Refuted of deposit will be made provided the plans and specifications are returned to the Purchasing Officer within ten (1.0} days from date of bid opening and the documents are in reasonable good .condition. No bid will be considered unless.. it is made on a proposal form furnished by .the Purchasing Officer, which appears herein immediately following the. speci°~ , fications of the project, and is made in accordance with the provisions set forth under Section-2, "Proposal Requirements and Conditions" of the Standard Specifications of the Department of Transportation, Business & Transportation Agency, State of California, under date of July, 1984. Each bid must be accom-° parried by a proposal guarantee in accordance with he requirements of article 2-1.07 of the said Section 2 of the Standard Snecif ications. -The City of Bakersfield reserves the right to reject any or all bids. Bids: are required on the entire work described herein. Substitution of .securities for moneys retained to ensure performance shall be permitted pursuant to the provisions and requirements of Government Code 4590. The eligible securities include interest bearing demand deposit .accounts, standby. letters of credit, or any other security agreed to by the Contractor and the City of Bakersfield. The request for substitution of securities to be deposited shall be submitted on the form entitled "Escrow agreement for. Security Deposits in Lieu of Retention" included in the back of these special provisions. The Contractor must possess a valid Class A or a combination of Class C- 8 and Class C- 10, C~12 and C®34 Contractor's License at the time this con- tract is awarded. SPECIFICATIONS: The work embraced herein shall be done in accordance with the Standard Specifications of the Department of Transportation, Business and Transportation Agency, dated July, 1984, insofar as the same may apply and in accordance with the following provisions. The Contractor shall diligently prosecute the same to completion before the expiration of 30 working days. The Contractor shall furnish the Engineer with a staten~nt from the vendor that the order for the electrical materials required for this contract has been received and accepted by said vendor, and said statement shall be furnished within fifteen t 15 } calendar da s from the date contr Y of the act. Said statement shall show the date or dates the electrical materials will be shipped. Dl BL.MTV.2 _2® GG.wrn CITY OF B~~.KERSFIELD, CALIFORNIA DEPARTMENT OF PUBLIC WORKS SECTION 1. PROPOSAL REQUIREMENTS ~a) GENERAL INFORMATION. The Purchasing Officer of the City of Bakersfield, California, will receive at her office, City Ha11, in said City, until 2 o'clock P.M, on June 9, 1988 sealed ro orals for Tra p p fflc Signal System on Brundage Lane at Mount Vernon Avenue (b} PROPOSAL FORM. All proposals must be made upon blank forms to be obtained fran the Purchasing Officer, the form of which a ars herein immedi- ate l p~ y follawing these specifications. All proposals must give the prices pro- posed, both in writing and figures, and must be signed by the bidder, with his address. If the proposal is made by an individual, his name and post office address must be shown. If made by a f irm or partnership, the name and post office address of each member of the firm or partnershi rrnast be shown. If p made by a corporation, the proposal must show the names of the state under the laws of which-the corporation was chartered and the names, titles, and busi- ness addresses of the president, secretary and treasurer. (c} BIDDER'S GUARANTEE. All bids shall be presented under sealed cover and shall be accompanied by a certified check or bid bond made a able pY ~o the City of Bakersfield, for an .amount equal to at least ten percent X100 of the amount. of said bid, and no bid shall be considered unless such certi- ~ied check. or bid bond is enclosed therewith. (d) RETURN OF BIDDER'S GU~~ZANTIES. Within ten X10) da s after the Y award of the contract, the City of Bakersfield will return. the proposal guaranties accompanying such of the proposals as are not to be considered in r~laking the award. All other proposal guaranties will be held until the con- tract has been finally executed, offer which they will be returned to the respective biddzrs whose proposals they accompany. {z} CONTRACT BONDS. The Contractor shall furnish two ood and cuffi- g dent bonds. One of the said bonds- shall guarantee the faithful performance of the said contract by the Contractor and shall be in an amount e ual to one hundred rcen q pe t ~100~} of the contract price. The other of the said bonds shall be in an amount of fifty percent ~50~) of the contract rice and shall p be furnished as required by the terms of an act entitled: "An act to secure the payment of the claims of persons e to ed b con L ~ y y tractors upon public works, and the claims oL persons who furnish materials, supplies, teams, implements, or