SUBJECT: Loan Agreement with the City of Bakersfield to provide financing ($3.5 Llion) for
the construction and development of affordable housing for the 19thStreet Senior
Plaza Apartments and the Courtyard Family Apartments at South Millcreek.
RECOMMENDATION: Staff recommends approval.
BACKGROUND:
Over the past year, the Bakersfield City Council and Redevelopment Agency have approved
various development and owner participation agreements in support of the 19th Street Senior
Housing Project (67 units) located east of the canal between 18th& 19thStreet and the Courtyard
Family Apartments (57 units) located at South Millcreek. In December, 2008 the City Council and
Redevelopment Agency authorized the issuance of taxable redevelopment housing bonds to
provide financing for these two affordable housing projects. Unfortunately, due to the State of
California's poor credit rating and the continued volatility in the bond market the housing bonds
did not attract investors and did not sell on the private market.
Staff is requesting to borrow the funds from the City's Equipment Fund and Self Insurance Fund in
order to proceed with the Agency's financial commitments for these two affordable housing
projects. Financing terms for these loans are 7 years at 5% interest and will be repaid in semi
annual payments from the low-mod housing funds of the Old Town Kern Project Area and
Southeast Redevelopment Project Area. When the bond market improves, the Redevelopment
Agency will again prepare a bond offering that could allow for early repayment of the loans.
The interest rate proposed to be charged on the loans exceeds the current investment rate of
funds that the City earns from its regular investment pool. The proposed loan is secured by the
Redevelopment Agency's affordable housing fund which has been untouched to date by the
State of California financial raids on Redevelopment Agency resources.
Both projects are expected to commence construction no later than December 2009 and should
be complete by Spring, 2011. These residential projects are an instrumental part of the Mill Creek
Project and were used as components for calculation In the amount of the financial award for
the recent Prop 1C Infrastructure grant funds the Agency received from the State of California
Housing and Community Development Department. Failure to complete the affordable housing
projects within 5 years could result in the loss of these grant funds. The City Council authorized
this action on September 23, 2009.

development of an office complex located at 525 18th Street.
RECOMMENDATION:
Staff recommends approval.
BACKGROUND:
Staff was approached by Sullivan Land And Development, LLC to discuss the purchase of Agency owned
property located at 525 18th Street in order to construct an office complex on the site. Staff has prepared
an Excl wive Negotiation Agreement between the Bakersfield Redevelopment Agency and Sullivan Land
and Development, LLC., to cover a period of 180 days with an option for a 60 day extension from the date
of execution of the Agreement. During this period the deal points for the project will be negotiated and will
be incorporated into a Disposition and Development Agreement which will include the specific scope of the
development, Agency financial participation requirements, a schedule of performance, evidence of private
financing, and required insurance. The current scope of the project consists of the construction of an
office complex in the Old Town Kern-Pioneer Redevelopment Project Area, specifically in the Millcreek
Linear Park Project.

BACKGROUND:
On February 2, 2009, the Bakersfield Redevelopment Agency approved a Disposition and Development
Agreement (DDA) with CREEKVIEW VILLAS LLC, to construct 36 affordable multi-family townhomes in
the South Mill Creek Mixed Use Redevelopment Project. This is one of three residential projects planned
in the South Mill Creek Village. There are several interior streets that must be developed and improved to
serve this new neighborhood.
On June 30, 2009 the State of California Department of Housing and Community Development awarded a
grant from the Infill Infrastructure Grant Program (Proposition 1C) to the Bakersfield Redevelopment
Agency in the amount of $10,847,200 for the Mill Creek project in the City of Bakersfield, California. Funds
are also included in the Redevelopment Agency Operating Budget for engineering and design costs
associated with the construction of the required infrastructure. The grant includes funding for the
construction of street improvements required for the South Mill Creek residential village.
The proposed amendment will provide funds to the developer to contract for the design and engineering
work required for the South Mill Creek residential village street improvements. The cost for this
professional work is proposed at $205,000 and includes the landscape architect design work which will be
paid from redevelopment bond proceeds. The cost Staff reviewed the engineering proposal from the
developer's engineering firm Pinnacle Engineering. for accuracy and reasonableness. The engineering
and design will include streets and streetscape improvements for the internal streets known as "R" Street,
"S" Street, 14'hStreet, and 13th Street. Additionally, design and engineering will also include the north side
of California between "R" and "S" Streets creating two new entry points off California into the South Mill
Creek residential village. All three residential projects located in the village; Courtyards, Creek View Villas
and Chelsea Place will benefit from these planned street improvements. A copy of the detailed scope of
work from Pinnacle Engineering is included as Attachment #10 to the amendment.

Staff is requesting approval of Amendment No. 1 to Agreement No. RA09-001 in the amount of $205,000
for engineering, design and surveying work as described above. The work is expected to be completed by
early 2010. Once this work is completed, the developer and engineering firm will obtain bids for the
construction of the required improvements which will be funded from the Proposition 1C grant.
