HomeMy WebLinkAboutRES NO 80-83 RESOLUTION NO. 80-83 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGmeNT III OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 1-83). WHEREAS, the Council of the City of Bakersfield referred Segment III of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on April 21, 1983, and continued said hearing to May 5, 1983, on Segment III of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is described as follows: SEGMENT III: THE CITY OF BAKERSFIELD has applied to include and designate solid waste disposal sites with- in the Open Space designation for the Bakersfield Landfill (80 acres) located North of Panorama Drive and the China Grade Landfill (118 acres) located in portions of Sections 1 and 2, Township 29 South, Range 28 East with access off Alfred Harrell Highway. and WHEREAS, for the above described Segment, an Initial Study was conducted and it was determined that the proposed project would not have a significant effect on the environment provided that the following mitigation measures are applied that will reduce poten- tially significant effects to an insignificant level: Landfill operations must comply with "minimum standards for solid waste handling and disposal" set forth by the State of California Solid Waste Management Board. Operations shall allow for a 100-foot "buffer strip" along the property boundaries of landfill facilities. No disturbance other than necessary for a perimeter service road and methane gas extraction shall be allowed within this area. The purpose of thi§ measure is to buffer areas with development potential from land- fill impacts including odor, noise, dust and methane gas migration. and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepara- tion and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution 60-80 has been duly followed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 28-83 on May 5, 1983, the Planning Commission approved a portion of Segment III of the pro- posed amendment and recommended approval and adoption of a portion of Segment III known as the China Grade Landfill portion, by this Council; and WHEREAS, the Council of the City of Bakersfield~ in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on June 15, 1983, on the above-described Segment Ill of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a newspaper of general circulation. NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration with mitigating measures for Segment III is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received. 4. That Segment Ill of proposed amendment to the Land Use Element, as shown generally on the map attached hereto, is hereby approved and adopted, subject to the following conditions in mitigation: Landfill operations must comply with "minimum standards for solid waste handling and disposal" set forth by the State of California Solid Waste Management Board. Operations shall allow for a 100-foot "buffer strip" along the property boundaries of landfill facilities. No disturbance other than necessary for a perimeter service road and methane gas extraction shall be allowed within this area. With respect to the Bakersfield Landfill along: (1) The Columbus Street - Panorama Drive access be restricted to refuse trucks operated by the City and by the City's contractors. (2) Hours of operation shall be 8:00 a.m. to 6:00 p.m. (3) The east side of the most easterly ridge shall not be disturbed. 5. That this Segment III of the proposed amendment to the Land Use Element be combined with other segments approved and adopted by this City Council, as set forth in separate resolutions, to form a single Land Use Element Amendment 1-83. .......... ooo ..........