machinery used or consumed by such contractors in the performance of such works, and prescribing the duties ~f certain public, officers with res ct thereto," approved May 10, 1919, as amended. Forms of bonds required may be obtained at the office of the City Attorney. Dl BL, MTV. 3 3 ~ e wrn tiVhenever any surety or sureties on any such bonds, or on any bonds required by law for the protection of the claims of laborers and material men, become insufficient, or the Mayor has cause to believe that such surety or sure-~ ties have becon~ insufficient, a demand in writing may be made of the Contractor for such further bond or bonds or additional surety, not exceeding that origi- nally required, as is considered. necessary, considering the extent of the work remaining to be done. Thereafter no payment shall be made upon such contract to the Contractor or any assignee of the Contractor until such further bond or bonds or additional surety has been furnished. ~f) REJECTION OF PROPOSALS CONTAINING ALTERATIONS, ERASURES OR .IRREGULARITIES. Proposals may be rejected if they sho~v any alterations of form, additions not called for, conditional or alternative bids., incomplete bids, era- sures or irregularities of any kind. Proposals in which the prices obviously are unbalanced may be rejected. The right is reserved to reject any and all proposals. (g) A~ OF CONTRACT. The award of the contract, if it be awarded, will be made to the lowest resonsible bidder. The language nresponsible" refers to not only the attribute of trustworthiness, but the quality, fitness and capacity of the low bidder to satisfactorily perform the work. The award of the contract will be made within forty-five X45} days after the opening of the proposals unless extension is approved by the lowest re ponsible bidder. ~h) EXECUTION OF CONTRACT. The contract shall be signed by the successful bidder and returned, together with the contract bonds within ten X14) days, not including Sundays, after the bidder has received notice that the contract has been awarded. No proposal shall be considered binding upon the City until the execution of the contract.. All contracts shall be considered. as being made and entered into in the City of Bakersfield, California. Failure to execute a contract .and file acceptable bonds as provided herein within ten X10) days, not including Sundays, after .the bidder has received notice that. the contract has been a`~arded, shall be just cause for the cance 1 lat ion of tie award and the forfeiture of the proposal. guaranty o ~i) E~~AMINATI~NS OF PLANS, SPECIFICATIONS, SPECIAL PR®vISIONS, AND SITE OF '4~RK. The, bidder is required to examine carefully the site of , the proposal., plans and specifications, and contract forms for the work- contem~ ated, and it will be assumed that the bidder has investigated and is satisfied as to the conditions to be encountered, as to the character, quality, and quantities of work to be performed and materials to be furnished, and as to the requirements of the .specifications, the special provisions, and the .contract. It is mutually agreed that the submission of a proposal shall be considered prima facie evidence that the bidder has made such examination. Dl BL.MTV.4 4 GG~wrn SECTICXV 2. SCOPE OF WORK (a) WC3RK TO BE DONE. The work to be done consists of furnishing all labor, materials, r~thods and processes, implen~nts, tools and machinery, except as otherwise specified, which are necessary and required to construct the pro- posed improver~nts, as designated in the contract. (b) ALTERATIONS. By mutual consent in writing of the parties signa- tory to the contract, alterations or deviation, increases or decreases, addi- tions or omissions, in the .plans and specifications, nay be made and the same shall in no way affect or .make void the contract. The City of Bakersfield reserves the right to increase or decrease the quantity of any item or portion of the work, onto omit portions of the. work as` may be deemed necessar~r or expedient by the Engineer. (c) E~~I:'RA WORK. New and unforeseen work wi lI be classed as extra work when such work cannot be covered by any of the various items or combination of items for which there is a bid price. The contractor shall do no extra work except upon written order from the Engineer.. For such extra work the contractor shall receive payment as pre- viously agreed upon in writing, or he shall be paid on force account. (d) REMOVAL OF OBSTRUCTIONS. The contractor shall ren~ve and dispose of all structures, debris, or other obstructions or any character of the con- struction of the street or road, if and as required by the Engineer. The contractor shall remove and dispose of all trees designated by the Eng-inset as obstructions to the proper completion of the work.. The removing and disposing of all obstructions to the. prosecution of the: contract, unless otherwise specified, shall be considered as included in the various items