Ki ~ mko Finance Director i j VA CITY OF BAKERSFIELD DEPARTMENT OF PUBLIC WORKS NOTICE TO CONTRACTORS SEALED PROPOSALS will be received by the City of Bakersfield at the Office of the Purchasing Officer, City Hall, 1501 Truxtun Avenue, Bakersfield, California, until 2:00 o'clock P.M. on February 5, 1987 to be publicly opened and read immediately thereafter, for the following work: TRAFFIC SIGNAL SYSTEM ON STINE ROAD AT WILSON ROAD Plans and specifications, and forms of proposal, bonds, and contract, may be obtained. at the office of the. Purchasing Officer by posting a refundable deposit of ZERO DOLLARS -0- ) for each complete set. Refund of deposit will be made provided the plans and specifications are returned to the Purchasing Officer within ten (10) days from date of contract award and the doc- uments are in reasonable good condition.. No bid will be considered unless it is made on a proposal form furnished y the Purchasing Officer, which appears herein immediately following the speci- ficatons of the project, and is made in accordance with the provisions set forth under Section Z, "Proposal Requirements and Conditions" of the Standard Specifications of ..the Department of Transportation, Business & Transportation Agency, State of California, under date of July, 1984. Each bid-must be accom- panied by a proposal guarantee in accordance with the requirements of article 2-1.07 of the said Section 2 of the Standard Specifications. The City of Bakersfield reserves the right to reject any or all-bids. Bids are required on the entire work described herein. Substitution of securities for moneys retained to ensure performance shall be permitted pursuant to the provisions and requirements of Government Code 4590. The eligible securities include interest bearing demand deposit accounts, standby letters of credit, or any other security agreed to by the Contractor and the City of Bakersfield. The request for substitution of securities to be deposited shall be submitted on the form entitled "Escrow agreement for Security Deposits in Lieu of Retention" included in the back of these special provisions. The Contractor must possess a valid Class A or a combination of Class C-8, Class C-1O, Class C-12 .and Class C-34 Contractor's License at the time this contract is awarded. SPECIFI~'ATIONS~ The work embraced herein shall be done in accordance with the Standard Specifications of the Department of Transportation, Business and Transportation Agency, dated July, 1984, insofar as the same may apply and in accordance with the following provisions. 1 S-STINE.I PROGRESS OF THE WORK AND TIME FOR COMPLETION. Attention is directed to the provisions of Section 8, Article 8-1.06, "Time of Completion" and Article 8-1,07, "Liquidated Damages," of the Standard Specifications, and is specifi- cally hereby made a part of these special provisions. The Contractor shall furnish the Engineer with a statement fro the vendor that the order for the electrical materials required for this contract has been received and accepted by said vendor, and said statement shall be furnished within fifteen (15) calendar days from the date of the contract, Said statement shall show the date or dates the electrical materials will be shipped. The Contractor shall begin work within fifteen (15) calendar days from the date of the contract and shall diligently prosecute the same to completion, except .for signal and lighting standards and other above ground electrical equipment if said electrical equipment has not yet been received, before the expiration of TWENTY (20) WORKING DAYS beginning with the fifteenth (15) day following the date of the contract, Signal and lighting. standards and other above ground electrical a u merit q P shall not be erected until all electrical materia-ls are received.. Upon receipt of said electrical materials, the Contractor shall com lete-all electri . P cal work, including functional tests, before the expiration of FIFTEEN (15) WORKING DAYS. from the date all electrical materials are received, but in no case shall the work be completed later than the expiration of SEVENTY FIVE (-75) DAYS beginning with the fifteenth (15th) day following the date of the contract for said work. 2 S-STINE.2 CITY OF BAKERSFIELD, CALIFORNIA DEPARTMENT OF PUBLIC WORKS SECTION 1. PROPOSAL REQUIREMENTS (a) GENERAL INFORMATION. The Purchasing Officer of the City of Bakersfield, California, will receive at her office, City Hall, in said City, until 2 o'clock P.M. on February 5, 1981 sealed proposals for. TRAFFIC SIGNAL SYSTEM ON STINE ROAD AT WILSON ROAD (b) PROPOSAL FORM. All proposals must be made upon blank forms to be obtained from the Purchasing Officer, the form of which appears herein immedi- ately following the a specifications, All proposals must give the prices pro-~ posed, both in writing and figures, and must be signed. by the bidder, with his address. If ,the proposal is made by an individual, his name and post office address must be shown. If made by a firm or partnership, the name and post office address of each member of the firm or partnership must be shown. If made by a corporation, the proposal must show the names of the state under-the laws of which the coxporaton was chartered and the names, .titles., and busi- Hess addresses of the president, secretary and treasurer. (c) BIDDER'S GUARANTEE. All- bids shall be presented under Sealed cover and shall be accompanied by a certified check. or `bid bond fade payable to the City of Bakersfield, for an amount equal to at least ten .percent (10% of the amount of said bid,, and no bid shall be considered unless such cert- Pied check or bide bond is enclosed therewith. {d): RETURN .OF BIDDER'S GUARANTIES. .Within ten {10) days after the award of the cont-Tact, the City of~Baker field will return the proposal guaranties accompanying such of .the proposals as are. not to be considered in making the award. All other proposal guaranties. will be held until thecon- tract has been. finally executed, after which they will be returned to the respective bidders whose proposals they accompany. {e) CONTRACT BONDS. The Contractor shall furnish two good and suffi- cient bonds. One of the said bonds shall guarantee the faithful performance of the said contract by the Contractor and shall be in an amount equal to one hundred percent (100%) of the contract price. The other of the said bonds shall be in an amount of fifty percent (50%) of the contract price and shall be furnished as required by the terms of an act entitled: "An act to secure the payment of the claims of persons employed by contractors upon public works, and the claims of persons. who furnish materials, supplies, teams, implements, or machinery used or consumed by such contractors in the performance of such works, and prescribing the duties of certain public officers with respect thereto," approved May 10, 1919, as amended. Forms of bonds required may be obtained at the office of the City Attorney. 3 S-STINE.3 Whenever any surety or sureties on any such bonds, or on any bonds required by law for the protection of the claims of laborers and material men, become insufficient, or the Mayor has cause to believe that such surety or sure- ties have become insufficient, a demand in writing may be made of the Contractor for such further bond or bonds or additional surety, not exceeding that origi- Wally required, as is considered necessary, considering the extent of the work remaining to be done. Thereafter no payment shall be made upon such contract to the Contractor or any assignee of the Contractor until such further bond or bonds or additional surety has been furnished. (f) REJECTION OF PROPOSALS CONTAINING ALTERATIONS, ERASURES OR IRREGULARITIES, Proposals may be rejected if they show any alterations of form, additions not called for, conditional or alternative bids, incomplete bids, era- sures or irregularities of any kind. Proposals in which the prices obviously are unbalanced may be rejected. The .right is reserved to reject any and all proposals. (g) AWARD OF CONTRACT. The award of the contract, if it be awarded, will be made within thirty (30) days after the opening of the proposals. (h) EXECUTION OF CONTRACT. The contract shall be signed by the sue- cessful b-idder and returned, together with the contract bonds within ten (10} days, not including Sundays, after the bidder has received notice that the con- tract has been awarded. No proposal shall be considered binding upon the City until the execution of the contract. A11 contracts shall be considered as being made and entered into in the City of Bakersfield, California. Failure to execute a contract and file acceptable bonds as provided herein within ten (10) days, not including Sundays, after the bidder has received notice ,.,that the contract has been awarded., shall be just cause for the cancellation of the. award and the forfeiture of the proposal guaranty. (i) EXAMINATIONS OF PLANS, SPECIFICATIONS, SPECIAL PROVISIONS, AND SITE OF WORK. The bidder is required to examine carefully the site of, the pro- posal, plans and specifications, and contract forms for the work contemplated, and it will be assumed that the bidder has investigated-and is satisfied as to the conditions to be encountered, as to the character, quality, and quantities of work to be performed and materials to be furnished, and as to the require- ments of the specifications, the special provisions, and the contract. It is mutually agxeed that the submission of a proposal shall be considered prima facie evidence that the bidder has made such examination. SECTION 2. SCOPE OF WORK (a) WORK TO BE DONE. The work to be done consists of furnis~a~:ng all labor, materials, methods and processes, implements, tools and machinery, except as otherwise specified, which are necessary and required to construct the pro- posed. improvements, as designated in the contract. (b) ALTERATIONS. By mutual consent in writing of the parties signa- Cory to the contract, alterations or deviation, increases or decreases, addi- tions or omissions, in the plans and specifications, may be made and the same shall in no way affect or make void the contract. 