RESOLUTION NO. 0 7 0 09
A RESOLUTION ESTABLISHING SEWER AND
STORM SEWER SERVICE USER CHARGES
WHEREAS, Chapter 14.12 of the Bakersfield Municipal Code authorizes the
establishment and increase of fees and charges to recover costs for services rendered;
and
WHEREAS, a public hearing before the City Council was advertised twice in the
Bakersfield Californian, a newspaper of general circulation and also hearing
notifications were sent to users by mail; and
WHEREAS, a public hearing was held to determine whether the proposed fees
and charges are discriminatory or excessive; and
WHEREAS, the fees and charges set forth in Exhibit "A" and Exhibit "B",
attached hereto and incorporated by reference, do not exceed the reasonable estimated
cost of providing the services for which the fees are charged.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
BAKERSFIELD AS FOLLOWS:
1. The above recitals and findings are true and correct and are incorporated
herein by reference.
2. The fees and charges set forth in Exhibit "A" and Exhibit "B" are hereby
adopted and shall become effective on July 1, 2009.
3. The adoption of these fees and charges complies with Proposition 218.
4. Pursuant to the Bakersfield Municipal Code, the fees and charges herein
shall be collected by the Kern County Tax Collector on the property tax
rolls.

This surcharge is to recover capital expenditures and administrative costs.
II. Surcharge for Outside Users

All outside users pay the same annual user fee as City residents. In addition, a surcharge fee is assessed to
cover capacity charge for reserving a portion of City's trunk line and sewage treatment facilities and a capital
charge for recovering of subsequent City capital costs.

V. Wastewater/Stormsewer Apportionment
The rates contained in this exhibit cover 100% of costs reasonably incurred in providing the
operation, maintenance, replacement, and capital improvements of the existing wastewater plants,
sewers, and storm sewer systems. Ninety-four and a half (94.5) percent of said rates are
attributable to sanitary sewer use, maintenance, replacement and improvements and five and a half
(5.5) percent of said rates are attributable to storm sewer use , maintenance, replacement and
improvements.

TSS - Means "total suspended solids"
