HomeMy WebLinkAboutRES NO 103-98(1)RESOLUTION NO. 103-98(1) FIRST AMENDMENT TO RESOLUTION ADOPTING THE ALLEN ROAD PLANNED SEWER AREA AND MAKING FINDINGS RELATIVE THERETO. WHEREAS, Resolution Number 103-98 adopting the Allen Road Planned Sewer Area approved by City Council on July 15, 1998, is being revised to reflect actual bid prices rather than engineering estimates; and WHEREAS, pursuant to Section 66483 of the California Government Code, this Council is, upon the making of specified findings, authorized to adopt sewer plans for local and neighborhood sewer areas; and WHEREAS, the Allen Road Trunk Sewer Line serves an area which encompasses both City and County; and WHEREAS, the construction of the Allen Road Sewer Line is being funded by the City and the County - the City's portion being funded through the Sewer Enterprise Fund and from bond proceeds from Assessment District No. 96-2 (A.D. 96-2); and WHEREAS, the Council desires to create the Allen Road Planned Sewer Area (ARPSA), the boundaries of which encompass A.D. 96-2 as well as land outside the assessment district; and WHEREAS, certain properties within ARPSA but outside of A.D. 96-2 have not been assessed under A.D. 96-2, but upon connection to the Allen Road sewer facilities shall pay their proportionate share for use of said facilities as per the attached fee schedule to reimburse the City's Sewer Enterprise Fund; and WHEREAS, prior to approval of any development entitlement as defined in Bakersfield Municipal Code Section 16.32.060 E as to any of the above referenced properties, said properties shall be reassessed or shall reimburse their fair share of benefits provided by A.D. 96-2 and the proceeds shall be fairly apportioned to A.D. 96-2. NOW, THEREFORE, BE IT RESOLVED by the of the City of Bakersfield as follows: 1. The foregoing recitals are true and correct and incorporated herein. 2. The Council hereby finds that, as to the Allen Road Planned Sewer Area, as described in the plans (on file in the Public Works office), map and fee schedules attached hereto and incorporated herein by reference, subdivision and development of property within such area will require construction of sewer facilities, described in such plan, and that the fees provided are fairly apportioned either on the basis of benefits conferred on property for subdivision or on the need for such facilities created by the proposed subdivision and development other property within such area, The Allen Road Planned Sewer Area Plan is hereby adopted. .......... o0o ..........