of. contract work and no additional compensation will be allowed therefor.. (e) FINAL. CLEANING UP, Upon completion and before making application for acceptance of the work, the contractor shall clean the street or road, bor- row pits, and all ground occupied by him in connection with the work, of all rubbish, excess materials, temporary structures, and equipment; and all parts of the work .shall be left in a neat and presentable condition. Dl BL.MTV.S -5® GG:wrn . SECTION 3 , CONTROL OF THE Ti~RK (a) AUTHORITY OF THE ENGINEER. The engineer shall decide any and all questions which ray arise as to the quality or acceptability of materials fur- niched and work performed, and as to the manner of performance and rate of pro- gress of the .work; .all questions which arise as to the interpretation of the plans and specifications; all questions as to the acceptable fulfillment of the contract on the part of the contractor; and all questions as to claims and compensation., The Engineer's decision shall be final and he shall have executive authority to enforce and make effective such decisions and orders as the con- tractor fails to carry out promptly... (b) PLANS.. All authorized alterations affecting the requirements and information given on the approved plans shall be in writing. No than es shall g be made of any plan or drawing after the same has been approved by the Engineer, except by direction of the Engineer. ~~orking drawings or plans for any structure not included in the plans . furnished by the Engineer shall be approved by the Engineer before any work involving these plans shall be performed, unless approval is waived in writin g by the Engineer. - It is mutually agreed, however, that. the approval by the Engineer of the. contractor's working plan does not relieve the contractor of any responsibility for accuracy of dirr~ns-ions and details, and that the contractor shall be respon- Bible for agreen~nt and conformity. of his working plans with the a roved Tans pp p andspecifications. (c) CONFORMITY WITH PLANS AND .ALLOWABLE DEVIATION. Finished surfaces in all, cases shall conform with the lines, grades., cross--sections, and dmen-~ lions shown on the approved plans. Deviations from the approved plans, as ma e y be rzqulred by the exigencies of construction well be determined In all cases by the Engineer and authorized in writing. (d) COORDINATION OF PLANS, SPECIFICATIONS, AND SPECIAL PROVISIONS, These specifications, the plans, special provisions, and all supplementary docu- ments are essential parts of the contract, and a requirement occurring in one is a binding as though occuring in all. They are intended to be cooperative, to describe, and to provide for a complete work. Plans shall govern over specifi- catons; special provisions shall govern over both specifications and plans. ..City specifications shall govern over State Standard Specifications. (e) INTERPRETATION OF PLANS AND SPECIFICATIONS. Should it appear that the work to be done, or any matter relative thereto, is not sufficiently detailed or explained in these specifications, plans, and the special rovision, p the contractor shall apply to the Engineer for such further explanations as may be necessary, and shall conform to such explanation or interpretation as part of the contract, so far as may be consistent with the intent of the origi- nal specifications. In the event of doubt or question relative to the true moaning of the specifications,. reference shall be made to the City Council, whose decision thereon shall be final. D1 BL . MTV. 6 - 6- C`,C; ~ wrn vv• wra.aa In the event of any discrepancy between any drawings and the figures written thereon, the figures shall be taken as correct. (f~ SUPERINTENDENCE. Whenever the contractor is not present on any part of the work where it may be desired to give direction, orders will be given by the Engineer in writing, and shall be received and obeyed by the super- intendent or foreman in charge of the particular work in reference to which orders are given. fig) LINES AND G~~ADES. All distances and measurements are given and will be made in a horizontal plane. Grades are given from the top of stakes or nails, unless otherwise noted on the plans. 