Refund of deposit will be made provided the plans and specifications are returned to the Purchasing Officer within ten (10) days from date of contract award and the doc- uments are in reasonable good condition. No bid will be considered unless it is made. on a proposal form furnished by the Purchasing Officer, which appears herein. immediately following the speci- fications of the project, and is made in accordance with the provisions set forth under Section 2, "Proposal Requirements and Conditions" of the Standard S ecifications of the Department of Transportation, Business & Transportation P Agency, State of California, under date of July, 1984. Each bid must be accom- panied by a proposal .guarantee in accordance with the requirements of article 2-1.07 of the said Section 2 of the Standard Specifications. The Cit of Bakersfield reserves the right to reject any or all bids. y .Bids are required on the entire work described herein. Substitution of securities for moneys retained to ensure performance shall be permitted pursuant to the provisions and requirements of Government Code 4590. The Contractor must possess a valid Class A or a Class C-10 Contractor's. License at the time this contract is awarded. { SPECIFICATIONS: .The work embraced herein shall be done in accordance with the Standard Specifications of the Department of Transportation, Business and Transportation Agency, dated July., 1984, insofar as the same may apply and in accordance with the following provisions. 1 PROGRESS OF THE WORK AND TIME FOR COMPLETION. Attention is directed to the provisions of Section 8, Article 8-1.06, "Time of Completion" and Article 8-1.01, "Liquidated Damages," of the Standard Specifications, and is specifi- tally hereby made a part of these special provisions. The Contractor shall furnish the Engineer with a statement from the vendor that the order for the electrical materials required for this contract has been received and accepted by said vendor, and said statement shall be furnished within fifteen (15) calendar days from the date of the contract. Said statement shall show the date or dates the electrical materials will be shipped. The Contractor shall begin work within fifteen (15) calendar days from the date of the contract and shall diligently prosecute the same to completion, .except for signal and lighting standards and other above ground electrical equipment if said electrical equipment has not yet been received, before the expiration of TWENTY (20) WORKING DAYS beginning with the fifteenth (15th) day following the date of the contract. Signal and lighting standards and other above ground electrical equipment shall not be erected until all electrical materials are received.. Upon receipt of said. electrical materials, the Contractor shall eompl.ete all electrical work, including functional tests, before the expiration of FIFTEEN (15) WORKING DAYS from. the date all electrical materials are received., but in no case shall the. work be completed later than the expiration of SEVENTY-FIVE (15) DAYS beginning with the fifteenth (15th) day following the date of the contract for said work. lA CITY OF BAKERSFIELD, CALIFORNIA DEPARTMENT OF PUBLIC WORKS - SECTION 1. (e) CoNTRACT~BONDS. The Contractor shall furnish two goad and sufficient boi~ds. one of the said bonds shall guarantee the faithful performance of the said contract by the Contractor and shall be in an amount equal tc one hundred. percent (1a0~} of the contract price. (f} REJECTION OF PROPOSALS CONTAINING ALTERATIONS, ERASURES OR IRREGULARITIES. Proposals may be rejected if they show any alterations of form, additions not called for, conditional or alternative bids, incomplete bids, erase ure~s~ or irregularities of any kind. Proposals in which the prices ob~rio~sly are unbalanced may be r~ej ected. The right i~s reserved to reject any and all proposals. . (g) AWARD OF CONTRACT. The award of the contract, if it be awarded, will be made. within thirty (30) days after the opening of the proposals. - (h} EXECUTION OF CONTRACT. The contract shall be signed by the success ful bidder and returned, together with the contract bonds within. ten (IO) days, not. including Sundays, after the bidder has received-notice that the contract his been awarded. No proposal shall be considered binding upon tho,-City until the e~cecution of the contract. All contracts shall be considered as being made and entered into in the City of Bakersfield, California. - Failure to execute a contract and file acceptable bonds as provided herein within ten (10) days, not including Sundays, after the bidder has received notice that the contract-has been awarded, shall be just cause for the cancellam Lion of the award and the forfeiture of the proposal guaranty.. (i) EXAMINATIONS OF PLANS, SPECIFICATLONS, SPECIAL PROVISIONS, AND SITE OF WORK. Tie bidder is required to examine carefully the site of,.,the pro posal, plans and specifications, and contract forms for the work contemplated, and it will be`assumed that the bidder has investigated and is satisfied as to the conditions to be encountered, as to the character, quality, and quantities of work. to be performed and materials to be furnished, and as to the requirements of-the specifications, the special provisions, and. the contract. It is mutually agreed that the submission of a .proposal shall be considered prima facie evidence that the bidder has made such examination. SECTION 2. SCOPE OF WORK (a} WORK TO BE DONE. The work to be done consists of furnishing alI labor, materials, methods and processes, implements,. tools and machinery, except as otherwise specified, which are necessary and required to construct the proposed improvements, as designated in the contract. (b} ALTERATIONS. By mutual consent in writing of the parties signatory to the contract, alterations or deviation, increases or decreases, additions or omissions, in the plans. and specifications, may be made and the same shall in no way affect or make void the contract. 