A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS THAT A MAJORITY
PROTEST HAS NOT BEEN MADE AND ORDERING THE
TERRITORY DESIGNATED AS PROCEEDING NO. 792,
ANNEXATION NO. 285 (RIO BRAVO NO. 2), ANNEXED
TO THE CITY OF BAKERSFIELD.
WHEREAS, Resolution of Application No. 72-82, dated
July 7, 1982, was submitted to the Local Agency Formation
Commission of Kern County ("Commission") for the annexation of
territory to the City of Bakersfield designated as Proceeding
No. 792, Annexation No. 285 (RIO BRAVO NO. 2); and
WHEREAS, a duly noticed public hearing upon said
held before the Commission on the 28th day of December,
was

proposal
1982;
WHEREAS, following said public hearing, the Commission,
on December 28, 1982, adopted its Resolution Making Determination
being Resolution No. 82-22, recorded in Minute Book 29 of said
Commission; and
WHEREAS, on February 2, 1983, the Council of the City
of Bakersfield, adopted its Resolution No. 22-83, initiating
proceedings for annexation of the said territory to the City of
Bakersfield, and setting Wednesday, the 9th day of March, 1983,
at the hour of 7 p.m. (or as soon thereafter as the matter could
be heard) in the Council Chambers of the City Hall, 1501 Truxtun
Avenue, Bakersfield, California, as the time, date and place of
hearing on the proposed annexation where and when any owner of
land within the hereinafter-described territory could appear
before the Council of the City of Bakersfield and show cause why
such territory should not be annexed and the owners of land
within the said territory were duly informed of their right to
file a written protest against the annexation with the City Clerk
at any time prior to the conclusion of the hearing on the proposed
annexation; and
WHEREAS, the public hearing was duly and regularly con-
ducted by and before the City Council in all respects in accordance
with Resolution No. 22-83, on March 9, 1983.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the
Council of the City of Bakersfield as follows:
1. In accordance with Section 35229 of the Government
Code, it is hereby found regarding the value of written protests
filed and not withdrawn by owners of land and improvements, at
the conclusion of the public hearing, as follows:
No written protests against the said annexation were
filed with the Clerk of the City of Bakersfield at any time prior
to the conclusion of the public hearing on the proposed annexation.
2. The description of the exterior boundaries of the
territory annexed is contained in Exhibit "A", attached hereto,
and incorporated in this Resolution as though fully set forth
herein.
3. That the said territory designated as Proceeding
No. 792, Annexation No. 285 (RIO BP~AVO NO. 2), and described
herein, and every part thereof, is hereby ordered annexed to the
City of Bakersfield.
4. That the Clerk shall forthwith transmit a certified
copy of this resolution ordering a change of organization, along
with any required remittance to cover the fees required by Section
54902.5 of the Government Code, to the executive officer of the
Local Agency Formation Commission of Kern County.
5. That the executive officer of the Commission is
hereby requested to prepare and execute a certificate of completion
and make the filings required by Chapter 4 of the Municipal
Organization Act of 1977 and record a certified copy of the
certification of completion with the recorder of Kern County,
with the surveyor of Kern County and with the Clerk of the City
of Bakersfield.

I HEREBY CERTIFY that the foregoing Resolution was

regular meeting thereof held on the 9th day of March, 1983, by

RIO BRAVO NO. 2
A parcel of land sithated in the County of Kern, State of
Califoraia, being a portioa of Sections 15 and 23, Township 29 South,
Range 29 East, H.D.B. & M., more particularly described as follows:
Beginning at the northeast corner of said Section 23, said
corner being.a point on the existing Corporate Boundary of the City
of Bakersfield and the Trne Point of Beginning for this description}
TiIENCE (1) Departing said Corporate Boundary southerly along the
east line of said Section 23 to intersect the south line of the
north 180 feet of said Section 23;
THENCE (2) l'lesterly along the last named south line one mile, more
or less, to intersect the west line of said Section 23;
TtIENCE (3) Northerly aim:f, the last named west line to intersect
the north line of said Section 23., said intersection being the
northwest corner of said Sect}on 23 and the southeast corner of
said Section 15;
THENCE (4) South 89° 59' 20" 17est along the south lioe of said
Section 1S a distance of 462.08 feet to a point on a non-tangent
curve concave to the east which bears South 67° 07' 04" West a
radial distance of 1245 feet from the center of said curve, said
poiat also being a point on the wesl right of way line of the
proposed Miramonte Drive;
TtiENCE (S) Continuing along the last named right of way line throogh
the following 5 courses: norther]y along the lnst natned curve
through a ceotral angle 10o 28' 56" an arc length of 227.77 feet;
TdI:NCE (6) North 12° 24' 00" h'est a distance of 641.04 feet to a
point on a tangent curve concave to tilt'. east having a radius of
1245 f~et;
THENCE (7) Northerly along the last named curve through a central
angle of 58° 03' 30" an arc length of 826..98 feet;
THE?!CE (8) North 25° 39' 30" East a distance of 967.62 feet to a
point on a tangent curve concave to the west having a radius of
1155 .feet;
THENCE (9).Northerly along tile last named curve through a central
angle of 6° 31' 53" an arc length of 1~1.66 feet to a point on the
north line of the south half of said Section 15, said point being
a point on the Existing Corporate Boundary of the City of Bakersfield;
T?~NCE (10) Easterly and southerly and easterly along the last named
Corporate Boundary to the Point of Beginning.
