HomeMy WebLinkAboutRES NO 35-83RESOLUTION NO. 35-83 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS PROCEEDING NO. 796, ANNEXATION NO. 286, IN ACCORDANCE WITH LAFCO RESOLUTION MAKING DETERMINATION (KERN RIVER NO. 8). WHEREAS, a proposal was submitted to the Local Agency Formation Commission of Kern County ("Commission") for the annexa- tion of territory to the City of Bakersfield dasignated as Annexa- tion No. 286 (KERN RIVER NO. 8); and WHEREAS, a duly noticed public hearing upon said proposal was held before the Commission on the 25th day of January, 1983; and WHEREAS, following said public hearing the Commission, on January 25, 1983, adopted its Resolution Making Determination, being Resolution No. 83-4, recorded in Minute Book 29 of said Commission. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. Preliminary proceedings for annexation of territory to the City of Bakersfield designated as Annexation No. 286 (KERN RIVER NO. 8) were authorized by the City Council of the City of Bakersfield by action at a regular meeting thereof held on September 15, 1982; Application for Annexation dated September 20, 1982, was transmitted to LAFCO; the Certificate of Filing of the Executive Officer of the Commission shows that the proposal was filed by him on the 9th day of December, 1982. 2. The distinctive short form designation assigned by the Commission to the territory proposed to be annexed is: "City of Bakersfield Annexation No. 286 (KERN RIVER NO. 8)." 3. The description of the exterior boundaries of the territory proposed to be annexed is contained in Exhibit "A", attached hereto, and incorporated in this Resolution as though fully set forth herein. ANNEXATION NO. 286 KERN RIVER NO. 8 A paireel of' land situated in the County of Kern, State of California, being a p,)rtion of Sections 26, 27, 53, and 34, Township 29 Sputh, Range 27 East, M.i'.B. & H., more particularly dcsc~ibed as :follows: Commencing at a point on the east ]iae o1' said Section 33 which bears Sonth (lO° 26' 04" West a distance of 1000 fcdt from the northeast co~er of said Section 53, said poznt being a point on the Existing Co.orate Boundary of cbe City of Bakersfield; thence North 89° 08' 2,1" West along the last named Corporate Bo~dary a distance of 1170.374 feet to a point on the northerly line of Parcel 6B of that certain Quitclaim Deed from Tenneco West, Inc., to the City of Bakersfield recorded June 6, 1977 in Official Records Book 5032, at page ,166 in the Office of the Kern County Recorder, said point being the Point of Beginnxng for this description; TIII!NCE (1) Departing from the Corporate Boundary o:f the City of gakersfield Nm'tb 09° 46' 13" East along the last named northerly line a dlstance of 313.415 feet; 'lttlNCE (2) South 86° 05' 34" East a distanc~ of 490.34 feet; 'EltliNCl! The territory proposed to be annexed is uninhabited as determined by the Commission in its Resolution Making Determina- tion. 5. The reason for the proposed annexation as set forth in the proposal thereof submitted to the Commission are that the privately owned lands within the proposal, consisting of approx- imately 44.7 acres, are geographically located for more efficient services from the City of Bakersfield south of the Kern River, and the City-owned properties, consisting of approximately 96.6 acres, are more appropriate within the City for tax purposes. 6. BE IT FURTHER RESOLVED, that Wednesday, the 30th day of March, 1983, at the hour of 7 p.m. (or as soon thereafter as the matter may be heard) in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time, date and place of hearing on the proposed annexation where any owner of land within the said described territory may appear before the Council of the City of Bakersfield and show cause why such territory should not be annexed. Any owner of land within the described territory may file a written protest against the annexation with the City Clerk of the City of Bakersfield at 1501 Truxtun Avenue at any time prior to the conclusion of the hearing on the proposed annexation. 7. That the Negative Declaration as to this project is hereby adopted and approved by the City of Bakersfield. The project will not have a significant effect on the environment. 8. The land and improvements within the territory to be annexed shall be liable for the general indebtedness of the City existing at the time of annexation. 9. A Certified copy of this Resolution shall forthwith be transmitted to the Executive Director of LAFCO. .......... o0o ......... RJO: mro 2-10-83 2.