3 i for accuracy of dimensions and details, and that the Contractor shall be respon~ sible for agreement and conformity of his working plans with the appro~red plans - and specifications. . (c) CONFORfi4ITY WITH PLANS AND ALL4~~FABLE DEVIATION. Finished surfaces in all cases shall conform with the lines, grades, cross sections, and dimensions shown on the approved plans. Deviations from the approved plans, as maybe re® quired by the exigencies of construction will be determined in alI cases by the Engineer and authorized. in writing. ~d) COORDINATION OF PLANS, SPECIFICATIONS,.AIND SPECIAL PROVISIONS. These specifications,. the plans, special. provisions,. and all supplementary documents are essential parts of the contract, and a requirement occurring in _ one is as binding as though occurring in all.. They are intended to be cooper- ative, to describe, and to provide for a complete. work. Plans shall govern over specifications; special provisions shall govern over both specifications and plans. City specifications shall govern over State Standard Specificationsa (e) INTERPRETATION OF PLANS AND SPECIFICATIONS.. Should it appear that the work to be done, or any matter relative thereto, is not sufficiently detailed or explained in these specifications., plans, and the special provisions, the con© tractor shall apply to the Engineer-for such further explanations as may be necessary, and shall conform to such explanation or interpretation as part. of the contract, so far as may be consistent with the intent of the original speci~ fications. In the event of doubt. or question relative to the true meaning of the specifications, reference shall be made to the-City Council, whose decision thereon shall be final. In the event of any discrepancy between any drawings and the figures written thereon, the figures shall be taken as correct. {f) SUPERINTENDENCE. Whenever the contractor is not present on any part- of the work where it may be desired to give direction, orders will be given by the Engineer in writing, and shall be received and obeyed by the superintendent or foreman in charge of the particular work in reference to which orders are given. (g) LINES AND GRADES. All distances and measurements are given and will be made in. a horizontal plane. Grades are given from the top of stakes or nails, unless otherwise noted an the plans. Three consecutive points shown on the same rate of slope-must be used in common, in order to detect any variation from a straight ,grade, and in case any such discrepancy exists, it must be reported to the Engineer. If such a discrepQ ancy is not reported to the Engineer, the contractor shall be responsible for any error in the finished work. The contractor shall give at least 24 hourst notice in writing when h~ will require the services of the Engineer for laying out any portion of the works The .contractor shall furnish the Engineer .such facilities and labor, necessary for making and maintaining points and lines, as he may require. Labor furnished by the contractor for such purposes will be paid for as Extra ~~tork. The contractor shall preserve all stakes and points set for lines,. grades, or measurements of the work in their proper places until authorized to remove them by the Engineer. All expenses incurred in replacing stakes that have been removed without proper authority shall be paid by the contractor. 5 (b} DEFECTIVE P~~ATERIALS. All materials nat conforming to the. requirem _ meats of these specifications shall be considered as defective, and all such materials, whether in place or not, shall be rejected and shall be removed immed~ iately from the site of the work unless otherwise permitted by the Engineer. No rejected material, the defects of which have been subsequently corrected, shall be used until approved in writing by the Engineer. Upon failure on the part of the contractor to comply with any order of the Engineer made under the provisions of this article,. the Engineer shall have authority t o remove and replace defective material and to deduct the cost of. removal and replacement from any monies due or to become due the contractors SECTION 5. LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUELIC (a) LAWS TQ EE OBSERVED. The contractor shall keep himself .fully inm formed of all existing and future State and National laws and all municipal ordinances and regulations of the City of 5akersfield which in any manner affect those engaged or employed in the work, or the materials used in the work, or which . in any way affect the conduct of the work, and of all such orders and decrees of .bodies or tribunals having any jurisdiction or authority over the same. (b) HOURS OF LABOR. The contractor shall forfeit, as penalty to the City of Bakersfield, Ten Dollars 010.00) for each Laborer, workman, or mechanic employed in the execution of the contract by him, or by any subcontractor under him, upon. any of the work hereinbefore mentioned, for each calendar day during which said Laborer, workman, or mechanic is required or permitted to Labor in violation of the provisions of Section 1510 to Section 1515, inclusive, of the Labor Code. (c} The contractor sha l comply with Section X705 of the Labor Code which provides that the contractor"'s responsibility shall be as fo-Mows: . If the contract price for the project includes an expenditure in excess of twenty-five thousand dollars(~25,000) for excavation of any trench or trenches . .five feet or.