HomeMy WebLinkAboutRES NO 5-99RESOLUTION NO. 5 - 9 9 A RESOLUTION AUTHORIZING THE CLOSING OF CERTAIN BLOCKS OF 20TH STREET AND PARTS OF G STREET FOR FOX THEATRE FOUNDATION FUNDRAISING EVENT. WHEREAS, the Bakersfield Fox Theatre ("the Fox") has been designated a culture resource by the City of Bakersfield; and WHEREAS, the Fox Foundation ("the Foundation") is a non-profit corporation which was established to purchase and restore the Fox to its past glory; and WHEREAS, the Fox fronts on H Street and 20th Street and the Foundation owns the property where the Fox is located; and WHEREAS, 20"~ Street between H and G Streets is a designated parking mall and is one-way street upon which less than 1,400 vehicles travel daily; and WHEREAS, the Foundation wishes to hold an annual fundraising event to benefit the Fox's restoration effort to fund capital projects; and WHEREAS, the Foundation wishes to hold this event on 20t~ Street between H Street and just west of G Street and parts of G Street; and WHEREAS, the event will consist of dinner, music and other forms of entertainment; and WHEREAS, the Foundation wishes to serve alcoholic beverages as well as soft drinks at this event; and WHEREAS, the Bakersfield Municipal Code prohibits possession and consumption of alcoholic beverages on City streets; and WHEREAS, the Foundation shall cordon off the area of 20th Street and G Street with chain-link fence and make it inaccessible to anyone who has not purchased a ticket to the event in advance; and WHEREAS, the Foundation shall post security guards at the only entrances and exits of the chain link fence to ensure that no one enters the event without a ticket and no one leaves the event with any alcoholic beverages; and WHEREAS, the Foundation guarantees to return the streets to the condition they -- Page 1 of 4 Pages -- were before the event; and WHEREAS, the Foundation has contacted the businesses which will be affected by this event and street closure and they have no objections; and WHEREAS, as this event meets the definition of a special event pursuant to Bakersfield Municipal Code section 10.69, the Foundation will comply with all of the requirements of Bakersfield Municipal Code section 10.69 and will have obtained all other necessary permits to enable them to hold this event at that location; and WHEREAS, the event is expected to start at 5:30 p.m. and end at 11 p.m. the same night; and WHEREAS, the Foundation needs time to erect the fencing and set up the booths, tables, chairs and other displays for the event as well as time to tear down the fencing and booths and return the streets to their prior condition; and WHEREAS, because of the historic significance of the Fox, the City of Bakersfield wishes to assist the Foundation in this effort by permitting the Foundation to host one such event at this location each year for two (2) years. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD AS FOLLOWS: 1. The Fox Foundation may hold one event on 20"~ Street to raise money for the restoration of the Bakersfield Fox Theatre (capital projects) each year for two (2) years. 2. The Foundation shall submit a detailed plan, setting out the location of all fences, booths, tables, food services, restroom facilities, emergency access and a schedule for the use of the proceeds. Such plan must be submitted to the City (Treasurer's office) at least thirty (30) days prior to the event. 3. The Foundation shall comply with Bakersfield Municipal Code section 10.69 relating to special events. 4. Upon plan approval, 20th Street from the west side of H Street and up to, but not including, 1816 20th Street will be closed to vehicular and pedestrian traffic from 6 p.m. the night before the event until 12 noon the day following the event. 5. Additionally, G Street between 2001 and 2005 to the area just south of 1925 G Street will be closed to vehicular and pedestrian traffic from 6 p.m. the night before the event until 12 noon the day following the event. -- Page 2 of 4 Pages -- 6. Additionally, the alley west of the Fox Theater from 20th Street to a point 100 feet north will be closed to vehicular and pedestrian traffic from 6 p.m. the night before the event until 12 noon the day following the event. 7. During the hours of 5:30 p.m. and 10 p.m. on the night of the event, alcoholic beverages may be sold, consumed and possessed only in the areas designated closed to vehicular and pedestrian traffic in paragraphs 4, 5 and 6 above. 8. The Foundation will ensure that only persons twenty-one years of age or older are served alcoholic beverages and will provide patrons with wristbands to indicate who may legally consume alcoholic beverages. 9. All street closures will be set up to ensure that emergency vehicles have all access necessary to protect the attendees and buildings surrounding the event. 10. The fencing which will be used to close the street area shall be provided by the Foundation. 11. Such street closures are necessary for the safety and protection of the persons attending the event. 12. The Foundation shall post "No Parking" signs in the areas to be closed prior to the actual street closure to ensure no vehicles will be on the streets when the fences are erected. 13. event.
