SPECIFICATIONS: The work embraced herein shall be done in accordance with
the Standard Specifications of t~~e Department of Transportation, Business and
Transportation Agency, dated July, 1984, insofar as the same .may apply and

(b) PROPOSAL FORI`I. All proposals must be made upon blank forms to be
obtained from t}ie Purchasing Officer, the form of which appears }ierein immediately
,following these specifications. All proposals must give the prices proposed, ba~}~
in writing and figures, and must be signed by the bidder, with his address. If the proposal is made by an individual, his dame and post office address must be
shown, If made by a firm or partnership, the name and post office address of
.each member of the firm or partnership must be shown. If made by a corporation,
the proposal must show the names of the state under the laws of which the
corporation was chartered and the names, titles, and business addresses of the
president, secretary and treasurer.

(d) RE'T'URN OF BIDDER' S GUARANTIES. I~ithin ten (1D} days after the award
of the contract, the City of Bakersfield will return the proposa]. guaranties
accompanying such of the proposals as are not to be considered in making the award. All other proposal guaranties will be held until. the contract has been
finally executed, after which they will be returned to the respective bidders
whose proposals they accompany. - .
(e) CONTRACT BONDS. The Contractor shall furnish two good and sufficient
bonds. One of the said bonds shall guarantee the faithful performance of the said
contract by the Contractor and shall be in an amount equal to one hundred percent
~loOQ) of the contract price. The other .of the said bonds shall be in an amount
of fifty percent (500) of the contract price and shall be furnished as required by the terms of an act entitled:
"An act to secure the payment of the claims of persons employed by
contractors upon public works, and~the claims of persons who furnish ,

• (b) DEFECTTVE ~ti4TERIALS. All materials not conforming to the requireM
meets of these specifications shall be considered as defective,, and all such.
materials, whether in place or not, shall be rejected and~shail be removed irimed-
lately from tl~e site of the work unless otherwise permitted by the Engineer. No rejected material, the defects of which have been subsequently corrected, shall
be used until approved in writing by the Engineer.
Upon failure on the part of the contractor to comply with any order of
the Engineer made under the provisions of this article, the Engineer shall have
authority to remove and replace defective material and to deduct the cost of
removal and replacement from any monies due or to become due the contractor.
SECTION 5. LEGAL RELATIONS AND RESPONSIBILITIES
TO THE .PUBLIC
(a) LAWS TO BE OBSERVED. The contractor shall keep himself fully in-
formed of all existing and future State and National laws and all municipal
.ordinances and regulations of the City of Bakersfield which in any manner affect
those engaged or~empleyed in the work, or the materi~.ls used ir. the work, or which in any way affect the conduct of t}~►e work, and of all such orders and decrees of
bodies or tribunals having any jurisdiction or authority aver the ,same.
(b) IiOURS OF LABOR. The contractor shall forfeit, as penalty to the City
of Bakersfield, Ten Dollars ($10.00) for each laborer, workman; or mechanic
employed in the execution of t}le contract by him, or by any subcontractor under
him, upon any of the work hereinbei'ore mentioned, for each calendar day during which said laborer, workman, or mechanic is required or permitted to labor in
violation of the provisions of Section 1810 to Section 1815, inclusive, of the
Labor Code.
(c) The contractor shall comply with Section 6745 of the Labor Coda
which provides that the contractor's responsibility shall be as follows:

Engineer and the detailed plan has been approved by the City Engineer.
If such plan varies from the shoring system standards established by the Construction Safety Orders of.. the Division of Industrial Safety, the plan shall
be prepared by a registered civil Ur structural engineer.
Nothing in thzs section shall be deemed to allow the use of a shoring,
sloping, or protective system. less effective than that required by the Construc-
tion Safety Orders of the Division of Industrial Safety.
.Nothing in t}1is section shall be construed to impose tort liability on the awarding body or a.ny af. its employees.
The terms "pub.llc works" and "award.ing body", as used in t~ris ser ~ ion,
shall have the same meaning as in Labor Code Sections 1720 and 1722 respectively.