~ore in depth, the contractor or his subcontractor shall not begin any trench excavation unless a detailed plan, showing the design of shoring, bracing, sloping an other provisions to be made for worker protection during the excavation of the trench, has been submitted by the contractor to the City Engineer and the detailed plan.has been approved by the City Engineer. If such plan varies from the shoring system standards established by the Construction Safety Orders of the Division of Industrial Safety, the plan shall be prepared by a registered civil or structural engineero Nothing in this section shall be deemed t~o allow the use of a shoring, sloping, or protective system Less effective than that required by the Construc® Lion Safety Orders of the Division of Industrial Safety. . Nothing in this section shall be construed to impose tort Liability on the awarding body or any of its employees. The terms "public works" and "awarding body", as used in this section, shall have the same meaning as in Labor Code Sections 1724 and 1.722 respectively. 7 (g) REGISTRATION OF CONTRACTORS. Before submitting bids, Contractors shall be licensed in accordance with the provisions of Section 7055 of Business ~ Professions Code. (h} PERMITS AND LICENSES. The Contractor shall procure all ermits and p licenses., pay all. charges and fees, and give all notices necessary and incidental to~ the due and lawful prosecution of the work. (.i) PATENTS. The Contractor shall assume ail responsibilities arising from the use of patented materials, equipment, devices, or processes used. an or incorporated in the work. PUBLIC CONVENIENCE AND SAFETY. The Contractor shall so conduct his operations as to cause the least possible obstruction and inconvenience to public traffic. Unless other existing streets are stipulated in the special provisions to be used~as detours, all traffic shall be permitted to pass through the work. Residents along the road or street shall. be provided passage as far as practicable. Convenient access to driveways, houses and buildings along the road or street shall be maintained and temporary crossings shall be provided and main rained in good condition. Not more than one cross or intersecting street or road shall be closed at any time without the approval of the Engineer. The Contractor shall furnish, erect, and maintain. such fences, barriers, lights, and signs as are necessary to give adequate warning to the public at all .times that the improvement is under construction and of any dangerous conditions to: be encountered as a result thereof, and he shall also erect and maintain such warnings .and directional signs as may be furnished by the City. .V;..a, , Full compensation for conforming to the provisions of this Section 5 .shall be considered as included in the prices paid f®r the various .contract items of work and no additional compensation will be allowed therefor. (k) RESPONSIBILITY FCR DAMAGE. The City of Bakersfield, the City Council, or the Engineer shall not be answerable. or accountable in any manner for any loss or damage that may happen to the. work or any part~~ thereof.; or for any material or equipment used in performing the work, or for injury or damage to any person or persons, either, workmen or the public; or for damage to adjoining property caused by the negligence of Contractor or one of his subcontractors during the progress of the. work at any time before final acceptance. :The Contractor shall indemnify and save harmless the City o ~ Bakersfield, the City Council, and the. Engineer from any suits,. claims, or actions brought by any person or persons for or on account of any injuries or damages sustained or arising in the construction of the work or in consequence thereof. (1) CONTRACTOR'S RESPONSIBILITY FOR wORK. Except as provided above, until the formal acceptance of the work by the City Engineer, the Contract®r shall have the charge and care thereof and shall bear the risk of injury or damage to any part thereof by the action of the elements or from any other cause, whether arising from the execution or from th.e non-execution of the works The Contractor 9 Two Hundred Dollars ($200.00} per dray for each and ever calendar ~ b y day s delay eyond the time prescribed to complete the work; and the Contractor a tees to g pay such liquidated damages as herein provided,. and in case the same are not aid agrees that the Cit of Bakersfield ma dedu p Y y ct the amount thereof from any money due or that may become due the Contractor under the contract. It is further agreed that in case the work called for under the contract is not finished and: completed in all parts and requirements within the time specified the City Council shall have the. right to extend the time far comple-~ tion or not, as may seem best to serve the interest of the City; and if it decides to extend the tune limit for the completion of the contract, it shall further have the right to charge to the Contractor, his heirs, assigns or sureties, and to deduct from the-final payment for the work, all or any part, as it may deem _ proper, of the actual cost of engineering, inspection, superintendence, and other overhead expenses which are directly chargeable to the contract, anal which accrue during the period of such extension, except that the cost of final surveys and preparation of final estimate shall not be included in such charges. The Contractor shall not be assessed with liquidated damages nor the cost of engineering and inspection during any delay in the completion of the work caused by acts of God or of the public enemy, acts of the City, fire,. floods, epidemics, quarantine restrictions, strikes, freight embargoes, and unusually severe ~veather or delays of subcontractors due to such causes; provided