4 ~ S-STINE.4 o The City of Bakersfield reserves the right to increase or decrease the quantity of any item or portion of the work, or to omit portions of the work as may be deemed necessary or expedient by the Engineer. (c) EXTRA WORK. New and unforeseen work will be classed as extra work when such work cannot be covered by any of the various items or combination of items for which there is a bid price. The contractor shall do no extra work except upon written order form the Engineer. For such extra work the contractor shall receive payment as pre- viously agreed upon in writing, or he shall be paid on force account. (d) REMOVAL OF OBSTRUCTIONS. The contractor shall remove and dispose of all structures, debris, or other obstructions or .any character of the con- struction of the street or road, if and as required by the~Engineer. The contractor shall remove and dispose ~of all trees designated by the Engineer as obstructions to the proper completion of the work. The removing and disposing of all obstructions to the prosecution of the. contract, unless otherwise specified, shall be considered as included in the variou items of contract work and no additional compensation will be allowed therefor. s (e) FINAL CLEANING UP. Upon completion and beforemaking-application for acceptance of the work, the contractor shall clean the street or road, bor- row pits, and all ground occupied by him in connection with the work, of all TUbbish, excess materials, temporary structures, and equipment; and all parts of the work shall be left in a neat and presentable condition. SECTLON 3: ~ CONTROL OF THE WORK (a) AUTHORITY OF THE. ENGINEER. The engineer shall decide any and all questions which may arise as to the quality or acceptability of materials fur- Wished and work performed, and as to the manner of performance and rate of pro- gress of the work; all questions which arise as to .the interpretation of the plans-and specifications; all questions, as to the acceptable fulfillment of the contract on .the part of the contractor; and all questions as to claims and compensation. The Engineer's decision shall~be final and he shall have executive authority to enforce and make effective such decisions and orders as the con- tractor fails, to carry out promptly. (b) PLANS. All authorized. alterations a.~fecting the requirements and information given on the approved plans sha~~? be in writing. No changes-shall be made of any plan or drawing after the same has been approved by the Engineer, except by direction of the Engineer. Working drawings or plans for any structure not included in the plans furnished by the Engineer shall be approved by the Engineer before any work involving these plans shall be performed,, unless approval is waived in writing by the Engineer. 5 ~ S-STINE.S e It is mutually agreed, however, that the approval by the Engineer of the contractor's working plan does not relieve the contractor of any responsibility for accuracy of dimensions and details, and that the contractor shall be respon- sible for agreement and conformity of his working plans with the approved plans and specifications. (c) CONFORMITY WITH PLANS AND ALLOWABLE DEVIATION. Finished surfaces in all cases shall conform with the lines, grades, cross-sections, and dimen- sions shown on the approved plans. Deviations from the approved plans, as may be required by the exigencies of construction will be determined in all cases by the Engineer and authorized in writing. (d) COORDINATION OF PLANS, SPECIFICATIONS, AND SPECIAL PROVISIONS. These specifications, the plans, special provisions, and all supplementary docu- ments are essential parts of the contract, and a requirement, occurring in one is a binding as though occuring in all. They are intended to be cooperative, to describe, and to provide for a complete work. Plans shall govern .over specifi- cations; special provisions shall govern .over both specifications and plans. City specifications shall govern over State Standard, Specifications. ' (e) INTERPRETATION OF PLANS AND SPECIFICATIONS. Should it appear . that the work to be done, or any matter relative thereto, is not sufficiently detailed or explained in these specifications, plans, and the special provision, the contractor shall apply to the Engineer for such further explanations as may be necessary, and shall conform to such explanation or interpretation as -part of the contract, so far as may be consistent with .the intent of .the origi- nal specifications. In the event of doubt or question relative to the true meaning of the specifications, reference shall be made to the City Council, whose decision thereon shall be final. In the event of any discrepancy between any drawings-and the figures written thereon,. the figures shall be taken. as correct. (f) SUPERINTENDENCE.. Whenever the contractor is not present on any part of .the. work. where it may be desired to give direction, orders will be given by the Engineer in writing, and shall be received and obeyed by the super- intendent or foreman in charge of the particular work in reference. to which. orders are given. (g) LINES AND GRADES. All distances and measurements are given and will be made in a horizontal plane. Grades are given from the top of stakes or nails, unless otherwise noted on the plans. Three consecutive points shown on the same rate of slope must be used in common, in order to detect any variation from a straight grade, and in case any such discrepancy exists, it must be reported to the Engineer. If such a discrepancy is not reported to ~-he Engineer, the contractor shall be responsible for any error in the finished work. The contractor shall give at least 24 hours notice in writing when he will require the services of the Engineer for laying out any portion of the work. The contractor shall furnish the Engineer such facilities and labor, nec- essary for making and maintaining points and lines, as he may require. Labor furnished by the Contractor for such purposes will be paid for as Extra Work. b S-STINE . b ~ c o 6 The contractor shall preserve all stakes and points set for lines, grades, or measurements of the work in their proper places until authorized to remove them by the Engineer. All expenses incurred in replacing stakes that have been removed without proper authority shall be paid by the contractor. (h) INSPECTION.p The Engineer shall at all times have access to the work during construction, and shall be furnished with every reasonable facility for discertaining full knowledge respecting the progress, workmanship, and char- acter of materials used and employed in the work. Whenever the contractor varies the period during which work is carried on each day, he shall give due notice to the Engineer, so that proper inspection may be provided. Any work done in the absence of the Engineer will be subject to rejection. The inspection of the work shall not relieve the contractor of any of his obligations to fulfill the contract as prescribed., Defective work ,shall be made good, and unsuitable materials may be rejected, notwithstanding the fact that such defective work and unsuitable materials have been previously over- looked by the Engineer and accepted or estimated for payment. Projects financed in whole or in part with State funds shall be sub- ject to inspection at all times by the Director of Public Works, or his agents. n (i) REMOVAL OF DEFECTIVE AND UNAUTHORIZED .WORK. A1.1 work which is defective in its construction o.r deficient in any of the requremen s of these specifications shall b:e remedied, or removed and replaced:by the contractor in an acceptab a manner, and no compensation will be allowed for such correction. Any work done beyond the lines and grades ,shown on the plans- or estab- lished by the Engineer, or any extra work done without written authority, will be considered as unauthorized and will. not be paid for. Upon failure on the part of .the contractor to ..comply forthwith with any order of the Engineer made under. the provisions of this article, the Engineer shall have authority to cause defective work to be remedied, or removed and replaced, and unauthorized work to be removed, and to deduct the costs thereof from any monies due or to become due the contractor. (j) FINAL INSPECTION. Whenever the work provided and contemplated by. the contract shall have been satisfactorily completed and the final cleaning up performed, the .Engineer will make final inspection. SECTION 4. CONTROL OF MATERIALS ~3) SAMPLES AND TESTS. At the option of the Engineer, the source of supply of each of the materials shall be approved by the Engineer before deliv- ery is started and before such material is used in the work. Representative preliminary samples of the character and quality prescribed shall be submitted by the contractor or producer of all materials to be used in the work, for test- ing or examination as desired by the Engineer. 7 ~ S-STINE.7 E e All tests of materials furnished by the contractor shall be made in accordance with commonly recognized standards of national organizations, and such special methods and tests as are prescribed in the specifications. The contractor shall furnish such samples of materials as are requested by the Engineer, without charge. No material shall be used until it has been approved by the Engineer. Samples will be secured and tested whenever necessary to determine the quality of material. (b) DEFECTIVE MATERIALS. All materials not conforming to the requirements of these specifications shall be considered as defective, and all such materials, whether in place or not, shall be rejected and shall be removed immediately from the site of the work unless otherwise permitted by the Engineer. No rejected material, the defects of which have been subsequently corrected, shall be used until approved in writing by the Engineer. Upon failure on the part of the contractor to comply with any order of the Engineer made under the provisions of this article, the Engineer shall have authority to remove and replace defective material and to deduct the cost of removal and replacement from any monies due or to become due the contractor. SECTION S. LEGAL RELATIONS AND RESPONSIBILITIES T~ THE PUBLIC {a) LAWS TC BE OBSERVED. The contractor shall keep himself fully -informed of all existing and future State and National laws and all municipal ordinance and regulations of the.City of Bakersfield which in any manner affect' those engaged or employed in the work, or the materials used in the work, or which in any way affect the conduct of the work, and of all such orders and- decxees of bodies or tribunals having any jurisdiction or authority over the same. (b) .HOURS OF LABOR. The contractor shall forfeit, as penalty to-the City of Bakersfield,. Ten Dollars {$10.00) for each laborer, workman, or mechanic employed in the execution of the contract by him, ox by any subcontractor under him, upon-any of the work herenbefore mentioned, for each calendar day during which said laborer, workman, or mechanic is required or permitted to labor in violation of the provisions. of Section 1810 to Section 1$15, inclusive, of the Labor Code. (c) The contractor shall comply with Section 6705 of the Labor Code which provides that the contractor's responsibility shall be as follows: If the contract price for the project includes an expenditure in excess of twenty-five thousand dollars ($25,000) for excavation of any trench or trenches five feet or more in depth, the contractor or his subcontractor shall not begin any trench excavation unless a detailed plan, showing the design of shoring, bracing, sloping or other provisions to be made for worker protection during. the excavation of the trench, has been submitted by the contractor to the City Engineer and the detailed plans has been approved by the City Engineer. 