A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING PROPOSED AMENDMENT TO
THE CIRCULATION ELEMENT OF THE BAKERSFIELD
METROPOLITAN AREA GENERAL PLAN BY THE DELETION
OF PALM STREET EXTENSION BETWEEN REAL ROAD AND
STOCKDALE HIGHWAY.
WHEREAS, the Council of the City of Bakersfield referred
the proposed amendment to the Circulation Element of the Bakersfield
Metropolitan Area General Plan to the Planning Commission; and
WHEREAS, the Planning Conm~ission of the City of Bakersfield,
in accordance with the provisions of Section 65351 of the Government
Code, held a public hearing on December 16, 1982 on the proposed
amendment to the Circulation Element of the General Plan, notice
of the time and place of hearing having been given at least ten
(10) calendar days before said hearing by publication in the
Bakersfield Californian, a local newspaper of general circulation;
and
WHEREAS, such proposed amendment to the Circulation
Element of the Bakersfield Metropolitan Area General Plan is
described as follows:
GRACE POTTER has applied to delete the designation
of Palm Street West of Real Road[ with connection
to Stockdale Highway as a major collector street;
and
WHEREAS, for the above-described matter, an Initial
Study was conducted and it was determined that the proposed
project would not have a significant effect on the environment
and a Negative Declaration was prepared; and
WHEREAS, the law and regulations relating to the
preparation and adoption of Negative Declarations as set forth
in CEQA and City of Bakersfield Resolution No. 60-80 have been
duly followed by the City staff and the Planning Commission; and
WHEREAS, the present plan would extend a major collector
street into an established residential neighborhood thereby
requiring the removal of homes and the relocation of residents
and extensive street improvements, including the covering of the
Stine Canal at an estimated cost of $2.2 million; and
WHEREAS, the proposed amendment is consistent with a
Circulation Element policy requiring that major streets bound
rather than cut through residential neighborhoods and Land Use
Element policies calling for preserving and enhancing existing
residential neighborhoods and promoting efficient and adequate
circulation without cutting through the neighborhood; and
WHEREAS, the reservation and dedication of land for
said future street without compensation would result in a burden
on the properties through which it would pass exceeding reasonable
benefits to the properties themselves and the public in general;
and
WHEREAS, the Metropolitan Bakersfield Circulation
Study (revised September, 1982) indicates that the extension of
Palm Street "is not critical due to the proposed improvements at
other locations, especially the S. H. (State Highway) 99/S. H.
58 interchange. If difficulty in implementing this project is
anticipated it would be justified to eliminate it" (P. V-8);
and
WHEREAS, the S. H. 99/S. H. 58 interchange project,
which will alleviate present and future potential traffic impacts
in the California Avenue and Real Road areas, has been approved
and funds allocated by the California Transportation Commission
with design plans in preparation by CALTkANS; and
WHEREAS, the proposed amendment to the Circulation
Element is consistent with both Circulation and Land Use Element
policies recommending that major streets be planned to form
boundaries for neighborhoods in order to preserve residential
living environments; and
WHEREAS, by Resolution No. 107-82 on December 18,
1982, the Planning Commission approved the proposed amendment to
the Circulation Element and recommended approval and adoption of
the same by this Council; and
WHEREAS, the Council of

THEREFORE, IT IS HEREBY FOUND AND RESOLVED as

The above recitals and findings, incorporated
true and correct.
The Negative Declaration for the proposed amendment
is hereby approved and adopted.
3. The report of the Planning' Commission, including
maps and all reports and papers relevant thereto, transmitted by
the Secretary of the Planning Commission to the City Council, is
hereby received, accepted and approved.
4. The City Council hereby approves and adopts the
afore-described amendment to the Circulation Element of the
Bakersfield Metropolitan Area General Plan, deleting approximately
0.72 miles (or 3800 feet) of an extension of Palm Street from
Real Road on the north and east to Stockdale Highway on the
south and west.