that the Contractor shall within ten (10} days from the beginning of any such delay, notify the Engineer in writing of the causes of delay, who shall ascertain the facts and the extent of the delay, and his findings of the facts thereon shall be final and conclusive. (f} SUSPENSION OF CONTRACT. If at any time in the opinion of the City Council, the Contractor has failed to supply an adequate working force, or material o.f proper quality, or has failed in any other respect to prosecute the work with the diligence and. force specified and intended in and by the terns of the contractp notice thereof in writing will be served upon him, and should he neglect or refuse to provide means for a satisfactory compliance with the contract, as directed by the Engineer, within the..time specified in such notice, the City Council in any. such case shall. have the power to suspend the operation of the contract. Upar~ receiving notice of such suspension, the Contractor shall discontinue said work, or such parts of it as the City Council may designate. Upon such suspension, the Contractor's. control shall terminate, and thereupon the City Council, or its duly authorized representative, may take possession of all or any part of the Contractor's materials, tools, equipment, and appliances upon the premises, and use the same for the purpose of completing said contract, and hire such force and buy or rent such additional machinery, tools., appliances .and equipment, and buy uch additional materials and supplies at the C®ntractor's expense as may be necessary for the proper conduct of the work and for the completion thereof; or may employ other parties to carry the contract to completion, employ the necessary workmen, substitute ether machinery or materials, and purchase the materials contracted for, in such manner as the City Council may deem praperg or the City Council may annul and cancel the contract and re-let the work or any part thereof. Any excess of cost arising therefrom aver and above the contract price will be charged against the Contractor and his sureties, who will be liable 11 payment shall be required to be made, when in the judgment of the City Engineer the work is not proceeding in accordance with the provisions of the contract, or when in his judgment the total value of the work done since the last estimate amounts to less than Three Hundred Dollars ($300.00}. (c) FINAL PAYMENT. The City Engineer shall, after the completion of the contract, make a final estimate of the amount of work done thereunder,. and the value of such work, and the City of Bakersfield shall pay the entire sum so found to be due after deducting therefrom all previous payments and all a~rounts to be kept and all amounts to be retained under the provisions of the contract. All prior partial estimates and payments shall be subject to correction in the final estimate and payment. The final payment shall not be due and payable. until the expiration of thirty (30) days from the date of acceptance of the work by the City Council. It is mutually agreed between the parties to the contract that no cer- tificate given or payments made under the contract., except. the final certificate or final payment, shall be conclusive evidence of the performance of the contract, either wholly or in part,. against any claim of the party of the first part, and no payment shall be construed to be an acceptance of any defective work ar improper materials. And, the Contractor further agrees that the payment of ,the final. amount due under the contract, and the adjustment and payment for any work done in accordance with .any alterations of the same, shall release the City of Bakersfield, the City Council, and the Engineer from any~-and all claims or lia- bility~on account of work performed under the contract or any alteration thereof. .~,a;F (d) SUBSTITUTION OF SECURITIES. .Whenever herein provision is made ~ft,:for withholding or retention of moneys to ensure performance, substitution of an equivalent amount (value} of securities shall be permitted in accordance with the provisions and requirements of Government Code Section 4590. SECTION 8. PROVISIONS OF STANDARD SPECIFICATIONS Thin work embraced herein shall. be done. in accordance with the. appro- priate provisions of construction details, Section to to Section 95, "inclusive, of the Specifications entitled "State of California, Department of Transportation, Standard Specifications, July, 1984," insofar as .the same may apply, which specifications are hereinafter referred to as the Standard Specifications, and in accordance with the following special provisions. Whenever in the Standard Specifications the following terms are used= they shall be understood to mean and refer to the following: Department of Transportation, CALTRANS - The Engineering Department of the City of Bakersfield. Public Works Manager - City Engineer, City of Bakersfield. Engineer - The City Engineer, acting. either directly or through prop- erly authorized agents, such agents acting within the scope of the particular duties entrusted to them. Laboratory - The designated laboratory authorized by the City of Bakersfield to test materials and work involved in the contract. State - The City of Bakersfield. 