It was apparently set aside a long time ago by the County for possible continuance of Watts Rd. in the future. Proposed area has been used by previous owners for decades to graze animals, and long ago they installed a barbed wire fence running through it (east to west) for this purpose. The area is lined with some old cottonwood trees that provide some shade for the grazing animals during our hot summers. Present owner would like to continue using area for this purpose with City's blessing. Owner would continue to maintain area, remove any junk and debris from area (dumped by outside sources/jtransients in the past), keep it tidy, as well as try to keep nearby cottonwood trees well watered. Our insurance policy well exceeds the City's requirement of $300,000, and specifically mentions this area so as to assure the City that their guidelines are being fully complied with and that they are completely covered as far as liability goes. My original e -mail (attached) was partially in error. I was misled by the resident I referred to in that e-mail. He is not the property owner of any of the 19 acres (15 14 Watts Drive and the surrounding 18 or so acres). I also did not realize the real property owner, Father Joseph Chaffee), has applied for an encroachment permit from the City. He would like some horses to remain just north of his 19 acres and what may be (I have not heard back from on this yet on just where its right of way ends on Watts Drive)) the City's right of way. This is the only area that has shade and easy access to the entire 19 acres. Historically, this piece has been used by previous owners and is behind the barbed wire fence. Watts Drive dead ends at the gate. The property owner has started installation of a security camera to protect this portion of his property. Prostitution has been known to occur just outside the gate on Watts Drive. My question is will the City be able to approve an encroachment permit on the merits of this request? When will you make a final decision? I was out at the site this morning and talked to Father Joseph Chaffee. I didn't tell him I was investigating anything. I was just checking our stockpile. Father Chaffee told me that he had bought the property (approx. 4 acres ?), located at 1514 Watts Drive, 3 years ago. He said that someone told him (didn't say who), that someone from Public Works would be out there to see if they could help him clean the lot. Also, he has applied for an encroachment permit to keep the horses on what he said was City Right -of- Way. I have seen Mr. Vahalkis moving some of the items (old cars, an old tractor, etc, etc.) file: //C:\Documents and Settings\rljohnso\Local Settings \Temp\XPgrpwise \48EB1F18CO... 10/7/2008 Page 3 of 3 there or stored on the property. Randy Johnson, Subdivision, is still looking into whether the City has a Right -of -Way. FYI: First of all I got the impression from Father Chaffee that Mr. Vahalkis does not own the property at 1514 Watts Drive. Also, if the City does have a Right -of -Way the horses should not be allowed on it. Approximately 17 or 20 years ago we had the area where the animals are kept (see attached photos) surveyed. We were going to pave it so that City employees that worked at Plant 2 and then the Woodsite could get to work from Cottonwood Road. But, some illegal dumping started and gardeners started to use the road; so we installed the chain -link fence on the north side and in front of the 32/40 foot area. Looking at the photo you can see where we installed the fence from the stop sign to the left and along the north side of the property. The barbwire fence that runs along the property has always been there. I don't know who Father Chaffee was waiting for from Public Works. But, if you want I can go out there and tell him that the City (PW) cannot go onto private property and clean it.
