AMENDMENT NO. 1 TO RESOLUTION NO. 036-01
ESTABLISHING UNDERGROUND UTILITY DISTRICT NO.
2, DIVISION 27 (STOCKDALE)
WHEREAS, Resolution No. 036-01 establishing Underground Utility District
No. 2 Division 27 (Stockdale), was adopted on March 14, 2001; and
WHEREAS, Pacific Gas and Electric has requested a boundary modification
in phase II of the district; and
WHEREAS, the City agrees with the modification requested by Pacific Gas
and Electric; and
WHEREAS, the City has requested annexation of approximately 1/4 mile of
Stockdale Highway in the unincorporated area west of Ashe Road; and
WHEREAS, the City desires to include that portion of Stockdale Highway in
the unincorporated area within the boundaries of the district.
NOW, THEREFORE, BE IT RESOLVED that the Council hereby amends
Resolution No. 036-01 as follows:
UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 27
PHASE II is hereby revised to read as follows:
PHASEII
Those portions of Sections 33 and 34, T. 29 S., R. 27 E., and Sections 3 and
4, T 30 S., R. 27 S., M.D.B.&M. being more particularly described as follows:
Commencing at the point of intersection of the West line of said Section 34,
also being the east line of Section 33, and the North right of way line of
Stockdale Highway and frontage road (150 feet wide), thence easterly along
said North right of way line a distance of 10.00 feet to the TRUE POINT OF
BEGINNING;
Thence (1) Easterly, along said North right of way line, a distance of 2630
feet, more or less, to intersect the mid section line of said Section 34, also
being the east end of the frontage road;
Thence (2) Southerly, along said mid section line and east end of the
frontage road, a distance of 40 feet to the north line of Stockdale Highway
(110 feet wide);
Thence (3) Easterly, along said north right of way line, a distance of 300.00
feet;
Thence (4) Southerly, at right angles to said north right of way line, a
distance of 110 feet, to intersect the south line of Stockdale Highway (110
feet wide);
Thence (5) Westerly, along said south right of way line, a distance of 2940
feet, more or less, to intersect the west line of said Section 3 also being the
east line of Section 4;
Thence (6) Continuing westerly along the south right of way line of Stockdale
Highway (110 feet wide) a distance of 5225 feet, more or less, to intersect
the northerly prolongation of the east right of way line of Gosford Road 110
feet wide);
Thence (7) Northerly, along northerly prolongation of Gosford Road and
Coffee Road, a distance of 110 feet, to intersect the north right of way line
of Stockdale Highway (110 feet wide);
Thence (8) Easterly, along said north right of way line of Stockdale Highway,
a distance of 600 feet, more or less, to the west end of the frontage road,
north of Stockdale Highway;
Thence (9) Northerly, along the west end of the frontage road, a distance of
40.00 feet to the north right of way line of Stockdale Highway and the
frontage road (150 feet wide);
Thence (10) Easterly, along the north right of way line of Stockdale Highway
and the frontage road, a distance of 1800 feet, more or less, to the east end
of the frontage road;
Thence (11) Southerly, along the east end of the frontage road, a distance
of 40.00 feet to the north right of way line Stockdale Highway (110 feet wide);
Thence (12) Easterly, along said north right of way line, a distance of 2825
feet, more or less, to intersect the east line of said Section 33;
Thence (13) Continuing easterly, along a line parallel to and 40.00 feet south
of the north right of way line of Stockdale Highway and frontage road (150
feet wide), a distance of 10.00 feet;
Thence (14) Northerly, along a line parallel to and 10.00 feet east of the west
line of said Section 34, a distance of 40.00 feet, to intersect the north right
of way line of Stockdale Highway and frontage road (150 feet wide), and the
TRUE POINT OF BEGINNING.
Phase III is hereby deleted.
Exhibit "A" is hereby amended and incorporated herein as part of the Resolution.
Except as otherwise amended herein, all other terms and conditions of Resolution No. 036-
01 shall remain in full force and effect.
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by Council of the City of Bakersfield at a regular meeting thereof held on