13 Other terms appearing in the Standard Specifications, the general ro- p visions, and the special provisions, shall have the intent and rneanin s ecified g. p in Section 1, Definition of Terms of the Standard Specifications. In the event that any portion of the Standard. Specifications inco .orated herein shall conflict with any of the provisions delineated in the special ro- P visions section herein set forth., the pr®visions so delineated shall take rece- P deuce over anal shall be,used in lieu of such conflicting portions of the Standard Specifications. . SECTION g . I NSURANC E In addition to any other form of insurance or bonds required under the terms of the contract and. specifications, the Contractor will be required to -carry insure ance of the following kinds .and amounts: contractor's public liability insurance policy far property damage, personal injury and automobile liabilit with an • e y( Insurance company licensed to do business in the State of Californian in an amount not less ,than FIVE H~JNDRED THOUSAND DOLLARS ($500,000.00), combined single-Limit coverage with a TWO MILLION DOLL~4R ($2, 000,000.00) umbrella policy (containing a drop down provision) or, in lieu thereof, a 2.5 MILLION DOLLAR combined single- limit policy. The City of Bakersfield,. its mayor, council, officers, agents and employees shall be named as additional insureds under the policy which shall operate as primary insurance. Lf any part of the work is sublet, similar insurance shall be provided ~y or in behalf of the subcontractors to cover their operations. The insurance hereinbefore specified shall be carried until all work .required to be performed under the terms of the contract. is satisfactorily completed as~evidenced by the forma acceptance by the City. The Contractor shall furnish the Finance Department with .one (1) certificate. copy of each of the executed policies ox a certified Certi~f~icate of Insurance. The certification vn such policies shall guarantee that the policy will not. bE~ amended, ajtered, ~nodife+~, or canceled i,lsofal' as tr.e ~;o~►~ez~age contem- plated hereunder is concerned, without at least five (S) days' notice mailed by registered mail to the Finance Department, City of .Bakersfield, Bakersfield, . California. The insurance herein required shall be obtained by the successful bidder and~the certified copy of the policies or Certificate of Insurance furnished as herein provided, within the time fixed herein for his execution of the contract. Full, compensation for ,all premiums ~vhich the .Contractor and the sub- . contractors are required to pay on all the insurance described above shall be considered as included in the prices paid for the various items of work to be performed under the contract, and no additional allowance will be made therefor or for additional premiums which may be required by extension of the policies of insurance. 14 SECTION 10. QUANTITIES The following preliminary estimate of the quantities of work to be done and materials to be furnished are approximate only, being given as a basis for the comparison of bids, and the City of Bakersfield does not expressly or by ,z implication agree that the actual amount of work will correspond therewith, but reserves the right to increase or decrease the amount of any class or portion of the Work or to omit portions of the work that may be deemed necessary or expedi- ent by the Engineer. The provisions of Section 4-1.03B of the Standard Specifications relative to alterations not involving changes in the character of the work shall not apply to any contract item of work in this proposal. MATERIALS The City of Bakersfield shall furnish the controllers and cabinet assemblies, street name sign panels,"NO PARKING" sign panels. The Contractor shah furnish, for use under these special provisions, all other materials required to complete the attached contract. -City furnished materials shall be made available to the Contractor at the City Corporation Yard, 4lOl Truxtun Avenue. 15 SECTION 12. DESCRIPTION OF WORK The work to be done consists, in general, of installing signs, traffic signals and lighting and median modification. Such other items or details, not mentioned above, that are required by the plans, Standard Specifications, or these special provisions shall be per- formed, placed, constructed or installed. Said work to be done is specifically shown, marked and detailed upon a Plan entitled: TRAFFIC SIGNAL SYSTEMS ON GOSFORD ROAD AT KROLL WAY GOSFORD ROAD AT CAMINO MEDIA lb SECTION 13. GENERAL PROVISIONS (a) PUBLIC SAFETY AND PRESERVATION OF PROPERTY. Attention is directed to Section 7 of the Standard Specifications. The Contractor shall comply with. the provisions of this section, except as otherwise directed by the Engineer. Such provisions for public safety shall meet the minimum requirements. and shall be subject to the approval of the City Engineer. Full compensation for complying with. the requirements of this section shall be considered as included in the contract prices paid for the various items of work and no additional compensation will be allowed therefor. (b} OBSTRUCTIONS. Attention is directed to Section 8-I.10, ''Utility and Non-.Highway Facilities," of the Standard Specifications, the plans, and . the special provisions. where extra work is required by said section it shall be paid for as provided in Section 7. (a) of these specifications. The Contractor will. be required to work around public utility facilities and other improvements that are t~o remain in place within the construction area or that are to be relocated and relocation operations have not been completed. In accordance with the provisions of Section 7-1.11, "Preservation of Property," and 7-1.12, "Responsibility-far Damage," of the Standard Specifications, the Contractor will be liable to owners. of such facilities and improvements for . any damage. or interference with service resulting froni~conducting his operations. The: exact location of underground facilities and improvements ~~•ithin the con- struction area shall. be ascertained by the Contractor before using equipment that may damage such facilities or interfere with the services. Other forces may be engaged in moving or