Two Hundred Dollars ($200.oU) per day for each and .every calendar day's delay
beyond t'~e time prescribed to complete the work; aid the Contractor agrees to
pay such liquidated damages as herein provided, a.nd in c~~se ~-he same are not p~~id,
agrees that the City of Bakersfield ma4,r deduct the amount. thereof from any money
due or that may become due the Contractor under the contract.
It is further agreed that in case the work called for under the contract
is not finished and completed in all parts and requirements within the time
specified the City Council shall have the right to extend. the time for comple- tion cr not, as may seem best to serve the interest of the City; and if it decides
to extend the time limit for the completion of the contract, it shall further have
the right to charge to the Contractor, his heirs, assigns or sureties, a.nd to
deduct from the final payment for the .work, aal or any part, as it may deem
proper, of the actual cost of engineering, inspection, superintendence, and
other overhead expenses which are directly chargeable to the contract, and
which accrue during the period of such extension, except that the cost of final surveys and preparation of final estimate shall not be included in such charges:
The Contractor shall not be assessed with liquidated damages nor the cost
of engineering and inspection during any delay in the completion of the work
caused by acts of God or of the public enemy, acts of the City, fire, floods,
epidemics, quarantine restz•ictions, strikes, freight embargoes, and unusually
severe weather or delays. of subcontractors due to s~~ch causes; provided t}t~.t
the Contractor shall within ten (10) days from the beginning of any such delay, notify the Engineer in writing of the causes of delay, who shall ascertain the
facts and the extent of the delay, and his findings of. the facts thereon shall
be final aid conclusive .
(f) SUSPENSION OF CONTRACT. If at any time in the opinion of the City
Council, the Contractor has failed to supply an adequate working force, or material
o.f proper quality, or has failed in any other respect to prosecute the ~vork with
the diligence and force specified and i~~tended in and by the terms of the contract, notice. thereof. in wrzting will be servec'~ upon him, and should he neglect or refuse
to pravi.de means for a. satisfactory compliance with the contract, as directed by
the Engineer, within the time specified in such notice, the City Council in a.ty

receiving notice. of .such suspension, the Contractor shall discontinue said ~~ork,
or `such parts of it as the City Council may designate. Upon such suspension,
the Contractor's. control shall te~•minate and there~apon t}~e City Col~ncil, or
its duly authorized representative, may take possession. of all or any part of the Contractor's materials, tools, equipment, and appliances upon the premises,
and use the. same r"or the purpose of• completing said contract, and hire such
force and buy or rent such additional ma.chine~•y, tools, appliances and equipment,
and buy such additional materials and supplies at the Contractor's expense as
may. be necessary for the proper conduct of the work d.nd for the completion
thereof; or may employ other parties to carry the contract to completion, employ
the necessary workmen, substitute other machinery or materials, and purchase
the materials contracted for, in such manner as the Cl.ty Council may dE~em proper; or the City Council may annul and cancel the contract and re-let. the work or any
part thereof. Any excess of cost arising therefrom over and above the contract
price will be charged against the Contractor and his sureties, who will be liable
. payment shall be required to be made, when in the. j u~~.;,ment of the City Engineer
the work is not p~•oceeding in~ accordance with the previsions of the contract, or
when in his judgment the total value of t}~e~work done. since the last estimate
amounts to Tess than Three Hundred Dollars ($300,40):
(c) FINAL PAYI~~LENT.~ The ~ity Engineer shall, after 'the completion of the
contract, make a final estimate of the amount of work done thereunder, and the value of such work, and the City of Bakersfield shall pay~the entire sum so found
to be due after deducting therefrom all previous payments and aII amounts to be
kept and all amounts to be retained under the provisions of the contract. All
prior partial estimates and payments shall be subject to correction 'in the final
estimate and payment. The final payment shall nat be due and payable until the
expiration of thirty (30) days from the date of acceptance of the work by the
City Council.
It is mutually agreed between the parties to the contract that no certif-
icate given oi• payments made under the contract, except the final certificate or
final paylrent, shall be conclusive evidence of the performance of the contract,
either «holly or in part, against any claim of the party of the first part, and
no payment shall be construed to be an acceptance of any defective work or
i~:proper materials.
And the Contractor further agrees that the payment of the final amount due under the contr~:ct, and the adi~astment and payment far any work done in accordance
with any alterations of the same, shall release the City of Bakersfield, the
City Council, and the Engineer from any and all claims or liability on account
of work performed under the contract or any alteration thereof.
(d) SUBSTITUTIQN OF SECURITIES. lUhenever herein provision is mado for
wit}~~holding or retention of moneys to ensure performance, substitution of an