0 Three consecutive points .shown on the same rate of slope rust be used in common, in order to detect any variation from a straight grade, and in case any such discrepancy exists, it must be reported to the Engineer. If such a discrepancy is not reported to the Engineer, the contractor shall be responsible for any error in the finished work.., The contractor shall give at least 24 hours notice in writing when he will require thz services of the Engineer for lading out any portion. of the work, The contractor shall furnish the Engineer such facilities and labor, nec- essary for making .and maintaining points and lines., as he may require. Payment for labor furnished by the Contractor for such purposes is considered as included in various items of work and no additional compensation will be allowed therefor. The contractor shall preserve-all,stakes and points set for lines, grades, or measuren~nts of the work in their proper places until authorized to remove them b~ the Engineer. All expenses incurred in replacing stakes that have been removed without proper authority shall be paid by the contractor. ~h) INSPECTIQN. The Engineer shall at all times have access to the work during construction, and shall be furnished wi h every reasonable facility for discertaning full knowledge. respecting the progress, workmanship, and char- aster of materials used and employed in the work. ~~henever the ..contractor varies the period during ~vhich work is carried on each day, he shall ive due notice to the Engineer, so that proper inspection may be provided. Any work done in the absence of the Engineer will be subject to rejection... The inspection of the work shall not relieve the contractor of any of his obligations to fulfill the contract as prescribed. Defective work shall be made good, and unsuitable materials may be rejected, notwithstanding the .fact that such defective work and unsuitable materials have been previously over- looked by the Engineer and. accepted or estimated for payment. Projects financed in whole or in part with State funds shall be sub- ject to inspection at all times by the Director of Public Works, or his agents. (i) REMOVAL OF DEFECTIVE AND UNAUTHORIZED ARK. All work which is defective in its construction or deficient in any of the requirements of these specifications shall be remedied, or removed and replaced by the contractor in an acceptable manner, and no compensation will be allowed for such correction. Dl HL.M'I'VV.7 -7- GG:wrn Any work. done beyond the 1-fines and grades shown on .the plans or estab- lished by the Engineer, or any extra work. done without written authority, will be considered as unauthorized and-will not be paid for. Upon failure on the part of the contractor to comply forthwith with any order of the Eng~,neer made under the provisions of this article, the Engineer. shall have authority to cause defective work to be remedied., or removed and replaced, and unauthorized work to be removed, and to deduct the costs thereof from any monies due or to become due the contractor. (j} FINAL INSPECTION, whenever the work provided and contemplated by the contract shall have been satisfactorily completed and the final cleaning up performed, tie Engineer will make final inspection. SECTION 4. CONTROL OF MATERIALS (a} SAMPLES AND TESTS. At the option of the Engineer, the source of supply of each of the materials shall be approved by the Engineer before deliv- ery is started and before such material is used in the work. Representative preliminary samples of the character and quality prescribed shall be submitted by the contractor or producer of all materials to be used in the work, for test- ing or examination as desired by the Engineer. All tests of materials furnished by the contractor shall be made in accordance with commonly recognized standards of national organizations, and such special methods and tests as are prescribed in the specifications. The contractor shall furnish such samples. of` materials. as are requested by~the Engineer, Without charge. No material shall be used until it has been approved by the Engineer. Samples will be secured and tested whenever necessary to determine the quality of material. (b} DEFECTIVE MATERIALS. All materials not conforming to the requirements of these specifications shall be considered as defective, and all.. such materials, whether in place or not, shall be rejected and shall be removed i~mediately from the site of the work unless other~rvlae permitted by the ,engineer. No rejected material, the defects of which have been .subsequently corrected, shall be used until approved in writing by the Engineer. Upon failure on the part of the contractor to comply with any order of the Engineer made under the provisions of this article, the Engineer shall have authority to re~ove and replace defective material and to deduct the cost of .removal and replacement from any monies due or to become due the contractor. LEGAL RELATIONS .AND RESPONSIBILITIES TO THE PUBLIC 0 (a) LAWS TO BE OBSERVED, The contractor shall keep himself fully informed of all existing and future State and National laws and all municipal ordinances and regulations of .the City of Bakersfield Which in any manner affect those engaged or employed in the work, or the materials used in the work, or which in any way affect the conduct of the work, and of all such orders and decrees of bodies or tribunals having any jurisdiction or authority over the same. • (b) HOURS OF LABOR. The contractor shall forfeit, as penalty to the City of Bakersfield, Ten Dollars ($10.00) for each laborer, workman, or mechanic employed in the execution of the contract by him, or by any subcontractor