The real property herein-described has been granted sewer service by the City of Bakersfield, even though the property is not located within the City. As a condition of extension of said sewer service to this property, the property shall be annexed into the City of Bakersfield as soon as it may be included in an annexation which is contiguous to City boundaries. The right to protest such annexation is hereby waived. This covenant may not be amended or modified without the prior approval of the City of Bakersfield. This covenant shall run with the land. Except 1/2 of all oil, gas, hydrocarbon substances and minerals in said lands, and within or underlying said land, but without the right to the use of the sur- face of said land or any other portion thereof above a depth of 500 feet for the purpose of drilling for or developing provided, however, that the Grantors, their heirs or assigns shall have the right to develop such substances by slant drilling from locations on adjacent lands at depths of more than 500 feet and in such a manner as not to disturb the surface of said land or any improvements thereon, as reserved in Deed from D.C.
