24 energy requirements for all new construction will substantially reduce the noise level to 45 db in the surrounding area. Regulation by the public entity managing the Airpark can reduce noise levels through required aircraft modifi- cation. County Housing Rehabilitation programs include insulation which will reduce noise levels for low-moderate housing rehab participants. ECONOMIC FACTORS: Project will accelerate present industrial growth. Full development of the project and proposed industrial areas will double present industrial employment and generate secondary service jobs in the area. Findings and Application: Finding (2) applies to the project. Supporting Facts: Enforcement of equal opportunity legislation will enhance job opportunities for local residents. WHEREAS, the City of Bakersfield Planning Commission, on the basis of the Findings and Statement of Facts, has determined that the significant environmental effects raised in the EIR have been eliminated or substantially lessened and that any remaining, unavoidable significant effects have been found acceptable on the basis of specific economic, social or other considerations making additional mitigation or alternatives to the project infeasible and that no significant adverse environmental effects will result from modifications and additions recommended by the Planning Commission from the areas identified in the EIR; and WHEREAS, at its regular meeting on July 9~ 1983, the Planning Commission, after consideration of Final EIR and related documents, adopted its Resolution No. 46-83 recommending to the City Council that the Final EIR be certifie~ as completed in compliance with the California Environmental Quality Act, the State EIR Guidelines, and City of Bakersfield Resolution No. 60-80. o I~OW, THEREFORE, THE CITY COUNCIL HEPEBY DETERMINES, RESOLVES AS 1. 2. response as FOLLOWS: The above recitals are true and correct. That the Final EIR dated December, 1980, an appended FINDS AN~ including City document, has been reviewed, evaluated and considered by the City Council. 3. That the Final EIR has been completed in compliance with the California Environmental Quality Act, the State EIR Guidelines and the City of Bakersfield Resolution 60-80. 4. That the said Final EIR is an accurate and objective dis- cussion of the proposed project and adequately discusses and describes the environmental considerations and mitigation measures. 5. That the various alternatives to the project, including "no project" have been considered in the Final EIR. 6. That in consideration of the above the City Council certifies that the Final EIR is material including information contained in this compliance with the California Environmental Quality Act, EIR Guidelines and City of Bakersfield Resolution 60-80. ........... oOo ...........