under -him, .upon any of the work hereinbefore mentioned, for each calendar day during which said laborer, workman, or mechanic is required or permitted to labor in violation of the provisions of Section 1810 to Section 1815, inclusive, of the -Labor Code. (c) The contractor shall comply with Section 6705 of the Labor Code which provides that the contractor's responsibility shall be as follows:. If the contract .price for the project includes. an expenditure in excess of twenty-five thousand dollars ($25,000) for excavation of any trench or trenches five feet or more in depth, the contractor or hi.s subcontractor shall not begin any trench excavation unless a detailed plan,_shawing the design of shoring, bracing, sloping or other provisions to be made. for worker protection duringthe,excavat-ion of the trench, has been submitted by the contractor to the City Engineer and the detailed plans has been approved by the City Engineer. If such plan varies from the shoring system standards established by the Construction Safety Orders of the Divi ion of Industrial Safety, the plan shall be prepared by a registered civil or structural engineer. Nothing in this section shall be deer~ed to allow the use of a shoring, sloping, or protective system less effective than that required by the Construction Safety Orders of the Division of Industrial Safety. Nothing in this section shall be construed to impose tort liability on the awarding body or any of its employees. The terms "public works" and "awarding body", as used in this section, shall have the same meaning as in Labor Code Sections 1724 and 1722 respectively. Dl BL,M'IfiT. 9 -9° GG:wrn (d) EQUAL EMPLOYMENT OPPORTUNITY. During the performance of this contract the Contractor agrees as follows: s (1) The contractor will not discriminate against any employee or applicant for employn~nt because of race, creed, color, sex, or national origin. The Contractor will take affirma- five action to ensure that applicants are employed, and that employees are treated during employn~nt, without regard to their. race, creed, color, sex, or national ori- gin. Such action shall include, but not be limited to, the following: Employn~nt, upgrading, demotion, or transfer;, recruitment or recruitment advertising; layoff or ter- mination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The Contractor agrees to post in conspicuous places, available to employees and applicants for ernplo~~;nt, notices to be provided setting forth the provisions of this non- dscrimination clause. (2) .The Contractor will, in all solicitations or advertisements for employees placed by or on behalf of the Contractor, state that all qualified applicants will receive considera- tion for emp oyment without regard to race, creed, color, sex, or national origin. (3) The Contractor will send to each labor union or representa- tiwe of workers. with which he has a collective bargaining agreement or other contract or understanding, a notice to be provided advising the labor union or workers' represen- tatve of the Contractor's commitments under Section 2Q2 of Executive Order No. 11246 of September 24, 1965 and shall post copies of the notice in conspicuous places available to employees and. applicants for emplo~~nt. (4) The Contractor will comply with all provisions of Executive Order No. 11246 as amended by Executive Order 11375, and of the rules, regulations, and relevant ordsrs of the Secretary of Labor. (e) PREVAILING wAGE. The Contractor shall, as a penalty to the City of ~Bak~rsf field, forfeit $25.00 for each calendar day or portion thereof, for each workman paid less than the stipulated prevailing rates for such work or craft in which such workman is employed under this contract or by any subcon- tractor under him, in violation of the provisions of Section 1770 to Section 1780, inclusive, of the Labor Code. The Contractor shall be responsible for its own and subcontractors' compliance with~the requirement of Section 1776 of that Code. Copies of the prevailing rate of per diem wages, for each craft, clas- sif ication or type of workman needed to execute the contract, are on file in the office of the Director of Public works and shall be made available to any inter- ested party on request. (f) APPRENTICES. All Contractors and Subcontractors shall. comply with the provisions of Labor Code Section 1777.5 relating t® the employment of apprentices. D1 BL.MTV~10. ®10- GG:wrn (g) REGISTRATION OF CONTRACTORS. Before submitting bids, Contractors shall be licensed in accordance with the provisions of Section 7055 of Business and .Professions Code. (h) PERMITS AND LICENSES.. The Contractor shall procure all permits and licenses, pay all charges and fees, and give all notices necessary and inci-° dental to the due and lawful prosecution of the work. (i) PATENTS. The Contractor shall assume all responsibilities aris- ing from the use of patented materials, equipment, devices, or processes