O57 09 A RESOLUTION OF THE CITY OF BAKERSFIELD AUTHORIZING THE EXECUTION OF A NEIGHBORHOOD STABILIZATION LAND BANKING PROGRAM AND AUTHORIZATION FOR THE CITY MANAGER OR HIS DESIGNEE TO IMPLEMENT THE NEIGHBORHOOD STABILIZATION LAND BANKING PROGRAM, EXECUTE ANY AND ALL DOCUMENTS AND MAKE MINOR REVISIONS IF NECESSARY. WHEREAS, the Congress of the United States has enacted Title III of Division B, of the Housing and Economic Recovery Act of 2008 ("Act" herein) for the purpose of assisting in the redevelopment of abandoned and foreclosed homes under the Emergency Assistance for Redevelopment of Abandoned and Foreclosed Homes heading, referred to as the Neighborhood Stabilization Program ("NSP" herein); and WHEREAS, CITY has submitted required documents to the Department of Housing and Urban Development ("HUD" herein) for receipt of a Neighborhood Stabilization Program Grant ("Grant" herein) under the Act, and WHEREAS, the City Council approved a Land Banking program with up to $2,007,730 from NSP funds for acquisition of foreclosed (dilapidated and/or distressed) housing structures within the qualified NSP(Redevelopment) areas; and WHEREAS, the program is expected to benefit LMMH (low-, moderate-, and middle-income housing) households < 120% of area median income with projects that could entail new affordable housing, public park uses, and mixed residential/commercial uses; and WHEREAS, the City of Bakersfield (a chartered city and municipal corporation) has determined that a high priority exists for safe and affordable housing; and WHEREAS, the Land Banking Program is intended to assist in the redevelopment of abandoned and foreclosed homes and provide for future infill development; and WHEREAS, the City will ensure NSP-assisted units meet affordability requirements in accordance with HOME program standards at 24 CFR 92.252 (a), (c), (e) and (f) and 92.254; and o~gAKF9~ m U r O ORIGINAL WHEREAS, affordability requirements for housing related activities will be imposed by deed restrictions, covenants running with the land, or other mechanisms approved by HUD, except that the affordability restrictions may terminate upon foreclosure or transfer in lieu of foreclosure; and NOW, THEREFORE, BE IT RESOLVED by the City of Bakersfield of the City of Bakersfield as follows: SECTION 1. The City of Bakersfield authorizes the City Manager or his designee to implement the Neighborhood Stabilization Land Banking program and execute any and all documents and make minor revisions if necessary. SECTION 2.