8 S-STINE.8 . 0 If such plan varies from the shoring system standards established by the Construction Safety Orders of the Division of Industrial Safety, the plan shall be prepared by a registered civil or structural engineer. Nothing in this section shall be deemed to allow the use of a shoring, sloping, or protective system less effective than that required by the Construction Safety Orders of the Division of Industrial Safety. Nothing in this section shall be construed to impose tort liability on the awarding body or any of its employees. The terms "public works" and "awarding body", as used in this section, shall have the same meaning as in Labor Code Sections 1720 and 1722 respectively. (d) EQUAL EMPLOYMENT OPPORTUNITY. During the performance of this contract the Contractor agrees as follows: (1) The contractor will not discriminate against any employee or applicant for employment because of race, creed, color, sex, or national origin. The Contractor .will take affirma- hive action to ensure that applicants are employed, and than employees are treated during employment,. without regard to their race.,. creed, color, sex, or national ori- gn. Such action shall include, but not be limited to, the fo lowing: Employment, upgrading,- demotion, or transfer; recruitment or recruitment advertising; layoff or ter- urination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The Contractor agrees to post 'in conspicuous places, available to employees and applicants for employment, notices to be provided setting forth the provisions of this non- discrimination clause. {2) The Contractor will, in all solicitations or advertisements for employees placed,by or on behalf of the Contractor, stave that all qualified applicants will receive considera- tion for employment without regard to race, creed, color, sex, or national origin. {3) The Contractor will send to each labor union or representa- tive of workers with which he has a collective bargaining agreement or other contract or understanding, a notice to be provided advising the-labor union or workers' represen- tative of the Contractor's commitments under Section 202 of Executive Order No. 11246 of September 24, 1965 and shall post copies of the notice in conspicuous places available to employees and applicants for employment. (4) The Contractor will comply with all provisions of Executive Order No. 11246 as amended by Executive Order 11375, and of the rules, regulations, and relevant orders of the Secretary of Labor. a 9 S-STINE.9 • i (e) PREVAILING WAGE. The Contractor shall, as a penalty to the City of Bakersfield, forfeit $25.00 for each calendar day or portion thereof, for each workman paid less than the stipulated prevailing rates for such work or craft in which. such workman is employed under this contract or by any subcon- ° tractor under him, in violation of the provisions of Section 1770 to Section 1780, inclusive of the Labor Code. Copies of the prevailing rate of per diem wages, for each craft, clas- sification or type of workman needed to execute the contract, are on file in the office of the Director of Public Works and shall be made available to any inter- ested party on request. (f) APPRENTICES. All Contractors and Subcontractors shall comply with the provisions of Labor Code Section 1777.5 relating. to the employment of apprentices. (g) REGISTRATION OF CONTRACTORS. Before submitting bids, Contractors shall be licensed in accordance with the provisions of: Section 7055 of Business and Professions .Code. (h) PERMITS AND LICENSES. The Contractor shall procure all permits and licenses, pay all charges and fees, and. give all notices necessary and inci- dental to the due and lawful prosecution of the work. (i) PATENTS.- The Contractor shall: assume all responsibilities aris- ing from the use of patented materials, equipment, devices, or processes used on or incorporated in the work. {j} PUBLIC CONVENIENCE AND SAFETY. The Contractor shall so conduct his operations as to cause the least possible obstruction and inconvenience to public traffic. Unless other existing streets are stipulated in the special provisions to be used as detours, all traffic shall be permitted to pass through the work. Residents along the road or street shall be provided passage as far as practicable. Convenient access. to driveways, houses and buildings along the road or street shall be maintained and temporary crossings shall be provided and maintained in good condition. Not more than :one cross or intersecting street or road shall be closed- at any time without the approval of the Engineer. The Contractor shall furnish, erect, and maintain such fences, barriers, lights, and signs as are necessary go give adequate warning to the, public at all times that the improvement is under the construction and of any dangerous conditions to be encountered as a result thereof, and he shall also erect and maintain such warnings and directional signs as may be furnished by the City. Full compensation for conforming to the provisions of this Section 5 (j) shall be considered as included in the prices paid for the various contract items of work and no additional compensation will be allowed therefor. y V 10 - S-STINE.10 m i (k) RESPONSIBILITY FOR DAMAGE.. The City of Bakersfield, the City Council, or the Engineer shall not be answerable or accountable in any manner for any loss or damage that may happen to the work or any part thereof; or for any material or equipment used in performing the work, or for injury or damage to any person or persons, either workmen or the public; or for damage to adjoining property caused by.the negligence of Contractor or one of his subcon- tractors during the progress of the work at any time .before final acceptance. The Contractor shall indemnify and save harmless the City of Bakersfield, the City Council, and the Engineer from any suits, claims, or actions brought by any person or persons for or on account of any injuries or damages sustained or arising in the construction of the work or in consequence. thereof. . (1) CONTRACTOR'S RESPONSIBILITY FOR WORK. Except as provided above, until the formal acceptance of the work by the City Engineer, the Contractor shall have. the charge and care thereof and- shall bear the risk of injury or damage to any part thereof by the action of the elements or from any other cause, whether arising from the execution or from the non-execution of the work. The Contractor shall rebuild:, repair, restore, and make good all injuries or damages to any portion of the work occasioned by and of the above causes. before final accep- tanceand shall bear the expense thereof, except such injuries or damages occa- sioned by acts of the Federal Government or the public enemy, (m) N0 PERSONAL LIABILITY. Neither the City Council, the Engineer, nor any other officer or authorized assistance or agent shall be personally responsible for any liability arising under the contract. (n) RESPONSIBILITY OF CITY, The City of Bakersfield shall not be held responsible for the care or protection of any material or parts of the work prior to final acceptance, except as expressly provided in these specifications. SECTION 6.0 PROSECUTION AND PROGRESS ta) SUBLETTING-AND ASSIGNMENT. The Contractor shall give his per- sonal attention to the fulfillment of the contract and shall keep the work under his control. Subcontractors will not be recognized as such, and all persons engaged in the work of construction will be considered as employees of the Contractor, and their work shall be subject to the provisions of the contract and specifications. Where a portion of the work sublet by the Contractor is not being pro- secuted in a manner satisfacfoby to tr_ City Engineer, the subcontractor shall be removed immediately on the requisition of the City Engineer and shall not again be employed on the work. ('b) The Contractor shall diligently prosecute the work to completion before the expiration of the permitted number of working days or calendar days as specified on Page 1 of this specification. 11 S-STINE.11 m (c) CHARACTER OF WORKMEN. If any subcontractor or person employed by the Contractor shall fail or refuse to carry out the directions of the Engineer or shall appear to the Engineer to be incompetent or to act in a disorderly or improper manner, he shall be discharged immediately on the requisition of the Engineer, and such person shall not again be employed on the work. (d) TEMPORARY SUSPENSION OF WORK. The Engineer shall have the authority to suspend the work wholly or in part, for such period as he may deem necessary, due to unsuitable weather, or to such other conditions as are consid- ered unfavorable for the suitable prosecution of the work, or for such time as he may deem necessary, due to the failure on the part of the Contractor to carry out orders given, or to perform any provisions of the work. The Contractor shall immediately obey such order of the Engineer and shall not resume the work until ordered in writing by the Engineer. (e) TIME OF COMPLETION AND LIQUIDATED DAMAGES. It is agreed by the parties to the contract that in case all the work called for under the contract. is not completed before or upon the expiration of the time limit as set forth in these specifications, damage will be sustained by the City of Bakersfield,. and that it is and will be impracticable to determine the actual damage which the, City will sustain in the event of and by reason of such delay, and it is th-ere- fore agreed that the Contractor will pay to the City of Bakersfield the sum of Two Hundred Dollars ($200.00) per day for each and every calendar. day's delay. beyond the time prescribed to complete the work.; and the .Contractor agrees to pay~such liquidated damages as herein provided, and in case the same are not paid; agrees that the City of Bakersfield may deduct the amount thereof from any money due or that may become due the Contractor under the contract. It is further agreed that in case the work called for under the con- tract is not finished and completed in all parts and requirements within the time specified the City Council shall have the right to extend the time for com- pletion ar not, as may seem best to serve the interest of the City;'and if it decides to extend the time limit for the completion of the contract, it shall further have the right-to charge to the Contractor, his heirs, assigns or sure- ties, and to deduct from the final payment for the work, all or .any part, as it may deem proper, of the, actual cost of engineering, inspection, superintendence, and other overhead expenses which are directly chargeable to the contract, and which accrue during the period of such extension, except that the cost of final surveys and preparation of final estimate shall not be included in such charges. The Contractor shall not be assessed with liquidated damages nor the cost of engineering and inspection. during any delay in the completion of the work caused by acts of God or of the public enemy, acts of the City, fire, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and unu- sually severe weather or delays of subcontractors due to such causes; provided that the Contractor shall within ten (10) days from the beginning of any such decay, not~.f~~ the Engineer in writing of the causes of delay, who shall ascer- tain the facts and the extent of the delay, and his findings of the facts thereon shall be final and conclusive. 