used on or incorporated in the work. (j) PUBLIC CONVENIENCE AND SAFETY. The Contractor shall so conduct his operations as to cause the least possible obstruction and inconvenience to public traffic. Unless other existing streets are stipulated in the special provisions to be used as detours, all traffic shall be permitted to pass through the work. Residents along the road or street shall be provided passage as far as practicable. Convenient access to driveways, houses and buildings along the road or street shall be maintained and temporary crossings shall be provided-and maintained in goad condition. Not more than one cross or intersecting street or road shall be closed at any .time without the approval of the Engineer. The Contractor shall furnish, erect, and maintain such fences, barriers, lights, and signs as are necessary go give adequate-warning to the public at all times that the. improvement is under the construction and of any dangerous conditions to be encountered as a result thereof, and he shall also erect and maintain such warnings and directional signs as may be .furnished by the City.. Full compensation for conforming to the previsions of this Section 5 (j) shall be considered as included in the prices paid for .the various contract items of work and no additional compensation will be allowed therefor. (k) RESPONSIBILITY FAR DAMAGE. The City of.Bakersfield, the City Council, or the Engineer shall not be answerable or accountable in any manner f~L any loss or d~agz that may hap~n to the :work or any part thereof ; or for any material or equipment used in performing the work, or for injury or damage to,any.person or persons, either workmen or the public; or for damage to ad~olning property caused by the negligence of Contractor or one of his subcon- tractors during the progress of the work at any time before final acceptance. The Contractor shall give his per- sonal attention to the fulfillment of the contract and shall keep the work under his control, . If any subcontractor or person employed by the Contractor shall fail or refuse to-carry out the directions of the Engineer or shall appear to the Engineer to be incompetent on to act in a disorderly or improper manner, he shall be discharged immediately on-the requisition of the Engineer, and such person: shall not again be employed on the work. ~d) TEMPORARY SUSPENSION OF ~~RK, The Engineer shall .have. the authority to suspend the work wholly or in part, for such period. as he may deem necessary, due to unsuitable weather, or to such other conditions as are consid- e red unfavorable for the .suitable prosecution of the. work, or for such time as he may deem necessary, due to the failure on the part of the Contractor to carry out orders given, or to .perform any provisions of the work. The Contractor shall immediately obey such order of .the Engineer-and shall not resume the work until ordered in writing by the'Engineer.. ~e ) TI~y~E OF COMPLETION AND LIQUIDATED DA~n~~AGES. The Contractor shall not be assessed with liquidated damages nor the cast of engineering and inspection during any delay in the completion of the work caused by acts of God or of the public enemy, acts of the City, fire, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and unu- sually severe weather or delays of subcontractors due to such causes; provided that the Contractor shall within ten (10) days from the beginning of any such delay, notify the Engineer in writing of-the causes of delay, who shall ascer- Lain the facts-.and the extent of the delay, and his findings of the-facts . thereon shall be final and conclusive. (f) SUSPENSION OF CONTRACT. If at any time in the opinion of the City Council, the Contractor has failed to supply an ade ate workin force ~ g ~ or material of proper,quallty, or has fulled In any other respect to prosecute the, work w~.th the diligence and force specified and intended in and by the terms of. the contract, notice thereof in writing will be served upon him, and should he neglect or refuse to provide rr~ans for a satisfactory compliance with the contract, as directed by the Engineer, within the time specified in such notice, the Ci y Council in any such case shall have the power to suspend the operation of the contract. Upon receiving notice of such suspension, the Contractor shall discontinue said work, or such parts of it as ..the City Council may designate. In the event of such suspension, all money due the Contractor or retained under the terms of -this contract shall be forfeited to the City; but such forfeiture will not release the contractor or his sureties from liability .or failure to fulfill the contract. The Contractor and his sureties will be credited with the amount of .money so forfeited toward.. any excess of .cost over and above the contract price, arising from the suspension of the operations of the contract and the completion of the work by the City as above provided, and the Contractor