RESOLUTION NO.121- 09
RESOLUTION APPOINTING THE CITY OF BAKERSFIELD
REPRESENTATIVE TO THE METROPOLITAN BAKERSFIELD
HABITAT CONSERVATION PLAN IMPLEMENTATION
TRUST GROUP.
WHEREAS, the City of Bakersfield and the County of Kern obtained approval of the
Metropolitan Bakersfield Habitat Conservation Plan from the United States Fish and Wildlife
Service and the California Department of Fish and Game to address the respective
regulations of the endangered species acts; and
WHEREAS, on August 24, 1994, the Fish and Wildlife Service of the United States
Department of Interior issued an "Incidental Take Permit" (PRT-786634) Section 10(a) (1) (B), to
the City of Bakersfield and the County of Kern; and
WHEREAS, on August 24,1994, the fish and Game Department of the State of California
issued a Section 2018 Permit to the City of Bakersfield and the County of Kern; and
WHEREAS, in accordance with the Joint Powers Agreement for the Formation of the
Metropolitan Bakersfield Habitat Conservation Plan Implementation Trust Group (City Council
Agreement No. 93-168), the City Council appointed the Development Services Director at the
City's permanent representative on the Implementation Trust Group; and
WHEREAS, the Council desires to designate an alternate City representative on the
Implementation Trust Group as described below.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED as follows:
1. The above recitals and findings incorporated herein by reference are true and
correct and constitute the Findings of the City Council in this matter.
2. The Council appoints the Development Services Director, as the City of Bakersfield's
representative on the Metropolitan Bakersfield Habitat Conservation
Implementation Trust Group; and
3. In the absence of the Development Services Director, the City Planning Director
shall be the City of Bakersfield's representative on said group.