12 S-STINE.12 a (f~ SUSPENSION OF CONTRACT. If at any time in the opinion of the City Council, the Contractor has failed to supply~an adequate working force, or material of proper quality, or has failed in any other respect to prosecute the work with the diligence and force specified and intended in and by the terms of the contract, notice thereof in writing will be served upon him, and should he neglect or refuse to provide means for a satisfactory compliance with the contract, as directed by the Engineer, within the time specified in such notice, the City Council in any such case shall have the power to suspend the operation of the contract. Upon receiving notice of such suspension, the Contractor shall discontinue said work, or such parts of it as the City Council may designate. Upon such suspension, the Contractor's control shall terminate, and thereupon the City Council, or its duly authori-zed representative, may take possession of all or any part of the Contractor's materials, tools, equipment, and appliances upon the premises, and use the same for the purpose of completing said contract, and hire such force and buy or rent such additional machinery, tools, appliances and equipment, and buy such. additional materials and supplies at the Contractor's expense as may be necessary for the proper conduct of the work and for the completion thereof; or may employ other parties to carry the contract to completion, employ the neces- sary workmen, substitute other machinery or materials, and purchase the materi- als contracted for, in such manner as the .City Council may deem proper; or the City Council may annul and cancel the contract and re-let the work or any part thereof.. Any excess of -cost arising therefrom over and above the contract price will be charged against the Contractor and his sureties,. who will be .liable therefor. In the event. of such suspension, all money due. the Contractor or retained under. the terms of this contract shall be forfeited to the City; but such forfeiture will not release the contractor or his sureties from liability or failure to fulfill the contract. The Contractor and his sureties will be credited with the. amount of money so forfeited toward any excess of cost over .and above the contract price, arising from the suspension of the operations of the contract and the completion of the work by the City as above. provided, and- the.Contractor will be so credited with any .surplus remaining after-all just- claims for such completion have been paid. In the determination of the ques ion whether there has been any such non-compliance with the contract as to warrant the suspension or annulment thereof, the decision of the City Council shall be binding on all parties to the contract. (g) RIGHT OF WAY. The right of way for the work to be constructed will be provided by the City. The Contractor shall make his -own arrangements, and pay. all expenses for additional area required by him outside of the limits of right of way unless otherwise provided in the Special Provisions. SECTION 7. MEASUREMENT AND PAYMENT (a) EXTRA AND FORCE ACCOUNT WORK. Extra work as hereinbefore defined, when ordered and accepted, shall be paid for under a written work order in accordance with the terms therein provided. Payment for extra work will be made at the unit price or lump sum previously agreed upon by the Contractor and the Engineer, or by force account. I3 ~ S-STINE.13 O If the work is done on force account the Contractor shall receive the actual cost of all material furnished by him as shown by his paid vouchers, plus fifteen percent (15%), and for all equipment and teams that are necessary he shall receive the current prices in the locality, which shall have been previ- ously determined and agreed to in writing by the Engineer and by the Contractor, plus fifteen percent (15%) and for all labor that is necessary he shall receive the current prices in the locality, plus twenty percent (20%) provided, however, that the City reserves the right to furnish such materials required as it deems expedient, and the Contractor shall have no claim for profit on the cost of such materials. The price paid for labor shall include all payments imposed by State and Federal laws for all payments made to, or on behalf of, the workmen, other than actual wages. All extra work and force account shall be adjusted daily upon report sheets, prepared by the Engineer, furnished to the Contractor and signed by both parties, which daily reports shall thereafter be considered the true record of extra work or force account work done. (b) PROGRESS PAYMENTS. The Contractor shall, once in each month, submit for approval, an estimate in writing to the City ,Engineer of the total amount ofwork done by the Contractor, to the time of such estimate, and the value thereof, The City of Bakersfield shall retain ten percent (10%) of such estimated value of the work done a part security for the fulfillment of the contract by the Contractor, and shall, monthly pay to the Contractor, while carrying on the work, the balance not retained, as aforesaid,. after deducting therefrom all previous payments and all sums to be .kept or retained under. the provisions of the contract. No such estimate or payment-shall be required to be made, .when inthe judgment of the City Engineer the work is not proceeding in accordance with the provisions of the contract, or when in his judgment the total value, of .the work. done since. the last estimate amounts to less than Three Hundred Dollars ($300.00). (c) FINAL PAYMENT. The City Engineer shall, after the completion of the contract; make a final estimate of the amount of work done thereunder, and the value of such work, and the City of Bakersfield shall pay-the entire sum so found to be due after deducting therefrom all prev-ions payments and all amounts to be ,kept and all amounts to be retained-under the provisions of the contract, All prior partial estimates and payments shall be subject to correction in the final estimate and payment, The final .payment shall not be due and payable until the expiration of thirty (30) days from the date of acceptance of the work by the City Council. It is mutually agreed between the parties to .the contract that no cer- tificate given or payments made under the contract, except the final certificate or final payment, shall be conclusive evidence of the performance of the contract, either wholly or in part, against any claim of the party of the first part, and no payment shall be construed to be an acceptance of any defective work or improper materials. And the Contractor further agrees that the payment of the final amount due under the contract, and the adjustment and payment for any work done in accordance with any alterations of the same, shall release the City of Bakersfield, the City Council, and the Engineer from any and all claims or lia- bility on account of work performed under the contract or any alteration thereof , ° 14 S-STINE.14 (d) SUBSTITUTION OF SECURITIES. Whenever herein provision is made for withholding or retention of moneys to ensure performance, substitution of an equivalent amount (value) of securities shall be permitted in accordance with the provisions and requirements of Government Gode Section 4590. SECTION 8. PROVISIONS OF STANDARD SPECIFICATIONS This work embraced herein shall be done in accordance with the appropri- ate provisions of construction details, Section 10 to Section 95, "inclusive, of the Specifications entitled "State of California, Department of Transportation, Standard Specifications, July, 1984," insofar as the same may apply,•which spec- ifications are hereinafter referred to as the Standard Specifications, and in accordance with the following special provisions. Whenever in the Standard Specifications the following terms are used, they shall be understood to mean and refer to the following: Department of Transportation, CALTRANS - The Engineering Department of the City of Bakersfield. Director of Public Works - City Engineer, City of Bakersfield. Engineer - The City Engineer, acting either directly or through properly authorized agents, such agents acting within .the scope of the particular duties entrusted to them. Labora ory - The designated laboratory autho'rize'd by the City of Bakersfield to test materials and work involved in the contract, State - The City of Bakersfield. Othex terms. appearing in the, Standard Specifications, the general provi- sions, and the special provisions, shall have the intent and meaning specified in Section 1, Definition, of Terms of the Standard Specifications. In the event that any portion of the Standard Specifications incorpo.rated herein shall conflict with any of the provisions delineated in the special pro- visions section herein set forth, the provisions so delineated shall take piece- deuce over and shall be used in lieu of such conflicting portions of the Standard Specifications. SECTION 9. INSURANCE In addition to any other form of insurance or bonds required under the terms of the contract and specifications, the Contractor will be required to carry insurance of the following kinds and amounts: contractor's p~a~blic liabil- ity insurance policy for property damage, personal injury a~~,i auton~~bile liabil-. ity,(with an insurance company licensed to do business in the State of California) in an amount not less than FIVE HUNDRED THOUSAND DOLLARS ($500,000), combined single-limit coverage with a TWO MILLION DOLLAR ($2,000,000.00) umbrella policy (containing a drop down provision) or, in lieu thereof, a 2.5 MILLION DOLLAR combined single-limit policy. The City of Bakersfield, its mayor, council, officers, agents and employees shall be named as additional insureds under the policy which shall operate as primary insurance. 