TOTAL PAID Stat Types:l RESOLUTION 110-01 A RESOLUTION ORDERING THE VACATION AND RELOCATION OF (2) RIGHT- TURN LANES (WITH ADJOINING ACCESS OPENINGS AND PUBLIC UTILITY EASEMENTS) ON THE NORTH SIDE OF STOCKDALE HIGHWAY, EAST OF CALLOWAY DRIVE (IN PARCEL MAP NO. 10625) IN THE CITY OF BAKERSFIELD ORi..GINAI RESOLUTION NO.~I 1 O- 0 1 A RESOLUTION ORDERING THE VACATION AND RELOCATION OF (2) RIGHT-TURN LANES (VglTH ADJOINING ACCESS OPENINGS AND PUBLIC UTILITY EASEMENTS) ON THE NORTH SIDE OF STOCKDALE HIGHWAY, EAST OF CALLOWAY DRIVE (IN PARCEL MAP NO. 10625) IN THE CITY OF BAKERSFIELD WHEREAS, on WEDNESDAY, JUNE 27, 2001, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, passed and adopted Resolution of Intention No. 1246 declaring its intention to order the vacation and relocation of (2) fight-turn lanes (with adjoining access openings and public utility easements) on the north side of Stockdale Highway, east of Calloway Drive (in Parcel Map No. 10625), in the City of Bakersfield; and WHEREAS, the Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, July 18, 2001, alter notices of said hearing were duly published and posted as required by law; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines (General Rule) in that there is no possibility that the proposed action could have a significant effect on the environment; and WHEREAS, at its meeting on June 7, 2001, the proposed vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield General Plan. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. The Council hereby orders the vacation and relocation of (2) right-mm lanes (with adjoining access openings and public utility easements) on the north side of Stockdale Highway, east of Calloway Drive (in Parcel Map No. 10625), in the City of Bakersfield, County of Kern, State of California, more particularly GSGROUPDAT~ADMINRPT~001XJullS\Resolution-2mumlnsPage 1 of 3 o described in Exhibit "A" and shown on Exhibit "B" attached hereto and made a part hereof by this reference. Public utility easement rights shall be reserved adjoining the above described strips of land as shown on said Exhibits "A" and "B". Also, all of the original (existing) 15 foot public utility easements shall be reserved and retained as shown on said Exhibit "B". The above described original (2) right turn lanes and access openings are unnecessary for present or prospective use for public street purposes and are hereby vacated and relocated subject to the conditions enumerated herein. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under seal of the city, to be recorded in the Office of the County Recorder of the County of Kern, California. ............... 000 ...............