Other terms appearing in the Standard Specifications, the general pro-
visions, and the special provisions, shall have the intent and meaning specified
in Section 1, Definition of Terms of the Standard Specifications.,
In the event that any portion of the Standard Specifications incorporated herein shall conflict with any of the provisions delineated in the special pro-
visions section herein set forth, the provisions s.o delineated shall take prece-
deuce over and shall be used in lieu of such conflicting portions of the Standard
Specifications.
SECTION 9. INSURANCE
In addition to any other form of insurance or bonds required under the terms
of the contract and specifications, the Contractor will be required to carry insur-
ance of the following kinds and amounts: contractor's public liability insurance
policy for property damage, personal injury and automobile liability (with an
insurance company licensed to do business in the State of California) in an amount
not less than FIVE HUNDRED THOUSAND DOLLARS ($500,000.00), combined single-limit
coverage with a TWO MILLION DOLLAR ($2,000,000.00) umbrella policy (containing a
drop down provision) or, in lieu thereof, a 2.5 MILLION DOLLAR combined single- limit policy. The City of Bakersfield, its mayor, council, officers, agents
and employees shall be named as additional insureds under the policy which ,shall
operate as primary insurance,
If any part of the work is sublet, similar insurance shall be provided by
or in behalf of the subcontractors to cover their operations.
The insurance hereinbefore specified shall be carried until all ~ti~ork
required to be performed under the terms of the contract is satisfactorily.
.completed as evidenced by the formal acceptance by the City.
The Contractor shall furnish the Finance Department with one (1) certified
copy of each of the executed policies or a certified Certificate of Insurance.
. The certification on such policies shall guarantee that the policy will not be amended, altered, modified, or canceled insofar as the coverage contem-
plated hereunder is concerned, without at least five (5) days' notice mailed by
registered mail to the Finance Department, City of Bakersfield, Bake rsfi~ld,
California.
The insurance herein required shall be obtained by the successful bidde~~,
and the certified copy of the policies or Certificate of Insurance furnished as
herein provided, within t}le time ,fixed herein for his execution of the contract.
Full compensation for.all premiums which the Contractor and the sub-
contractors are required to pay on all the insurance described above shall be
considered as included in the prices paid for the various items of work to be
perfor~~ed under the contract, and no additional allowance will be made therefor
or for additional premiums which may be required by extension of the policies
of insurance. .

SECTION 10. QUANTITIES
The following preliminary estimate :of the quantities of work to be done
and materials to be furnished are approximate only, being given as a basis for
the comparison of bids, and the City of Bakersfield does not expressly or by
implication agree that the actual amount of work will correspond therewith,
but reserves the right. to .increase or decrease the amount of any class or
portion of the work or to omit portions of the work that may be deemed
necessary or expedient by the Engineer.
The provisions of Section 4-1.03B of the Standard Specifications
relative to alterations not involving changes in the character of the work

Omissions fron~ the drawings or the specifications of the materials or
details of work which are manifestly or obviously necessary to carry out the
intent of the .drawings and specifications c7r which are customarily :~~urnished
or performed, shall not relieve the Contactor of his responsibility for

the Standard Specifications shall not apply to final cost of this con~tra.~.: :.tld
no final adjustment for overhead costs will be made.
(f) DUST CONTROL. It shall be the Contractor's responsibility to prevent
a dust nuisance from originating from the site of the work as a result of ris
operations during the effective period of this contract. Preventative measures
to be taken by the Contractor sl~~a11 include but shall not be Limited to the
following:
1. Water shall be applied to all lznpaved areas a5 reQuired
to prevent the surface from becoming dry enough to permit dust foz~mation.
2. Paved surfaces over w~~ich vehicular. traffic is permitted
to travel shall be kept free of dirt.
Temporary suspension of the work, either ~~.s a result of order by the
Engineer, or as a result of cu~nditions beyond tale control of the Contractor
shall not relieve the Contractor from his resrcnsibility for dust control as set forth herein.