15 S-STINE.15 If any part of the work is sublet, similar insurance shall be provided by or in behalf of the subcontractors to cover their operations. The insurance hereinbefore specified shall be carried until all work required to be performed under the terms of the contract is satisfactorily com- pleted as evidenced by the formal acceptance by the City. The Contractor shall furnish the Finance Department with one (1} certif- icate copy of each of the executed policies or a certified Certificate of Insurance. The certification on such policies shall guarantee that the policy will not be amended, altered, modified, or canceled in so far as the coverage contem- plated hereunder is concerned, without at least five (5} days' notice mailed by registered mail to the Finance Department, City of Bakersfield, Bakersfield, California. The insurance herein. required shall be obtained by the successful bidder and the certified copy of the policies or Certificate of Insurance furnished as herein provided, within the time fixed herein for his execution of the contract, : Full compensation .for all premiums which the Contractor and the subcon- tractors are required to pay on all the insurance..deserbed above shall be con- sidered as included in ,the prices paid for the various items of work to be performed under the contract, and no additional allowance will be made therefor or for additional premiums :which may be required by extension of the policies of insurance. SECTION 10. QUANTITIES The following preliminary estimate of the quantities of work to be done. and materials to be furnished are approximate only, being given as a ba is for the comparison of bids, and the City of Bakersfield does not expressly or by mpli-cation agree. that the actual amount of•work wi l correspond therewith, but reserves the right to increase or decrease the amount of any class or portion of the-work or to omit portions of the-work that may be deemed necessary or expedi- ent by the Engineer. The Contractor shall furnish, for use under these special provisions, all materials required to complete the attached contract, except those materials provided by the City where specified in these special provisions, SECTION 12. DESCRIPTION OF WORK The general description of work is as follows: Installation of traffic signal and light system.. Reconstruction of alley and Stine Road, south, including paving, concrete and drainage work. Said work is shown and detailed on a plan entitled: TRAFFIC SIGNAL SYSTEM ON STINE ROAD AT WILSON ROAD SECTION 13. GENERAL PROVISIONS. (a) PUBLIC SAFETY AND PRESERVATION OF PROPERTY, Attention is directed to Section 7 of the Standard Specifications. The Contractor shall .comply with the provisions of this section, except as otherwise directed by the Engineer. Such provisions for public safety shall meet the minimum requirements and shall be subject to the approval of the City Engineer. Full compensation for complying with the requirements of this section shall be considered as included in the contract prices paid for the various items of work and no additional compensation will be allowed therefor. (b) OBSTRUCTIONS. Attention is directed to Section 8-1,10, "Utility and Non-Highway Facilities," of the Standard Specifications, the plans, and the special provisions. Where extra work is required by said section it shall be paid for as provided in Section 7.(a) of these. specifications. The Contractor will be required to work around public utility facilities and other improvements that are to remain in place within the construction area or that are to be relocated and relocation operations have not been completed. In accordance with the provisions of Section 7-1.11, "Preservation of Property," and 7-1.12, "Responsibility for Damage," of the Standard Specifications, the Contractor will. be liable to owners of such facilities and improvements for any. damage or interference with service resulting from conducting his operations, The exact location of underground facilities and improvements within the con- struction area shall be ascertained by the Contractor befojv~e using equipment that may damage uch facilities or interfere with the serv~'~es. Other forces may be engaged in moving or removing utility facilities or other improvements or maintaining services or utilities. The Contractor shall cooperate with such forces and conduct his operations in such a manner as to avoid any unnecessary delay or hindrance to the work being performed by other such forces. 18 S-STINE.18 9 Any delay to the Contractor due to utility relocation whether or not the utility is shown or correctly located on the plans will not be compensated for as idle time, However, additional contract time commensurate with such delays may be allowed. At locations where irrigation systems exist, the Engineer will direct the Contractor as to what steps will be required to protect the irrigation sys- tem and the area it serves. The Contractor shall replace the irrigation system as directed by the Engineer. Existing land subdivision monuments and stakes shall be fully protected from damage or displacement and they shall not be disturbed unless directed by the Engineer. Attention is directed to the fact that nuisance- water may be present at all times along the project. It will be the responsibility of the Contractor to provide. for handling of said water and any expense involved shall be considered as included in the prices paid for the various items of work and no additional allowance will be made therefor. Except in the case of extra work, full compensation for conforming to the requirements of this .article shall be considered as included in the prices paid for the various items. of work and no additional compensation-will be made therefor. (c) OMISSIONS IN SPECIFICATIONS AND DRAWINGS. Any materials or work mentioned in the specifications and not shown on thee. drawings or shown on the drawings and not. mentioned in the specifications shall be of the same effect as if shown or mentioned in both. Omissions from the drawings or the specifications of the materials or details of work which are manifestly or obviously necessary to carry out the intent of the drawings and specifications or which are customarily furnished or performed, shat not relieve the Contractor. of his responsibility for furnishing such omitted materials or performing such omitted work; but shall be'furnished or performed as if fully shown or described in the drawings or specifications. (d) MATERIALS. whenever any material is specified by name and number - thereof, such specifications shall be deemed to be used for the purpose of fac- litating description of the materials and establishing quality, and shall be deemed and construed to be followed by the words "or approved equal". No sub- stitution will be permitted other than as described herein unless authorized by the Engineer before the bids are opened. All materials shall be new and the best of their class .and kind.- (e) ADJUSTMENT OF OVERHEAD COSTS. The provisions of Section 9-1.08 of the Standard Specifications sh-.11 not apply to final cost~of this contract-and no final adjustment for overhead costs will be made. 19 _ S-STINE.19 9 (f) DUST CONTROL. It shall be the Contractor's responsibility to pre- vent a dust nuisance from originating from the site of the work as a result of his operations during the effective period of this contract. Preventative meas- ures to be taken by the Contractor shall include but shall-not be limited to the .following: 1. Water shall be applied to all unpaved areas as required to prevent the surface from becoming dry enough to permit dust formation. 2. Paved surfaces over which vehicular traffic is permitted . to travel shall be kept free of dirt. Temporary suspension of the work,, either as a result of order by the Engineer, or as a result of conditions beyond the control of the Contractor shall not relieve the .Contractor from his responsibility for dust control as set forth herein. Furl compensation for conforming to the requirements of this article shall be considered as included in the prices paid for the various contract items of work and no additional compensation will be allowed therefor. (g) WATERING. Furnishing and applying water shall conform to the pro- visions of Section 17 of the Standard Specifications, except that full compensa- tion therefor shall be considered.as included in .the prices paid for the various cont-race items and no separate payment will be made therefor. (h) ALTERATIONS IN QUANTITY OF WORK. The provisions of Sec ion 4-1.O~B, 4-1.03B(1), and 4-1.03B(2), of the standard Specifications relative to increases or decreases in the quantity of contract item of work, when no change in thecharacter of the work is irwolved shall .not apply to any contract item of .work in this proposal and the City reserves, the right to increase or decrease the quantity of any item or portion of work as may be deemed necessary or in the bust interest of the City. (i) WORK IN CITY STREETS. All of the work shown on the plans and included in these specifications that is located in the public streets in the City of Bakersfield shall be done in accordance with City Ordinances regulating the use of public streets within the City, except as otherwise provided herein. The Contractor shall inform himself as to all regulations and require- ments of the City Engineer and Superintendent of Streets of the City of Bakersfield and shall conduct his operations in compliance .therewith. (j) PERMITS AND LICENSES. The Contractor shall procure all permits and licenses, pay all charges and fees and give all notices necessary and inci- derital to tYie due and lawful prosecution of the work. (k) MAINTAINING TRAFFIC. Attention is directed to Sections 7-1.08, "Public Convenience," 7-1.09, "Public Safety," 7-1.092, "Lane Closure," and 7-1..093, "Portable Delineators," of the Standard Specifications. The Contractor shall comply with the provisions of these sections and these special provisions. 