HomeMy WebLinkAboutRES NO 79-83RESOLUTION NO. 79-83 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND CONDITIONALLY APPROVING SEGMENT II OF PROPOSED AMENDMENT TO THE LAND USE ELE- MENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 1-83). WHEREAS, the Council of the City of Bakersfield referred Segment II of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on April 21, ]983, on Segment II of a proposed amendment to the Land Use Element: of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing Bakersfield Californian, a local newspaper and by publication in the of general circulation; WHEREAS, the Land Use Element Plan is described as SEGMENT II: such Segment II of the proposed amendment to of the Bakersfield Metropolitan Area General follows: DR. SAMI SROUR (by William Tuculet, A.I.Ao) has applied to change the Low Density Residential designation to Medium Density Residential for 6.66 acres located on the east side of Stine Road, approximately 150 feet north of Pine Castle Avenue. WHEREAS, for the above-described Segment, an Initial Study was conducted, and it was determined that the proposed project would not have a significant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the preparation and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 60-80 have been duly followed by the City staff and the Planning Commission; and WHEREAS, the Planning Commission approved Segment II, subject to P.U.D. (Planned Unit Development) zoning to include the following items: a. All buildings adjacent to the north, east and south property lines be limited to single story to be more compatible with adjacent lower density residential develop- ment. b. A minimum of 25-foot rear yard setback adjacent to the north, east and south property lines for privacy and noise control. c.Recreation facilities shall be located in the central area. d. Interior buildings be designed to elim£- nate overlook into adjacent residential properties. WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on June 15, 1983, on the above-described Segment II of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a newspaper of general circulation. NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED as follows: i. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment II is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved~ 4. The City Council hereby approves and adopts Segment II of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, subject to P.U.D. (Planned Unit Development) zoning to include the following items: ao All buildings adjacent to the north, east and south property lines be limited to single story to be more compatible with adjacent lower density residential develop- ment.
