HomeMy WebLinkAboutRES NO 82-83RESOLUTION NO. 82-83 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGMENT V OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 1-83). the Land Use Element Plan is described as SEGMENT V: WHEREAS, the Council of the City of Bakersfield referred Segment V of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on April 21, 1983, on Segment V of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment V of the proposed amendment to of the Bakersfield Metropolitan Area General follows: THE CITY OF BAKERSFIELD has applied to adjust the range of residential land use designations in order to conform more closely with existing zoning densities and to achieve consistency in residential density classifications, as follows: Low Density Residential (0.5-5.49 d.u.'s/gross acre) Medium Density Residential (5.5-16.99 d.u.'s/gross acre) High Density Residential (17-45 d.u.'s/gross acre) WHEREAS, for the above-described Segment, an Initial Study was conducted, and it was determined that the proposed project would not have a significant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the preparation and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 60-80 have been duly followed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 30-83 on April 21, 1983, the Planning Commission approved Segment V of the proposed amend- ment and recommended approval and adoption of Segment V by this Council; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on June 15, 1983, on the above-described Segment V of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a newspaper of general circulation. NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for approved and adopted. Segment V is hereby 3. The report maps and all reports and papers relevant the Secretary of the Planning Commission hereby received, accepted and approved. of the Planning Commission, including thereto, transmitted by to the City Council, is 4. The City Council hereby approves and adopts Segment V of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan. 5. That this Segment ¥ of the proposed amendment to the Land Use Element be combined with other segments approved and adopted by this City Council, as set forth in separate resolu- tions, to form a single Land Use Element Amendment 1-83. .......... o0o ..........