20 S-STINE.20 The Contractor shal_1 furnish, install and maintain signs, lights, flags and other warning and safety devices when performing work which interferes with or endangers the safe movement of traffic on any street or highway. Signs, lights, flags and other warning and safety devices and their use shall conform to the requirements set forth in the current "Manual of Traffic Controls - Warning Signs, Lights, and Devices for Use in Performance of Work Upon Highways," published by the State of California, Department of Transportation. Application and use of devices shall be as specified and as directed by the Engineer. The Contractor shall keep the Bakersfield Fire Department informed at all times as to the exact location and progress of the work and shall notify them immediately of any streets impassable for fire fighting equipment. The full width of the traveled way shall be open for use by public traffic on Saturdays, Sundays and designated legal holidays, before 8:30 A.M. .and after 4:00 P.M. on weekdays, and when construction operations are not acti- vely in progress. Designated legal holidays are: January lst, the. third Monday in February, the last Monday in May, ,July 4th, the first Monday in September, November 11th, Thanksgiving Day, and December 25th. When a designated legal holiday falls on a Sunday, the following Monday shall be a designated legal holiday. When November 11th falls. on a Saturday, the preceding Friday shall be a designated legal holiday. Personal vehicles of the Contractor's employees shall not be parked on the roadway at any time, including any section closed to public traffic. When entering or .leaving roadways carrying public traffic, the Contractor's equipment, whether empty or loaded, shall in all cases yield to public traf f is. The provisions in this section may be modified or altered if, in the opinion. of the Engineer, public traffic will be better served and work expe- dited. Said modifications or alterations shall not be adopted until approved in writing by the Engineer. The prices paid .for the various contract items of work shall be con- sidered as full compensation for complying with the provisions of this Section 13(k) Maintaining Traffic, and no additional payment will be made therefor. (1) ORDER OF WORK. Order of work shall conform to the provisions in Section 5-1.05, "Order of Work," of the Standard Specifications and these spe- cial provisions. All striping removal shall be completed a minimum of 2 days prior to signal being placed into operation. When initially installed, all vehicle and pedestrian signal faces shall be aimed and covered with cardboard or other material with an observation hole (max. 1" dia.) in front of each signal indication. The covers shall remain in place until all signal operations have been checked and signal is placed into operation. 21 S-STINE.21 . Prior to commencement of the traffic signal functional tests, all items of work related to the signal control shall be completed and all signs shall be in place. . (m) COOPERATIONS. The Contractors shall cooperate fully with the other Contractors performing work on the site. It is not anticipated-that the work to be done by others will seri- ously delay the Contractor's completion of the work. However, if such work does result in extraordinary delay, the Contractor may seek relief from liquidated damages as set forth in the fourth paragraph of Article b(e) of these Special Provisions. Full compensation for complying with the requirements of this Article 13(m) shall be considered as included in the prices paid for the- various con- tract items of work and no additional allowance will be made therefor. SECTION I4. SPECIAL PROVISIONS (a) MAINTAINING TRAFFIC. Attention is directed to Sections 7-1.08, "Public Convenience," 7-1.09 "Public Safety,'' and 12, "Construction Area Traffic Control Devices," of the Standard Specifications and these special provisions. Nothing in these. special provisions shall be construed as relieving the Contractor from his responsibility as provided in said Section 1-.1..09. The fourteenth, fifteenth, sixteenth., and nineteenth paragraphs of Section 7-1.08, "Public Convenience," of the. Standard Specifications, shall be amended to read as follows: Upon completion of rough grading at the grading plane, or placing any subsequent layer thereon, the surface of the roadbed shall be brought to and maintained at a smooth, even-condition,. free of humps and depressions, satisfac- tory for the use of public traffic. After the surface of the roadbed has been brought to a smooth, even condition for the passage of public traffic as above provided, any-work ordered by the Engineer (in addition to maintaining a smooth, even condition as above provided) for accommodation of public traffic prior to commencing subgrade open- ations will be paid for as extra work as provided in Section 4-1.03D, of the Standard Specifications. After subgrade preparation for a specified layer of material has been completed, the Contractor'shall, at his own expense, repair any damage to the roadbed or completed subgrade, including damage caused by his operations or use by public traffic. Except during periods of road closure, when allowed by these special provisions, a minimum of one traffic lane, not less than twelve feet in width, shall be open for use by public traffic where construction operations are acti- vely in progress. Where construction operations are not actively in progress, not less than two such lanes shall be open for use by public traffic. Public traffic may be permitted to use the shoulders and, if half-width construction methods are used, may also be permitted to use the side of the roadbed opposite to the one under construction. No additional compensation will be allowed for any shaping of shoulders or reshaping of subgrade necessary for the accomodation of public traffic thereon during subgrade preparation and paving operations. , 22 S-STINE.22 In order to expedite the passage of public traffic through or around the work and where ordered by the Engineer, the Contractor shall, at his own expense, furnish, install, and maintain construction area signs, lights, flares, temporary railing (Type K), barricades, and other facilities for the sole con- venience and direction of public traffic, Also, where directed by the Engineer, the Contractor shall furnish competent flagmen whose sole duties shall consist of directing the movement of public traffic through or .around the work. The signs "Road Construction Ahead," No. C-18, and "End Construction," No. C-13, shall be furnished, installed and maintained by the Contractor at locations as directed by the Engineer at least 48 hours in advance of any construction. At location where public traffic is being routed over a surface upon which a seal coat is to be applied the seal coat shall not be applied to more than one-half the width of the traveled way at a time, and the remaining. width shall be kept free of obstructions and open for use by public traffic until the seal coat first applied is ready for use by traffic. At the direction of the Engineer, or at Contractor's option, sand may be spread over newly applied seal coat surfaces. Whenever traffic lanes are to be closed to public traffic, the Contractor shall close lanes as shown in the current Manual of Traffic Controls and as directed by the Engineer. .The first paragraph in Section 12-2.02, "Flagging Costs," of the Standard Specifications, is amended to read: The cost of furnishing all flagmen, including transporting flagmen.,. to provide for .passage of ,public traffic through the. work under the provisions in Sections 7-1.08, '.'Public Convenience," .and 7-1.09, "Public Safety," will be borne by the Contractor. The costs of placing and moving flagging signs and the cost of :providing stands or towers for use of flagmen shall be considered as part of the cost of furnishing flagmen. The fourth paragraph in Section 12-3.04, "Portable Delineators," of the Standard Specifications is amended to read: A minimum of two reflective bands, each not less. than 3 inches wide, shall be .mounted at least 1-1/2 inches apart and at a height on the post so that one reflective band will be between 2.5 feet and 3 feet above the roadway surface. The second paragraph in Section 12-3.Ob, "Construction Area Signs," of the Standard Specifications, is amended to read: Construction area signs shall be installed as designated in the spe- cial provisions as directed by the Engineer. Section 12-3.08, "Temporary Railing (Type K)", of the St~~ndard Specifications is amended by adding the following after the 1.3th paragraph: Each rail unit placed within 10 .feet of a traffic lane shall have a Contractor-furnished reflective marker installed thereon as directed by the Engineer. The Contractor shall also install a Type P marker at each end of a Type K railing installed adjacent to a two way highway and at the end of railing facing traffic when installed adjacent to a one way roadway. 22A S-STINE22A Full compensation for conforming to the requirements of this article shall be considered as included in the prices paid for various items of work and no additional allowance will be made therefor. (b) EXISTING HIGHWAY FACILITIES. The work performed in connection with various existing facilities shall conform to the provisions in Section 15, "Existing Highway Facilities," of the Standard Specifications and these special provisions. Existing highway signs and street markers shall remain the property of the City of Bakersfield. Such signs and street markers shall be relocated and maintained during construction so as to convey the same intent that existed prior to construction. Existing City highway signs and street markers shall be placed in their permanent position by the Contractors forces prior to completion of construction. Signs removed from the project area shall be delivered to the City Corporation Yard at 4101 Truxtun Avenue. Full compensation-for conforming to the requirements of the.two pre- ceedng paragraphs shall be considered as included in .the prices .paid for the various items of work and no additional allowance will be made therefor. (c) REMOVE CONCRETE. Removing concrete shall conform to the provi- sions in Sections 15, Existing Highway Facilities, 16, Clearing and Grubbing, and 19-1.04, "Removal .and Disposal of Buried Man-Made Objects," of the Standard Specifications and these special provisions. Concrete removed shall be disposed of in accordance with the provi- sions in Section 7-1.13, "Disposal of Material Outside the Highway Right of Way," of the Standard Specifications. Removing sidewalk .and drive approaches shall be measured and paid by ,the square foot of sidewalk removal in accordance with the provisions of Section 15-3.04 "Payment" of the Standard Specifications. Removing median curb and curb and gutter shall be measured and paid for by the linear foot of curb and gutter removal in accordance with the provisions of Section 15-3.04 "Payment" of the Standard Specifications. Removing concrete cross gutter shall be measured and paid for on a lump sum basis in accordance with the provisions of Article 15-3.04 "Payment" of the Standard specifications. Removing catch basin and concrete pipe shall be measured and paid for on a lump sum basis in accordance with the provisions of Article 15-2.07 "Payment" of the Standard Specifications. (d) ADJUST MANHOLE. Frames and covers of existing manholes shall be adjusted to grade in accordance with the provisions in Section 15-2.05, "Reconstruction," of the Standard Specifications, the details shown on the plans, these special provisions, and City Standards S-1 and S-8. 