(h) ALTERATIONS IN QUANTITY OF WORK. The provisions of Section 4-1.03B,
4-1.03B(1), and 4-1.03B(2), of the Standard Specifications relative to increases
or decreases in the quantity of a contract item of work when no change in the character of the work is involved shall not apply to any contract item. of work
in this proposal and th.e City reserves the right to increase or decrease the
quantity of any item or portion of work as may be deemed necessary or in the
best interest of the City, y
(i) WORK IN CITY STREETS. All of the work shown on the plans and included
in these specifications that is located in the public streets in the City of Bakersfield shall be done in accordance with City Ordinances regulating the use
of public streets within-the City, except as otherwise provided herein.
The Contractor shall inform himself as to all regulations and requirements
of the City Engineer and Superintendent of Streets of the City of Bakersfield
and shall conduct his operations In compliance therewith.
(j) PERMITS AND LICENSES. The Contractor shall procure all permits and licenses, pay all charges and fees and give all notices necessary and incidental
to the due and lawful prosecution of the work.
(k) ~~AINTAINING TRAFFIC. Attention is directed to Sections 7-1.08,
"Public Convenience," 7-1.0.9, "Public Safety," and Section 12, "Construction Area
Traffic Control Devices," of the Standard Specifications. The Contractor shall
comply with the provisions of these sections and these special provisions.
The Contractor shall furnish, install and maintain all signs, lights,
flares, barricades, and other facilities required by .this Section.
The Contractor shall keep the Bakersfield Fire Department informed at all
times as to the exact location and progress of the work and shall notify them imme-
diately of any streets impassable for fire fighting equipment.
Personal vehicles of the Contractor's employees shall not be parked on
the roadway at any time, including any section closed to public traffic.
When entering or leaving roadways carrying public traffic, the Contractor's
equipment, whether .empty or loaded, shall in all cases yield to public traffic.
The provisions in this section may be .modified or altered if, in the opinion of the Engineer, public traffic will be better served and work expedited.
Said modifications~or alterations shall not be adopted until approved in writing
by the Engineer.
The prices paid for the various contract items of work shall be considered
as full compensation for complying with the provisions of .this Section 13(k)
Maintaining Traffic, and no additional payment will be made .therefor.
(1) ORDER OF WORK. ..Order of work shall conform to the provisions in
Section 5-1.05, "Order of Work," of the Standard Specifications and these special
. . provls~.ons .

Prior to commencement of the traffic signal functional tests, all items
of work related to the.s~.gnal control shall be completed and roadside signs shall
be in place.
(m) COOPERATION. The Contractor shall cooperate fully with the ;other
_ Contractors performing work.on the site.
It is not anticipated that the work to be done by others will seriously
delay the Contractor's completion of the work. However, if such work does result
in extraordinary delay, the Contractor may seek relief from .liquidated damages as
set forth in the fourth paragraph of Article 6(e) of these Special Provisions,
Full compensation for complying. with the requirements of this Article 13 (m)
shall be considered as included in the prices. p a~.d for the various contract items of work and no additional allowance will be made therefor.

SECTION 14. SPECIAL PROVISIONS - TRAFFIC SIGNALS
AND STREET LIGHTING
(a) DESCRIPTION. Furnishing, installing and modifying traffic signals
and highway lighting and payment therefor shall. conform to the rovisions in Section P
86, "Signals and Lighting of the Standard Specifications and these special provisions.
Traffic signal work is to be performed at the followin location;

(b) REMOVING AND REPLACING IMPROVEMENTS. Removing and replacing improvements shall conform to. the provisions in Section 86-2.02, "Removing and
Replacing Improvements," of the Standard Specifications and these special
provisions,
(c) FOUNDATIONS. Foundations shall conform to the provisions in
Section 86-X2.03, "Foundation," of the Standard Specifications and these s ecial P
provisions.
The Contractor shall furnish the anchor bolts, nuts and washers to be
used for new foundations and shall furnish the appropriate nuts washers for
existing foundations to be reused.
Existing foundations not be reused may be abandoned, except where
removal is necessary to install a new foundation.
Portland cement concrete shall conform to Section 90-10, "Minor Concrete,"
of the Standard Specifications and shall contain not less than 470 pounds of
cement per cubic yard, except. concrete for pile foundations shall contain not
less than 564 pounds of cement per cubic yard.
(d) CONDUIT. Conduit shall conform to the provisions in Section
86-2.05, "Conduit," of the Standard Specifications and these special provisions.
Insulated bonding bushings will be required on metal conduit.
(e) PULL BOXES. Pu11 boxes shall conform to the provisions in
.Section 86-2.06, "Pull Boxes", of the Standard Specifications and these special
provisions.
Recesses for suspension of ballasts will not be required.
At locations where existing pull boxes are too small to accomodate
additional new conduit, the Contractor shall furnish and install a larger pull
box.
(f) CONDUCTORS AND WIRING. Conductors and wiring shall conform to the provisions in Section 86-2.08, ".Conductors", and Section 86-2.09, "Wiring,"
of the Standard Specifications and these special provisions.
Conductors shall be spliced by the use of "C'' shaped compression
connectors as shown on the plans..
Splices shall be insulated by "Method B."
Numbered sentence 2 in the first paragraph of Section 86-2.09D,
Splicing", is amended to read:
2. Pedestrian push button commons in pull boxes.