removing. utility facilities or oche rimprovements or maintaining services or utilities, The Contractor shall cooperate with such forces and conduct his operations in such a manner as to avoid. any unnecessary delay or hindrance to the~work being performed by other such forces, Any delay to the Contractor due to utility relocation whether or not the utl.lity is shown or correctly located can the plans w~.ll nr~t be cnmp~nGated for as .idle time. However, additional contract time commensurate with such delays may be allowed. At locations where irrigation systems exist, the Engineer will direct the Contractor as to what steps gill be ,required to protect the irrigation system and the area it serves. The Contractor shall replaee the irrigation system as directed by the Engineer. . Existing land subdivision monuments and stakes shall be fully protected from damage or displacement and they shall not. be disturbed unless directed by the Engineer. Except in the case of extra work, full compensation for conforming to the . requirements of this article shall be considered as included in the prices paid for the various items of work and no additional compensation will be made therefor. (c} 0~1ISSIONS IN SPECIFICATIONS AND DRAWINGS. Any materials or work mentioned in the specifications and not shown on the drawings or sho~~~n on the drawings and not mentioned in the specifications shall be of the same effect as if shown or mentioned in both. 17 Omissionsfrom.the draj~ings or the specifications of the materials or details of work which are manifestly or obviously necessary to carry out the intent of the drawings and specifications or wThich are customarily furnished or performed, shall not relieve the Contractor of his responsibility for furnishing such omitted materials or performing such omitted work; but shall be furnished or performed as if fully shown or described %n the drawings or specifications. . (d) MATERIALS. Whenever any material is specified by name and number thereof, such specifications shall be deemed to be used for the purpose of . facilitating description of the materials and establishing quality, and. shall be deemed and construed to be followed by the words "or approved equal".. No substitution will be permitted other than as described herein unless authorized by the Engineer before the bids are opened. All materials shall be new and the .best of their class and kind. (e) ADJUSTI~~iENT OF OVERHEAD COSTS. The provisions of Section 9-1.08 of P the Standard Specifications shall not apply to final cost of this contract~an~ no final adjustment for overhead costs will be made. (f) .DUST CO~;TROL. It-shall be the Contractors responsibility to prevent a dust nuisance from originating from the site of the work as a result of his operations during the effective period ~of this contract. Preventative measures to be taken by the Contractor shall include but shall not be limited to the following: 1. Water shall be applied to all unpaved areas as required to prevent the surface from becoming dry enough to perr~it dust format ion . 2. Paved surfaces over which vehicular traffic is permitted to travel shall be kept free of dirt. Temporary suspension of the work, eithe~~as a result of order by the Engineer., or as a result of conditions beyond the control of the Contractor shall rot red i e~~~e the Contractor from his responsibility fnr dust contro~. as set forth herein. Full compensation for conforming to the requirements of this article shall be considered as included in the prices paid for the various contract items of work and no additional compensation will be allowed therefor. (g) WATERING. Furnishing and applying. water shall conform to the provisions of ,Section 17 of the Standard Specifications, except that full co ensation therefor shall be considered. as included in the prices paid ~ . for the various contract. items of work and no separate payment will be made therefor. 18 (h) ALTERATIONS IN QUANTITY OF WORK. The provisions of Section 4-1.03B, 4-1.03B(1), and 4-1.03B(2), of the Standard Specifications relative to " increases or decreases in the quantity of contract item of work when no change in the character of the work is involved shall not apply to any. contract item of work in this proposal and the City reserves the right to increase or decrease the quantity of any item or portion of work as may be deemed necessary or in the best interest of the City. (i) WORK IN CITY STREETS. All of the work shown on the plans and, included in these specifications that is located in the public streets in the City of Eakersfield shall be done in accordance with City Ordinances regulating the use of public streets within the City, except as otherwise provided herein. The Contractor shall inform himself as to all regulations and require- . ments of the City Engineer and Superintendent of Streets of the City of Eakersfield and shall conduct his operations in compliance therewith. (j) PERMITS AND LICENSES. The Contractor shall procure all permits and licenses, pay all charges and fees and give all notices necessary and inci- dental to the due and lawful prosecution of the work. (k) MAINTAINING TRAFFIC. Attention is directed to Sections 7-1.08, "Public Convenience," 7-1.09, "Public Safety," 7-1.092, "Lane Closure," and 7-1.093, "Portable Delineators," of the Standard Specifications. The Contractor shall comply with the provisions of these sections and these special provisions. The Contractor shall furnish, install and maintain signs, lights, flags .and other warning and safety devices .when performing work which interferes ` with or endangers the safe movement of traffic on any street or highway. Signs, lights, flags and other warning and safety devices and their use shall