A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD REQUESTING THE BOARD OF SUPERVISORS
OF THE COUNTY OF KERN TO ORDER THE CONSOLIDATION
OF A GENERAL MUNICIPAL ELECTION, A SPECIAL
MUNICIPAL ELECTION FOR FILLING A VACANCY ON
THE COUNCIL IN WARD 1 AND A SPECIAL MUNICIPAL
ELECTION SUBMITTING CHARTER AMENDMENTS, WITH
THE GENERAL DISTRICT ELECTION TO BE HELD ON
TUESDAY, NOVEMBER 8, 1983, SETTING FORTH THE
EXACT FORM OF THE MEASURES TO BE VOTED UPON
AT SUCH SPECIAL MUNICIPAL ELECTIONS AS THE
SAME ARE TO APPEAR ON THE BALLOT.
WHEREAS, Section 23300 of the Elections Code of the
State of California provides that when two or more elections are
called to be held on the same day in territory that is in part
the same, they may be consolidated pursuant to Chapter 4, Part 2
of Division 14 (commencing with Section 23300) of the Elections
Code, upon the order of the governing bodies calling the elections;
and
WHEREAS, the Council of th~ City of Bakersfield by
Resolution No. 89-83 has called a special election for Ward 1 for
the purpose of filling the unexpired term of a Council vacancy
and a special election for the purpose of submitting to the
electors of the City of Bakersfield Charter amendments, said
elections to be held on Tuesday, the 8th day of November, 1983;
and
WHEREAS, the Council of the City of Bakersfield by
Resolution No. 88-83 has called a General Municipal Election in
Wards 2, 5 and 6 to be held on the 8th day of November, 1983 for
the purpose of electing councilmembers to the City Council of the
City of Bakersfield; and
WHEREAS, an odd-year General District Election has been
called to be held on Tuesday, the 8th day of November, 1983, in
territory that is in part the same as for the said City elections,
to wit, in territory which includes all the city limits of the
City of Bakersfield.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. That the Board of Supervisors of the County of
Kern is hereby requested to make an order, pursuant to Sections
23300 et seq. of the Elections Code of the State of California,
consolidating the City of Bakersfield Special Municipal Elections
and General Municipal Election called for November 8, 1983, with
the odd-year General District Election to be held on the same
date.
2. That the form of the City of Bakersfield Special
Municipal Election, Measure "A" and Measure "B", to be voted upon
within the City at said consolidated election, as same are to
appear on the ballot, are as follows:
City of Bakersfield Measure "A"
Shall Section (202)20 of the City Charter
be amended to remove the prohibition against YES
outside employment and to add provisions allow-
ing employees of the Fire Department to engage
in outside employment up to 312 hours per NO
calendar year quarter under conditions approved
by the Fire Chief?
City of Bakersfield Measure "B"
Shall Section (239)19 of the City Charter
be amended to remove the prohibition against YES
outside employment and to add provisions allow-
ing police officers to engage in outside
employment up to 20 hours per week under NO
conditions approved by the Chief of Police?
3. That the office in the Special Municipal Election
to fill the unexpired term in Ward 1 of the City of Bakersfield
and the candidates therefor be set forth in the ballot to be used
in Ward 1 at said consolidated election.
4. That the offices in the General Municipal Election
in Wards 2, 5 and 6 and the candidates therefor be set forth in
each ballot to be used at said General Municipal Election insofar
as the same is held within said territory affected by said order
of consolidation.
5. That the County Clerk is requested to conduct the
elections and is requested to provide within the territory affected
by request for order of consolidation, the election precincts,
polling places and voting booths, which shall, in every case, be
the same and there shall be only one set of election officers in
each of the precincts for the Special Municipal Elections hereby
called and the General Municipal Election to be held on the same
day, and that the offices in Wards 1, 2, 5 and 6 in the City of
Bakersfield and the candidates therefor be set forth in each
ballot to be used at said General Municipal Election insofar as
the same is held within said territory affected by said order of
consolidation.
6. That said Board is further requested to cause to
be set forth said mesures, as provided herein, and candidates, as
later provided, on all sample ballots relating to said City
election, and to mail to the qualified electors within the City
said sample ballots and voters pamphlets and arguments, if any,
relating to said election, all in the time and in the form required
by law, and to provide absent voter ballots for said election for
use by electors of the City of Bakersfield who may be entitled
thereto in the manner provided by law.
7. That the Board of Supervisors of the County of
Kern is hereby authorized to canvass, or cause to be canvassed,
the returns of said Special Municipal Elections and said General
Municipal Election with respect to the votes cast in the City and
to the votes cast for the offices of Councilmember in Wards 1, 2,
5 and 6 of the City of Bakersfield in said territory affected by
the consolidation herein and to certify such canvass of the votes
so cast to this Council.
8. That the City Clerk is hereby directed to transmit
and file certified copies of this resolution with the Board of
Supervisors of Kern County and the County Clerk of Kern County.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 6th day of July, 1983, by the
following vote:
