Dear Mr. Wines,
In response to your letter dated December 23, 2008, wherein you advise that your records
indicate that the underground storage tank located at 3800 California Avenue has been out of
service for more than ninety (90) days, please be advised that this property is in Escrow, and
that the reapplication for a permit to use the tank or the removal of the tank will be at the
discretion of the Buyer. ~
Per your request, this letter is offered as documentation for your files, and to relieve Three-
Way Chevrolet Co. of the responsibility of properly closing the tanks by January 31, 2009, as
originally requested.