conform to the requirements set forth in the current "Manual of Traffic Controls - Warning Signs, Lights, and Devices for Use in Performance of Work Upon Highways," published by the State of California, Department of Transportation. Application and use of devices shall be as specified and as directed by the Engineer. The Contractor shall keep the Bakersfield Fire Department informed at all times as to the exact location. and progress of the work and shall notify them immediately of any streets impassable for fire fighting equipment. The full width of the traveled way shall be open. for use by public traffic on Saturdays, Sundays and designated legal holidays, before 8:30 A.M. and after 4:00 P.M. on weekdays, and when construction operations are not acti- vely in progress. Designated legal holidays are: January 1st, the third Monday in February, the last Monday in May, July 4th, the first Monday in September, November 11th, Thanksgiving Day, and December 25th. When a designated legal " holiday falls on a Sunday, the following Monday shall be a designated legal holiday. When November 11th falls on a Saturday, the preceding Friday shall be a designated legal holiday. 19 Personal vehicles of the Contractor's employees shall not be parked on the roadway at any time, including any section closed to public traffic. When entering or leaving roadways carrying public traffic, the _ Contractor's equipment, whether empty or loaded, shall in all cases yield to public traffic . The provisions in this section may be modified or altered if, in. the opinion of the Engineer, public traffic will be better served and work expe- dited. Said modifications or alterations shall not be adopted until approved in writing by the Engineer. The prices paid for the various contract items of work shall be con- . sidered as full compensation for complying with the provisions of this Section 13{k) Maintaining Traffic, and no additional payment will be made therefor. {1) ORDER OF WORK. Order of work shall conform to the provisions in Section 5-1.05, "Order of Work," of the Standard Specifications and these spe- cial provisions, Prior to commencement of the traffic signal functional tests, all items of work related to the signal control shall be completed and all signs shall be in place. {m) COOPERATIONS. The Contractors shall cooperate fully with the other Contractors performing work on the site, It is not anticipated that the work to be done by others will seri- ously delay the Contractor's completion of the work. .However, if such work does result in extraordinary delay, the Contractor may seek relief from liquidated damages as set forth in the fourth paragraph of Article b(e) of~these Special Provisions. Full compensation for complying with the requirements of this Article 13(m) shall be considered as included in the prices paid for the various con- tract items of work and no additional allowance will be made therefor. 20 SECTION 14, SPECIAL PROVISIONS - TRAFFIC SIGNALS AND STREET LIGHTING (a) DESCRIPTION. Furnishing, installing and modifying traffic sig- pals and highway lighting and payment therefor shall conform to the provisions in Section 86, "Signals and Lighting.", of the Standard Specifications and these special provisions. Traffic signal work is to be performed at the following locations: GOSFORD ROAD AT KROLL WAY _ GOSFORD ROAD AT CAMINO MEDIA (b) REMOVING AND REPLACING IMPROVEMENTS. Removing and replacing improvements shall conform to the provisions in Section 8b°2,02, "Removing and Replacing Improvements," of the Standard Specifications and these special provisions, (c) FOUNDATIONS. Foundations shall conform to the provisions in .Section 8b-2,03, "Foundations," of the Standard Specifications and these special 0 provisions. The Contractor shall furnish the anchor bolts, nuts and washers to be used for new foundations and shall furnish the appropriate nuts and washers for existing foundations to be reused. Portland cement concrete shall conform to Section 90-10, "Minor Concrete," of the Standard Specifications and shall contain not less than 410 pounds of cement per cubic yard,. except for pile foundations shall contain not lens than 564 pounds of cement per cubic yard. (d) CONDUIT. Conduit shall conform to the provisions in Section 86-2,05, "Conduit," of the Standard Specifications and these special provisions. Insulated bonding bushings will be required on metal conduit. (e) PULL BOXES. Pull boxes shall conform to the provisions in Section 86-2.06, "Pull Boxes," of the Standard Specifications and these special provisions, Recesses for suspension of ballasts will not be required. 21 0 (f} CONDUCTORS AND WIRING. Conductors and wiring shell conform to the rovisions in Section 86-2.08, "Conductors," and p Section 86-2.09, "Wiring," of the Standard Specifications and these special provisions. Conductors shall be spliced by the. use of "C" shaped compression connectors as shown on standard plan ES 13. S 1 is e s shall be insulated by "Method B . Servi~:e shall conform ~to the provis.io~ns in Section 86-2.11, "Service,." of the Standard Specifications and thesE special provisions. . The Engineer will arrange with the serving utility to complete service connections to service points shown on 'the plans and will pay all required costs and fees required. by the utility. ~ i.