23 S-STINE.23 If existing manhole frames and covers are damaged during removal, a new frame and cover shall be furnished. The Contractor shall provide and install a temporary plywood floor inside the sewer manhole to collect all debris that results from his construc- tion. The Contractor shall remove all debris plywood floor from the manhole in the presence of the Engineer. The surface of the concrete shall be protected from public traffic for a minimum of three days. At the option of the Contractor, minor concrete containing a minimum of seven sacks of cement per cubic yard may be used and the time required for protection of the concrete surface from public traffic shall be reduced to a 'minimum of one day. MEASUREMENT AND PAYMENT. Adjust manhole will be paid for at .the con- tract unit price each, which price shall include full compensation for furnishing all labor, materials, tools, equipment and for doing all the work involved in adjusting the manhole, complete with concrete pad, including excavation and sawcutting pavement at the periphery of the square PCC pad. (e) CLEARING AND GRUBBING. Clearing and grubbing shall conform to ' the provisions in Section 16, "Clearing and Grubbing," of the Standard Specifications and these special provis-ions. Clearing-and grubbing shall be limited to concrete gutters, those areas to .receive asphalt concrete and other areas actually affected by the planned construction as directed by the Engineer. . Dirt and loose material shall be removed from all areas to be cleared and-grubbed, including ''chuckholes". The Contractor may use any method, approved by the Engineer, that does not create a dust problem, to clean the areas to be cleared and grubbed. However, in residential areas a self- . contained, pick-up type, power broom with water distribution system-shall be used to clean the areas to be cleared and grubbed. The seventh paragraph of Section lb-1.03, "Construction," of the Standard Specifications is deleted. (f) EARTHWORK. Earthwork shall conform to the provisions in Section 19 "Earthwork," of the Standard Specifications and these special provisions.. Section 4-1.05. 10Use of Materials Found on the Work," of the Standard. Specifications shall be amended to read as follows: Unless designated as selected material as provided in Section 19-2.07, "Selected Mate~ia1," the Contractor, with the approval of the Engineer, may ~~se in the proposed construction such stone, gravel, sand or other material suitable in the opinion of the Engineer as may be found in excavation. The Contractor will be paid for the excava- tion of such materials at the contract price for such excavation, but he shall replace at his expense with other suitable material all of that portion of the material so removed and used which was contem- plated for use in the work. The Contractor shall not excavate or remove any material from within the highway location that is not within the excavation, as indicated by the slope and grade lines, without written authorization from the Engineer. 24 S-~TINE.24 It is anticipated that there will be 494 cubic yards of surplus material which shall become the property of the Contractor and shall be disposed of outside of the highway right of way in accordance with the provisions of Section 7-1.13, "Disposal of Material Outside the Highway Right of Way," of the Standard Specifications. _ When asphalt concrete is to be placed on the grading plane, the grad- e ing plane at any point shall not vary by more than 0.05-foot above or below the grade established by the Engineer. Section 19-3,Ob2, "Slurry Cement Backfill," of the Standard Specifications is deleted and shall not apply to this contract, The relative compaction limits specified in the second paragraph of Section 1.9-5.03 "Relative Compaction (95 Percent)," of the Standard Specifications are amended to the limits .shown on the plans and typical cross- ; sections and shall be determined by: ASTM D1557-70, Method "C" Standard Test Method for Moisture-Density Relations of Soils using l0 lb, (4,5 Kg) rammer and 1$" (457mm) drop, Calif, Test Methods 216 or 231. .The subgrade must be .smooth, uniform and true to the required grade. Driveways and private road approaches shall be constructed as directed by the Engineer. ~ . Rounding of cut slopes will not be required. In areas where existing bituminous surfacing. is to be placed in embankments more than 2.O feet below finished grade or where embankment is to placed over existing bituminous surfacing more than 2.0 feet below finished. grade,: the surfacing shall be broken up and mixed with the underlying or embank- went material to produce a dense, compact embankment. In areas where existing bituminous surfacing in to be placed in embankments within 2.O feet of the. finished grade or where embankment is to be placed :over existing bituminous surfacing within 2,O fee of finished grade, the surfacing shall be .broken that no lumps greater than 3" in maximum dimension remain. The estimated quantity of roadway excavation required or the work described in these special provisions and shown on the plans shall be the final .quantity. for which payment will be made unless the dimensions of the work as shown on the plans are revised by the Engineer.. If .the- limits or the dimensions of the work are revised, and such revisions result in an increase or decrease in the quantities of roadway excavation, the final quantity for payment will be revised in the amount represented by the change in dimensions or limits. The estimated quantity of roadway excavation required to complete the work shall be considered as approximate only and no guarantee is made that the quantity which can be determined by computations based on the details and dimensions shown on .,the::. plans will equal the estimated quantity. No allowance will be made in the event that the quantity based on these computations or the quantity actually required to be excavated to complete the work do not equal the estimated quan- tity, except as indicated above in the case of revisions ordered by the Engineer. 25 S-STINE.25 a a (g) FINISHING ROADWAY. Finishing roadway shall conform to the provi- sions in Section 22, "Finishing Roadway," of the Standard Specifications and these special provisions. In addition to the conditions, provisions and requirements of Section 22-1.01, "Description," of the Standard Specifications, the following shall apply: The Contractor shall remove, from all affected areas, whether inside or outside the project limits, all excess and/or objectionable mate- rial originating within the project Iimits and transported by public traffic or by the Contractor's operations. The Contractor may use any method, approved by the Engineer, that does not create a dust problem to remove the excess and/or objectionable material from the affected areas. However, in residential areas, when a broom is used, a self-contained, pick-up type,. power broom with water distribution system shall be used. The first paragraph in Section 22-1..03, "Payment," of the Standard Specifications, is amended to read: The contract lump sum price paid for finishing roadway shall include full compensation for furnishing all labor, materials, tools, equip- ment, and incidentals, and for doing all the work involved in finish- ing the entire project, including all ramps, connecting roads and streets, frontage roads, road approaches, and channelized intersec- tions, whether inside or outside the highway-right of way, and all other areas, whether inside or outside the project limits, affected by public traffic or by the Contractor's operations, all as shown on the plans, and as specified in the Standard Specifications and these spe- dial provisions, and as directed bythe Engineer. (h) ASPHALTIC PAINT BINDER. Asphaltic paint binder shall be asphaltic emulsion and shall be furnished and applied as set forth in Section 39-4 of the Standard Specifications and at he rate of 0.05 gallons per square yard of surface covered. Furnishing all labor, materials, tools and equipment for applying asphaltic paint binder shall be considered as included in the contract price paid per ton for Asphalt Concrete Type "B" and no additional com- pensation will be allowed therefor. (i) AGGREGATE BASE. Aggregate base shall be Class 2 and shall con- form to the provisions in Section 2b, "Aggregate Bases," of the Standard Specifications and these special provisions. Aggregate for Class, 2 aggregate base shall be clean and free from veg- etable matter and other deleterious substances. Compact the aggregate base to 95% relative compaction. Compaction is determined by the following test methods: California No, 21b, California No. 231, or ASTM D1557-70, Method C. For verification purposes, the tonnage of compacted aggregate base will be calculated from the dimensions shown on the plans, adjusted by the amount of any change ordered by the Engineer. 2b S-STINE.26 MEASUREMENT AND PAYMENT: Submit a weighmaster's summary sheet, show- ing the tonnage of aggregate base delivered to the job each day, to the inspec- tor on the following work day. No allowance will be made for aggregate base placed in excess of the dimensions shown on the plans unless directed by the Engineer. Aggregate base shall be paid for at the contract unit price per ton. Said price includes full compensation for furnishing all labor, materials, tools, and equipment and for doing all work involved in constructing the aggre- gate base complete in place, as shown on the plans and specified herein. (j) ASPHALT REJUVENATING AGENT (CONSTRUCTION SEAL). Asphalt rejuve- nating agent shall be applied to new asphalt concrete pavement in accordance .with the provisions for fog seal coat in Section 31 of the Standard Specifications and these special provisions. -The asphalt rejuvenating agent shall be composed of a petroleum resin oil base uniformly emulsified with water-and shall conform to the following requirements: .TEST TEST.METHOD REQUIREMENTS Viscosity, 17° F. Test procedure: AASHTO T 59 to be modified by using distilled water in place of 2 percent sodium oleate solution. Before spreading, water shall be added to, and mixed with, the asphalt rejuvenating agent at the approximate rate of one part water, by volume to 2 parts rejuvenating agent. The combined mixture of asphalt rejuvenating agent and water shall be spread at the rate of 0.05 gallon per square .yard of surface covered. At locations where public traffic is being routed over a surface upon which a seal coat is to be applied, the seal coat shall not be applied to more than one-half of the width of the traveled .way in each direction at a time, and the remaining width shall be kept free of obstructions and open for use by pub- lic traffic until the seal coat first applied is ready for use by traffic. Sand shall be spread over newly applied seal coat surfaces, to reduce the hazard of vehicles skidding. 