(g) BONDING AND GROUNDING. Bonding. and grounding shall conform to
the provisions in Section 86-2.10, "Bonding and Grounding", ~of the Standard
Specifications and these special provisions. .
(h) SERVICE. Service shall conform to the provisions in Section 86-2.11,
"Service", of the Standard Specifications and these special provisions,
The Engineer will arrange with the serving utility to complete service
connections to service points shown on the plans and will pay all required costs
and fees required by the utility.
(i) TESTING. Testing shall conform to the provisions in Section 86-2.14,
"Testing", of ,the Standard Specifications and these special provisions.

(j) SIGNAL FACES AND SIGNAL HEADS. Signal faces, signal heads and
auxiliary equipment, as shown on the plans, and the installation thereof, shall
conform to the provisions in Sections 86-4.01, "Vehicle Signal Faces," 86-4.02,
"Directional Louvers," 86-4.03, "Backplates" and 86-4.06, "Signal Mounting
Assemblies," of the Standard Specifications and these special provisions.
~Iousing, visors,~directional louvers and backplates shall not be
structural plastic.
All lamps for traffic-signal units shall be furnished by the Contractor.
All mast arm mounted signal faces and all arrow indications shall be
provided with 12-inch sections.
(k) PEDESTRIAN SIGNALS. Pedestrian signals shall conform to the provisions in Section 86-4.05, "Pedestrian Signal Faces," of the Standard
Specifications and these special provisions.
Pedestrian signals shall be in accordance with Type C specifications,
except as follows:
1) Signal faces shall be international symbol type.
2) Minimum brightness requirements shall~be 150 foot-lamberts
for the "upraised hand" symbol message and 2I0 foot-lamberts
for the "walking person" symbol message.
3) Disregard the reference to the sample that is available at
the Transportation laboratory.
(1) LUMINAIRES. Luminaires shall conform to the provisions in
Section 86-6.01, "High Intensity-Discharge Luminaires," of the~Standard
Specifications and these special provisions.
Luminaires shall be furnished with 200-watt high pressure sodium lamps
and integral ballasts,
(m) PHOTOELECTRIC CONTROLS. Photoelectric controls shall conform to
the provisions in Section 86-6.07, "Photoelectric Controls, of the Standard
Specifications and these special. provisions.
Each luminaire shall be provided with a Type IU photoelectrical control.

(n) CONTROLLERS, CABINETS AND AUXILIARY EQUIPMENT. The City will
furnish the controller and cabinet assembly for each location. The Contractor shall furnish the cabinet adapter for use at Locations B and C.

(p) DETECTORS. Detectors shall conform to the provisions in Section
86-5, "Detectors," of the Standard Specifications and these special provisions.
Irl lieu of sealing methods specified in Section 86-S.OlA(5), "Installation Details," of the Standard specifications, the Contractor may seal loops in A.C, in
accordance with the following:
After conductors are installed in the slots cut in the pavement,
the slots shall be filled with asphaltic emulsion Type CSS-l, Section
94, "Asphaltic Emulsion," to within 1/8 inch of the pavement surface.
The emulsion shall be at least 1/q inch thick above the top conductor in the sawcut. Plant mixed RMAS, composed of 4 to 8o MC-800 conforming
to Section 93, "Liquid Asphalts," and aggregate of Type 'C', No. 4
max, grading, conforming to Section 39, "Asphalt Concrete," shall be
mixed with asphaltic emulsion placed in the slots and tamped, all as
directed by the Engineer. Surplus materials shall be removed from .the
adjacent surfaces without the use of solvents. Asphaltic emulsion
shall be applied to the filled slot and sand applied to the surface, , all as directed by the Engineer.
Loops installed in concrete will be sealed with epoxy sealant conforming
to Section 95-2.09 of .the Standard Specifications.

