ROLL CALL Present: Board Members Underwood, Lee and Haynes Absent: None 2. PUBLIC STATEMENTS No speaker cards were presented. 3. CONSENT CALENDAR A. Consent Calendar Non-Public Hearing Items: 1. Minutes of the regular meeting held September 8, 2009. APPROVED Motion by Underwood to approve non-public hearing items. B. Public Hearing Items: File No. 09-0315 – REMOVED 1. Remove from the agenda a conditional use FROM permit to operate a concrete and asphalt recycling facility on an AGENDA 11.24-acre site in an M-3 (Heavy Industrial) zone district located at 75 E. White Lane. File No. 09-0674 REMOVED 12. 2. –Approval of a zoning modification to allow FROM for the retention of an existing 14-foot tall RV canopy within the CONSENT required 5-foot side yard setback in an R-1 (One-Family Dwelling) zone district located at 5401 Trimont Drive. File No. 09-0691RES 09-22 3. – Approval of a zoning modification to re- (Ward 2 establish a 9,624 square foot restaurant with 37 parking spaces, where 128 spaces would normally be required, in an M-2 (General Manufacturing) zone district located at 1200 E. Truxtun Avenue. (Ward 7 BZA Minutes October 13, 2009 Page 2 REGULAR MEETING ACTION TAKEN File No. 09-0730RES 09-23 4. – Approval of a conditional use permit to construct an 80-foot tall monopole communications antenna in an M-1 (Light Manufacturing) zone district located at 3725 S. H Street. APPROVED Motion by Underwood to remove public hearing item 3.B.1 from the agenda, remove public hearing item 3.B.2 from the consent calendar, and approve public hearing items 3.B.3 and 3.B.4. 4. PUBLIC HEARINGS 1. File No. 09-0674CONTINUED –Approval of a zoning modification to allow for the retention of an existing 14-foot tall RV canopy within the required 5- foot side yard setback in an R-1 (One-Family Dwelling) zone district located at 5401 Trimont Drive. Staff report given. Robert Rapp, applicant/property owner, spoke in favor. APPROVED Motion by Haynes directing the applicant to notify the occupants of neighboring properties of the alterations to the RV canopy which are necessary to bring achieve compliance with building code requirements and to continue public hearing item 4.1 to November 10, 2009. 5. COMMUNICATIONS None 6. BOARD COMMENTS Member Haynes expressed appreciation to staff and the other Board members for welcoming him as a new member. 7.