will be so credited with any surplus remaining after all just claims for such completion have been paid. In the determination of the question whether there has been any such non-comQliance with the contract as to warrant the suspension. or annulment thereof, the decision of the City Council shall be binding on all parties to .the contract. The Contractor shall make his oven arrangements, and pay all expenses for additional area required by him outside of the limits of right of way unless otherwise provided in the Special Provisions. Dl BL.MTV.15 ~15® GGawrn Section 7. M1UREMENT AND PAYMENT (a) EXTPA AND FORCE ACCOUNT woRK. Extra work as hereinbefore defined, when ordered and accepted, shall be paid for under a written work order in accordance with the terms therein provided. Payment for extra work will be made at the unit price or lump sum previously agreed upon by the Contractor and the Engineer, or by force account. I f the work is done on force .account the Contractor shall receive the actual cost of all material furnished by him as shown by his paid vouchers, plus fifteen percent (15~) , and for all equipment and teams that are necessary he shall receive the current prices in the locality, which shall have been previ- ously determined and agreed to in writing by the Engineer and by the. Contractor, plus fifteen percent (15~) and for all labor that is necessary he shall receive the current prices in the locality, plus twenty percent (200} provided, however, that the City reserves the right to furnish such materials required as it deems expedient, and the Contractor shall have no claim for profit on the. cost of such materials. The price paid for labor shall include all payments unposed by State and Federal laws for all payments made to, or on behalf of , the workmen, other than actual wages. A11 extra work and force account shall be adjusted daily upon report sheets, prepared by the Engineer, furnished to the Contractor and signed by both parties, which daily reports shall thereafter be considered the true record of extra work or fence account work done. (b} PRC7GRESS PAYMENTS. The Contractor shall, once In each month., submit for approval, an estimate in writing to the City Engineer of the total amount of-work done by the Contractor, to the time of such estimate, and the - _ value thereof, The City of Bakprsf field shall retain -ten percent (10~) of such estimated value of the .work done as part security for the fulfillment of the contract by the Contractor, and shall monthly pay to the Contractor, while carrying on the work, the balance not retained, as .aforesaid, after deducting therefrom all previous. payments and all sums to be kept or retained under the provisions of the contract. No such estimate or payn~:nt shall. be required to be made, when in the judgment of the City Engineer the work is not proceeding in accordance with the provisions of the contract, or ~~h©n in his ju~gmvnt the total value of the wort{ done since the last estimate amounts to less than Three Hundred Dollars ($300.00). (c} FINAL PAST. The City Engineer shall., after the ..completion of - .the contract., make a final estimate of the amount of work done thereunder, and the value of such work, and the City of Dakersf field shall pay the entire sum so found to be due after deducting therefrom all previous payments and all amounts to be-kept and all amounts to be retained under the provisions of the contract. All prior partial estimates and payments shall be subject to correction in the final estimate and payment.. The final payment shall not be due and payable until the expiration of thirty (~0} days from the date of acceptance of the work by the.Cty Council. It is mutually agreed between the parties to the contract that no cer- of icate given or payments. made under .the contract, except the final certificate or final payment, shall be conclusive evidence of the performance of the contract, either wholly or in part, against any claim of the party of .the first part, and no payment shall be construed to be an acceptance of any defective work or improper materials. Specifications entitled "State of California, Department of Transportation, Standard Specifications, July, 1984,".insofar as the same may apply, which spec- ifications are hereinafter referred to as the. The City of Bakersfield, its mayor, council, officers, agents and employees shall be named as additional insureds under the policy which shall operate as primary insurance. If any part of the work is sublet, similar insurance shall be provided by or in behalf of the subcontractors to cover their operations. The insurance hereinbefore specified shall be carried until all work required to be performed under the terms of the contract is satisfactorily com- pleted as evidenced by the formal acceptance by the City. The Contractor shall furnish the Finance Department with one (1,) certif- icate .copy of each of the executed policies or a certif ied Certificate of Insurance. There extra work is required by said section it shall be paid for as provided in Section 7.