(q) PAYMENT. Payment for signals and lighting shall conform to the
provisions in Section 8~6-8, "Payment", of the Standard Specifications and these special provisions.
Fu11 compensation for cast-in-drilled hole concrete pile foundations
shall be considered as included in the contract lump sum price paid for the
item requiring foundations and no separate payment will be made therefor..
SECTTON l5. SPECIAL PROVISIONS -ROADSIDE SIGNS
(a) ROADSIDE SIGNS.. Roadside signs shall conform to the provisions in
.:.Section 56-2, "Roadside Signs," of the Standard Specifications and these special
provisions.
Sign panels shall be furnished by the City.
Mast-arm hangers shall be furnished by the Contractor.
Roadside signs shall be installed by mast-arm hanger methods as shown
on Standard Plan Sheet TS-3, 3A (sign hanger mounting details).
(b) PAYMENT. Payment per unit for installing sign (Mast-arm Hanger,
Street Name Sign) shall conform to the provisions in Section 56-2.06, "Payment,"
of the Standard Specifications.
SECTION 16. SPECIAL PROVISIONS - GUARANTEE FOR TRAFFTC
SIGNAL AND STREET LIGHTING
SYSTEMS.
(a) GUARANTEE. The Contractor shall furnish a written guarantee to the City on the form attached, guaranteeing all systems, except traffic signal
lamps, installed under this contract for a period of one (1) year from the date
of~acceptance of the work. The guarantee, properly executed, shall be filed with
the City before notice of completion and final acceptance is made by the City
of the work described. on the plans and these special provisions.
(b) PAYMENT. The lump sum prices paid for installation of traffic signal and street lighting systems shall include full compensation for furnishing
the guarantee as required in this Section.

Galvanizing shall conform to the specifications of ASTM Designation: A 123.
Galvanizing of material shall be performed after fabrication.
Fabrication shall include all operations such as shearing, cutting, punch-
ing, forming, drilling, milling, bending, welding and riveting.
All welded areas shall be thoroughly cleaned prior to galvanizing to remove
all slag or other material that would interfere with the adherence of the zinc.
When it is necessary to straighten any sections after galvanizing, such work shall be performed without damage to the zinc coating.
The minimum pitch diameter of the threaded portion of all bolts, anchor
bars, or studs shall conform to ANSI Standard: B1.1, having a Class 2A tolerance
before galvanizing+
Galvanized surfaces that are abraded or damaged at any time after the .
application of the zinc coating shall be repaired by thoroughly wire brushing the damaged areas and removing all loose and cracked coating, after which the
cleaned areas shall be painted with 2 applications of Zinc-Rich Primer, Organic
Vehicle Type, Type II, Section 91-2,01, without thinner, or zinc--rich paint
conforming to the requirements of Military Specification MIL-P-21035. Spray
cans shall not be used.

To the City Clerk of the City of Bakersfield:
The undersigned, as~~bidder, declares that the only persons or parties
interested in this proposal as px•incipals are those named herein; that this pro-
posal is made without collusion with any other person, firm or corporation; that
he has carefully examined the location of the proposed work, the annexed proposed
form of contract ,and the plans therein referred to; and he proposes and agrees~if this proposal is accepted, that he will contract with the City of Bakersfield, in
the prescribed form of contract hereto annexed, to provide all necessary machinery,
tools, apparatus and other means of construction and to do all the work and furnish
all the materials in accordance with the plans and specifications for the above,
filed in the office of the Finance Director of the City of Bakersfield and as
specified in the contract, in the manner and time therein prescribed, and according
to the requirements of the Engineer as therein set forth, and that he will take in
full payment therefor the unit prices or lump sums set forth in the following schedule:
In case of a discrepancy between words and figures, the words shall
prevail; and in case of discrepancies between unit prices and totals, the unit
prices shall prevail.
The undersigned further agrees that in case of default in executing the required contract, with necessary bonds, within ten (10) days, not including Sunday,
after having received notice that the contract is ready for signature, the proceeds
of the"check or bid bond accompanying his bid shall become the property of the
City of Bakersfield.
