A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING SEGMENT IV OF PROPOSED
AMENDMENT TO THE LAND USE ELEMENT OF THE
BAKERSFIELD METROPOLITAN AREA GENERAL PLAN
(LAND USE AMENDMENT 1-83).
WHEREAS, the Council of the City of Bakersfield referred
Segment IV of a proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan to the Planning
Commission; and
WHEREAS, the Planning Commission of the City of Bakersfield,
in accordance with the provisions of Section 65351 of the Government
Code, held a public hearing on April 21,, 1983, on Segment IV of a
proposed amendment to the Land Use Element of the General Plan,
notice of the time and place of hearing having been given at least
ten (10) calendar days before said hearing by publication in the
Bakersfield california, a local newspaper of general circulation;
and
WHEREAS, such Segment IV of the proposed amendment to the
Land Use Element of the Bakersfield Metropolitan Area General Plan
is described as follows:
SEGMENT IV:
THE CITY OF BAKERSFIELD has applied to change
the land use designation on approximately 90
acres from Open Space (Physical Constraints)
and approximately 100 acres from Recreational
Commercial to Low Density Residential and to
amend the Land Use Element bo'undaries to
include the Low Density Residential designa-
tion for approximately 53 acres as defined in
the Rio Bravo NO. 2 Annexation to the City of
Bakersfield for property known as the Rio
Bravo Golf Course located south of State
Highway 178 and east of Miramonte Drive.
WItEREAS, for the above described Segment, an Initial Study
was conducted and it was determined that the proposed project would
not have a significant effect on the environment and a Negative
Declaration was prepared; and
WHEREAS, the law and regulations relating to the preparation
and adoption of Negative Declarations as set forth in CEQA and City
of Bakersfield Resolution 60-80 has been duly followed by the City
staff and the Planning Commission.
WHEREAS, by Resolution No. 29-83 on April 21,
1983, the Planning Commission approved Segment IV of the proposed
amendment and recommended approval and adoption of Segment IV by
this Council; and
WHEREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government
Code, conducted and held a public hearing on April 21, 1983, on
the above described Segment IV of the proposed amendment to the
Land Use Element of the Bakersfield Metropolitan Area General
Plan, notice of time and place of the hearing having been given
at least ten (10) calendar days before tlhe hearing by publication
in the Bakersfield Californian, a newspaper of general circulation.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED as
follows:
1. The above recitals and findings, incorporated herein,
are true and correct.
2. The Negative Declaration for Segment IV is hereby
approved and adopted.
3. The report of the Planning Commission, including
maps and all reports and papers relevant thereto, transmitted by
the Secretary of the Planning Commission to the City Council, is
hereby received, accepted and approved.
4. The City Council hereby approves and adopts Segment
IV of proposed amendment to the Land Use Element, constituting a
change from Open Space (Physical Constraints) on approximately 90
acres and from Recreational Commercial on approximately 100 acres
to Low Density Residential and the amendment of Land Use Element
boundaries to include the Low Density Residential designation for
approximately 53 acres located south of Highway 178 and East of
Miramonte Drive, as shown on map, the Planning Commission hereby
approves and recommends approval and adoption by the City Council.
5. That this Segment IV of the proposed amendment to
the Land Use Element be combined with other segments approved and
adopted by this City Council, as set forth in separate resolutions,
to form a single Land Use Element Amendment 1-83.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 15th day of June, 1983, by
the following vote;