~a) of these specifications. The Contractor will be required to work around public utility facilities and other improvements that are to remain in place within the construct.-ion area or that are to be relocated and relocation operations have not been completed. In accordance with the provisions of Section 7-1.11, "Preservation of Property," and 7--1.12, "R~sponsibility for Damage, " of the. Standard Specifications, the Contractor will.. be liable to owners of such facilities and improver~nts for .any damage or interference with service resulting from conducting his operations. The exact location. of underground facilities and irnproven~nts within the con- struction area shall be ascertained by the Contractor before using equipment that may damage such facilities or interfere with the services.- Other forces may be engaged in moving or removing utility facilities or other improvements or maintaining services or utilities. Thy Contractor shall cooperate w~,th such forces and conduct his operations in such a manner as to avoid any unnecessary delay or hindrance to the work being performed by other such forces. All of the work shown on the plans and included in these specifications that is located in the public streets in the Cit of Bakersfield shall be done in accordance with City Ordinances regulating Y the use of public streets within the City, except as otherwise provided herein. The Contractor shall inform himself as to all regulations and require- merits of the City `Engineer and Superintendent of Streets of the City of Bakersfield and shall conduct his operations in compliance therewith. (j) PERMITS ADD LICENSES, The Contractor shall procure all permits and licenses, pay all charges and fees and give all notices necessary and inci- dental to the due and lawful prosecution of the work. (k) MAINTAINING T]~AFFIC. Attention is directed to Sections 7-1..03, "Public Convenience," and 7-1.0~ "Public Safety," of the Standard Specifications. .The Contractor shall comply with the provisions of these sections and these special provisions. The Contractor shall furnish, install and maintain signs, lights, flags and other warning and safety devices when performing work which interferes with or endangers the safe movement of traffic on any street or highway. Signs, lights, flags..-and other warning and safety devices and their use shall conform to the requirements set forth in the current:"Manual of Traffic Controls - Warning signs, Lights, and Devices for Use in Performance of Work Upon Highways.," published by the :State of California, Department of Transportation. Application and use of devices shall be as specfizd and as directed ~y the Engineer. The Contractor shall keep the Bakersfield Fire Department informed at all tins as to the exact location and progress of the pork and shall notify them immediately of any streets impassable for fire fighting equipment. The full width of the traveled way shall be open for ..use. by public traffic on Saturdays, Sundays and designated legal holidays, before 8:30 A.M. and after 4:00 P.M. on weekdays, and when construction operations are not acti- vely in progress. Designated legal holidays are: January 1st, the third Monday in February, the last Monday. in May, July 4th, the first Monday in September, November 11th, Thanksgiving Day, and December 25th. ti~hen a designated legal holiday falls on a.Sunday, the following Monday shall be a designated legal holiday, ~~hen November 11th falls on a Saturday, the preceding Friday shall be a designated-legal holiday. SPECIAL PROVISIONS -Remove Traffic Stripes and Pavement Markings a) REMOVE TRAFFIC STRIPES AND PAVEMENT M~~RKINGS, Traffic stripes and pavement markings to be removed will be as shown on plans and as designated by the Engineer. Traffic stripes and pavement markings shall be removed to the fullest extent possible from the pavement by any method that does not materially damage the surface or texture of the pavement or surfacing. Where blast cleaning is used for the removal of painted traffic stripes and pavement markings, the area shall be shielded so that na material from the blasting operation is allowed to enter the area that is open to public traffic. Sand or other material deposited on the pavement as a result of removing traffic stripes and markings shall be ren~ved as the work progresses. Accumulations of sand or other material which might interfere with drainage or might constitute a hazard to traffic will not be permitted, Traffic stripes shall be removed before any change is made in the traffic pattern. Blast cleaning for removal of traffic stripes shall be feathered out to irregular and varying widths. Pavement markings shall be removed by blast cleaning a rectangular area, rather than-just lettering or markings, so the old n~;ssage cannot be identified.