} TESTING. Testing shall conform to the provisions in Section 86-2.14, "Testing,", of the Standard Specifications and these special provisions. SIGNAL FACES AND SIGNAL HEADS. Signal faces, signal .heads and auxiliary equipment , a s shown on the pian~s , and the installation thereof,' shall conform to the provisions in Section 86-4.01 "Vehicle Signal, Faces," 56-4'.02, "Directional Louvers,'' 86-4.03 ~ "Back lates" and. 86-4.06, "Signal. Mounting Assemblies," p . e of the Standard Specifications and .these special provisions. Housing, visors, directional louvers ,and backplates shall not be structural plastic . All lamps for traffic signal units shall be furnished. by the Contractor. A1.1 mast. arm mounted signal faces a:nd all arrow indications shall be provided With 12-inch sections. ~k} PEDESTRIAN SIGNALS. Pedestrian signals shall conform to the .rovisions in Section 86-~ . 05 , "Pedestrian Signal Faces," of p the Standard Specifications and these special provisions. Pedestrian signals shall be Type C 22' 0 (1) LUMINAIRES. Luminaires 5ha~11 conform to the provisions in Section 8b-b.01, "High Intensity-Di$charge Luminaires," of, the Standard. Specifications: and these special provisions. Luminaires shall be furnished with 200-watt high pressure sodium Lamps. and integral ballast.s~. (m) PHOTOELECTRIC CONTROLS. Photoelectric controls shall conform to the provisions in Section 8b-b.07, "Photoelectric Controls, of the Standard Specifications and these special provisions. Each luminaire shall be provided with a Type IV photoelectrical control. (n) CONTROLLERS,~CA~BINETS AND AUXILIARY EQUIPMENT. The City will ~ a furnish the controller and cabinet assembly for each location. (o) DETECTORS. Detectors shall conform t'o the provisions in Section 86-5, "Detectors," of the Standard Specifications and these special provisions. In lieu of sealing methods specified in Section~8b-S.oIA(5), "Installation Details," of the Standard Specifications, the Contractor may seal loops in A.C., in accordance with the following: After conductors. are installed in the slots cut%n the pavement, . the slots shall be filled with asphaltic emulsion Type CSS-1, Section 94, "Asphaltic Emulsion," to within I/8 inch .of the pavement surface. The emulsion shall. be at Least 1/q inch thick above the top conductor in the sawcut. Plant mixed RMAS, composed of~4 to 8v MC-800 conforming . to Section 93, '.'Liquid Asphalts,'' and aggregate of Type 'C' , No. 4 ~ ° max, grading, conforming to Section 39,~''Asphalt Concrete," shall ~e mixed with asphaltic emulsion placed ,in the slots and tamped, all as directed by the Engineer. Surplus .materials shall be removed from the adjacent surfaces without the use of solvents . Asphaltic emulsion shall be applied to the filled slot and sand applied to the surface, . all ds directed by~the Engineer, ~ i Lead-~in cables shall- consist of 2 No. ~ 12 . copper conductors with each conductor insulated with 35 mils minimum, at any point, high molecular weight, heat-stablized, colored polyethylene. The conductors shall be twisted and the.. twisted pair shall be protected with a shield of tinned copper-brass,- or aluminium-poly. ester. A No. I6 minimum, stranded tinned copper ground drain wire shall be .provided and connected to~the equipment ground within the cabinet. The cable shall be provided with a chrome vinyl outer jacket with a minimum thickness, at any point of 37~mils. , (p) PAYMENT. Payment far signals and Lighting shall conform to the provisions in Section, 8b-8, "Payment", of the Standard Specifications and these especial provisions. Full compensation for cast-in-drilled hole concrete pile foundations shall be considered as included in the contract lump sum price paid for the item requiring foundations and no separate payment will be made therefor. 23 0 SECTION 15. SPECIAL PROVISIONS - ROADSIDE SIGNS (a) ROADSIDE SIGNS. Roadside signs-shall conform to the provisions _ in Section 56-2, "Roadside Signs," of the Standard Specifications and these spe- cial provisions. Sign panels shall be furnished by the City. Mast.-arm hangers shall be furnished by the Contractor. Roadside signs shall be installed by mast-arm hanger methods as shown on Standard Plan Sheet TS-3, 3A (Street Name Sign), or acceptable equal such as Hawkins M1OJ Series swinging sign bracket, with return spring removed. (b) PAYMENT. Payment per .unit for installing sign (Mast-arm Hanger, Street Name Sign) shall conform to the provisions in Section 56-2,06, "Payment," of the Standard Specifications. SECTION 16. SPECIAL PROVISIONS - GUARANTEE FOR TRAFFIC SIGNAL AND STREET LIGHTING SYSTEMS, (a) GUARANTEE. The Contractor shall furnish a written guarantee to the City on the form attached, guaranteeing all systems, except traffic signal .lamps, installed under this contract for a period of one (1} year from the date of acceptance of-the work. The guarantee, properly executed, shall be filed with the City before notice of completion and final acceptance°is made by the City of the work described on the plans and these special provisions. (b) PAYMENT. The lump sum prices paid for installation of traffic signal and street lighting systems shall include full compensation for furnish- ing the guarantee as required in this section. 24 u SECTION 17, SPECIAL PROVISIONS -MEDIAN MODIFICATIONS Ca} DESCRIPTION. This work consists of the removal and recanstruction of median curb, concrete removal and other miscellaneous items in~canformance to the- plans and these special provisions. (b) EXISTING HIGHWAY FACILITIES. The work performed in connection with median modifications and the various .existing highway facilities shall conform to the provisions in Section 15, "Existing Highway Facilities," of the, Standard Specifications,.. the plans and these special provisions, Existing facilities removed shall be disposed of in conformance to the provisions in Section 7~-1,.13, "Disposal of Material Outside the Highway Right of _ Way," of the Standard Specifications, 1. REMOVE CONCRETE F CONCRETE CURBING. Removing concrete,:concrete f®otings, and concrete curbing shall conform to the provisions in Section 15, "Existing Highway.