2~ S-STINE:27 a e After the rejuvenating agent has penetrated sufficiently so as to no longer present a hazard to the traveling public, loose sand shall be swept up and removed from the traveled way and gutters. MEASUREMENT AND PAYMENT. Asphalt rejuvenating agent will be measured and paid for by the ton as asphalt rejuvenating agent in the same manner as pro- a vided for asphaltic emulsion in Section 37-1.08, "Measurement," and Section 37-1.09, "Payment," of the Standard Specifications. (k) ASPHALT CONCRETE. Asphalt concrete shall be Type B and shall conform to the provisions in Section 39, "Asphalt Concrete," of the Standard Specifications and these special provisions. Aggregate for-the top layer of Type B asphalt concrete shall conform to the requirements for 1/2 inch maximum, medium grading and aggregate for any lower layers of Type B asphalt concrete shall conform to the requirements for 3/4 inch maximum, medium grading, both as specified in Section 39-2,02, "Aggregate", of the Standard Specifications. when directed by the Engineer, aggregate conforming to any of the grading .requirements in Section 39-2.02, "Aggregate," of the Standard Specifications shall be used to surface intersections, tapers, and other areas where thin layers of asphalt concrete are being constructed. If the finished surface of the asphalt concrete does not .meet the spe- cifed surface tolerances, it shall be brought within tolerance by either (1) abrasive grinding with equipment utilizing diamond blades (with fog seal coat on the areas which have been ground), (2) removal and replacement, or (3) placing an overlay of asphalt concrete. The method will be selected by the Engineer. The corrective work shall be at the Contractor's expense. If used, the. Fog Seal Coat shall be either Asphalt Rejuvenating Agent or Asphaltic Emulsion as directed by the Engineer. If abrasive grinding is used to bring the finished surface to speci- fed surface tolerances, additional grinding shall be performed as necessary to extend the area ground in each lateral direction so that the lateral limits of grinding are at a constant offset from, and parallel to the nearest lane line or pavement edge, and in each longitudinal direction so that the grinding begins and ends at lines normal to the pavement centerline, within any ground area. All ground areas shall be neat rectangular areas of uniform surface appearance. Abrasive grinding shall conform to the requirements in the first paragraph and the last 4 paragraphs in Section 42-2.02, "Construction," of the Standard Specifications. where the compacted thickness is 0.15 foot or less, halfwidth surfac-~ ing operations shall be conducted in such a manner t~iat, at the end of each day's work, the distance between the ends of ac jacen`surfaced lanes shall not be greater than can be completed in the following day of normal surfacing opera- tions. Additional asphalt concrete shall be placed along the transverse edge at the ends of each lane, hand raked, and compacted to form temporary conforms. Kraft paper, or other approved bond breaker, may be placed under the conforms to facilitate the removal of the conforms when paving operations resume. 28 ~ S-STINE.28 o Where the compacted thickness is more than 0,15 foot, the Contractor shall schedule his paving operations such that each layer of asphalt concrete is placed on all contiguous lanes of a traveled way each work shift. At the end of each work shift, the distance between the ends of the layers of asphalt concrete on adjacent lanes shall not be greater than 10 feet. Additional asphalt con- crete shall be placed along the transverse edge at the ends of each lane and along the exposed longitudinal edges between adjacent lanes, hand raked, and compacted to form temporary conforms. Kraft paper, or other approved bond breaker, may be placed under the conform feathers to facilitate the removal of the feathers when paving operations resume. The area to which paint binder has been applied shall be closed to public traffic, Care shall be taken to avoid tracking binder material onto existing pavement surfaces beyond the limits of construction. A prime coat will not be required on subgrade prior to placement of asphalt concrete. Intersections and tapered shoulders shall. be surfaced as directed by the Engineer. At road connections and private drives, shown on the .plans and as directed by the Engineer, additional asphalt concrete surfacing material shall . be placed and hand raked, if necessary, and compacted to form smooth, tapered connections. Where new. asphalt concrete pavement is to conform to existing paved surfaces, the existing pavement shall be saw cut. {1) CONCRETE STRUCTURES. Portland cement concrete structures shall conform to the provisions in Section 51, "Concrete Structures," of the Standard Specifications and these special provisions. MEASUREMENT AND PAYMENT. Full compensation for connecting to existing storm drain, furnishing and installing metal frames-and covers or frames and grates shall be considered as included in the contract prices paid per cubic yard for minor concrete (minor structure) or for concrete (minor structure) of the class and type specified in the Engineer's Estimate, and. no separate payment will be made therefor, (m) MISCELLANEOUS CONCRETE CONSTRUCTION, Portland cement concrete curbs, sidewalks, wheelchair ramps, cross drains, drive approaches, driveways and miscellaneous construction shall conform to the provisions in Section 73, "Concrete Curbs and Sidewalk," of the Standard Specifications and these specia l provisions. SECTION 14, SPECIAL PROVISIONS - TRAFFIC SIGNALS ' - AND STREET LIGHTING (a) DESCRIPTION. Furnishing, installing and modifying traffic sig- pals and highway lighting and payment therefor shall conform to the provisions in Section 86, "Signals and Lighting", of the Standard Specifications and these .special provisions. 29 S-STINE,29 D e Traffic signal work is to be performed at the following locations: STINE ROAD AT WILSON ROAD (b) REMOVING AND REPLACING IMPROVEMENTS. Removing and replacing improvements shall conform to the provisions in Section 86-2.02, "Removin and g Replacing Improvements," of the Standard Specifications and these s ecial P provisions, (c) FOUNDATIONS. Foundations shall conform to the provisions in Section 86-2.03, "Foundations," of the Standard Specifications and these special provisions. The Contractor shall furnish the anchor bolts, nuts and washers to be used for new foundations and shall furnish the appropriate nuts and washers for existing foundations to be reused. . Portland cement concrete shall .conform. to Section 90-10, "Minor Concrete," of the Standard Specifications and shall contain not less than 470 pounds of cement per cubic yard, except for pile foundations .shall contain .not less than 564 .pounds of cement per cubic yard. (d) CONDUIT. Conduit shall conform. to the rovisions in Section P 86-2.05, "Conduit," of°the Standard Specifications and these specie provisions, Insulated bonding bushings will be required on metal conduit., (e) PULL BOXES. Pull boxes shall conform to the provisions in Section. 86--2.06, "Pull Boxes," of the Standard Specifications and these s ecial P provisions. Recesses for suspension of ballasts will-not be required. (f) CONDUCTORS AND WIRING. Conductors and wiring shall conform to the provisions in Section 86-2,08, "Conductors," and Section 86-2.09, "Wiring," of the Standard Specifications and these special provisions.. Conductors shall be spliced by the use of "C" shaped compression con- Hectors as shown on standard plan ES 13. Splices shall be insulated by "Method B." Numbered sentence 2 in the first paragraph of Section 86-2.09D, "Splicing," is amended to read: 2. Pedestrian push button co~mnons in pull boxes. (g) BONDING AND GROUNDING. Bonding and groundin shall conform to g the provisions in section 86-2.10 "Bonding and Grounding," of the Standard Specifications and these special provisions. (h) SERVICE. Service shall conform to the provisions in Section 86-2.11, "service," of the Standard Specifications and these special provisions, 30 S-STINE.30 e The Engineer will arrange with the serving utility to complete service connections to service points shown on the plans and will pay all required costs and fees required by the utility. (i) TESTING. Testing shall conform to the provisions in Section 86-2.14, "Testing," of the Standard Specifications and these special provisions. (j) SIGNAL FACES AND SIGNAL HEADS. Signal faces, signal heads and. auxiliary equipment, as shown on the plans, and the installation thereof, shall conform to the provisions in Section 86-4.01, "Vehicle Signal Faces," 86-4.02, "Directional Louvers," 86-4.03, "Backplates" ..and 86-4.06, "Signal Mounting Assemblies," of .the Standard Specifications and these special provisions. Housing, visors, directional louvers and backplates shall not be structural plastic. All lamps for traffic signal units shall be furnished by the Contractor. All signal faces shall be provided with 12-inch sections. (k) PEDESTRIAN SIGNALS. Pedestrian signals shall conform to the pro- visions in Section $6-4.05, "Pedestrian Signal Faces," of the Standard 'Specifications and these special provisions. Pedestrian signals shall be Type-C. (l.) LUMINAIRES. Luminaires shall conform to the provisions in Section 86-6.01, "High Intensity-Discharge Luminaires," of the Standard Specifications and these special provisions. Luminaires shall be furnished with 200-watt high pressure sodium lamps and integral ballasts. (m) PHOTOELECTRIC CONTROLS, Photoelec.,tric controls shall conform to the provisions in Section 86-6.07, "Photoelectric Controls", of the Standard Specifications and these special provisions. Each luminaire shall be provided with a Type IV photoelectrical control. (n) CONTROLLERS, CABINETS AND AUXILIARY EQUIPMENT. The City will furnish the controller and cabinet assembly for each location. (o) DETECTORS.
