As we receive more specifics on the time frame and other details, we will keep you informed. -� With the retirement of Florn Core at the end of December, John Stinson will be helping out as the interim in the Water Department as we go about the process of finding a permanent department head. Similarly, with the resignation of Javier Lozano in Human Resources, Steve Teglia will be helping out until that position is filled. -� We received the enclosed letter from the Vineyards Association Board of Directors thanking and commending our Parks crews for the work and attention they have given to the streetscape bordering The Vineyards properties. -� The following reports are enclosed: • Neighborhood Stabilization Program Update. • Construction Division's weekly update of the roadway paving projects. • Streets Division's weekly work schedule. MORE ON THE BUDGET AND ECONOMY FRESNO, CA - The City of Fresno is facing a $28 million shortfall and the Mayor is proposing layoffs of 125 employees and 66 more unfilled include more than 100 non-sworn positions will be left vacant. Those cuts Positions employees will be forced to take five unpaid furlough days) by New Department.Year's Eve of this year. Firefighters will be forced to take 84 furlough hours and the Mayor is proposing the closure of two fire stations. A decision on the proposed cuts is slated for next week. Thank you so much. ---------------------------------------------------------- Dear Mayor Harvey Hall: It is with great pleasure that I inform you of GSA's award of American Recovery and Reinvestment Act funding for a project in your city. The Bakersfield Courthouse: A$21.88M contract for the design and construction of a 33,000 gross square feet modern courthouse was awarded on November 20, 2009 to Gilbane Building Company of San Jose, in partnership with NBBJ Architects. The Bakersfield Courthouse will house one Magistrate Court and chamber, district clerks office, U.S. Marshalls Service, U.S. Pretrial Services, and U.S. Probation. Through innovative design and new green technologies this new courthouse will save taxpayer dollars through the building's energy efficiency. By using green technologies, this project will create jobs in both traditional construction sectors and emerging green industries. The project is expected to achieve at least a LEED Silver certification. The Gilbane+NBBJ team will include local and regional consulting engineers and building specialists. Design work will begin this month and is expected to be completed by late spring of 2010. GSA was appropriated $5.5 billion under the Recovery Act to convert federal buildings into high-performance green buildings and build new energy-efficient federal buildings, courthouses, and land ports of entry. GSA's projects will deliver lasting progress toward modernizing the nation's infrastructure, reducing the federal government's consumption of energy and water, and increasing use of clean and renewable sources of energy. GSA welcomes this opportunity to contribute to our nation's economic recovery, address strategic energy goals and reinvest in our public buildings. Gonzales and his maintenance crews for their most recent work and attention given to the street cape bordering The Vineyards properties (Kroll-Gosford-Cam ino Media). Recently, I contacted your offices and was instructed to call Mr. Gonzales to discuss our needs. Mr. Gonzales returned my call immediately. Since that initial contact_we have talked via the telephone and in person regarding these needs. Mr. Gonzales met with me at our appointed time to review our requests. Within approximately two (2) hours Mr. Gonzales had his crew cleaning the areas that were discussed and noted that these areas would receive his attention. Furthermore, during a previous windstorm, a tree had fallen and damaged The Vineyards sign at the Camino Media entrance. Mr. Gonzales had the sign repaired within the next few days. Most recently I contacted Mr. Gonzales regarding some trenching work his crew was conducting along the street cape and common wall adjacent to Camino Media, He informed me that given a malfunction of the irrigation wiring, it would be necessary to replace to old wire with new wire to the irrigation clocks/valves. We are most pleased and grateful for the response by Mr. Gonzales and his crew to our requests for help and assistance. We have received several comments from residents regarding the presence of his crews and the good work that they are doing. We"thank" Mr. Gonzales, his crews and your office for the prompt response to our requests given the current budgetary constraints. Among the highlights: *Activity remains strong for NSP Down Payment Assistance. In addition to the 12 borrowers assisted, ten more files are in various stages of processing. *The Housing Authority has closed escrow and rehabilitated three foreclosed properties. An additional five properties are in escrow with offers pending on nine more. *Escrow is scheduled to close November 30 on the purchase of Pinewood Glen Retirement Community (formerly Castlewood). This will represent an additional $3.69 million in NSP funds expended. We expect the bottom courses of roadway reconstruction for this project to be complete in one to two weeks with the final lift of paving to be completed after the Christmas Holidays. The scheduled completion date of this project is February 10, 2010. AMERICAN RECOVERY AND REINVESTMENT ACT PROJECTS: Mt Vernon Ave -SR178 to University Avenue Paving operations on Mt. Vernon Ave. are complete. The contractor will be striping and reestablishing traffic detection loops at the traffic signals. This project is expected to be complete on December 10, 2009. Ashe Road -White Lane to Min Avenue Reconstruction operations are currently underway on the west side of the street with final paving being completed next week. Construction delineation and temporary traffic signage will be configured to allow one lane of traffic in each direction while this operation is being performed. This project is expected to be complete on December 7, 2009. Wilson Road -White Lane to Planz Road Reconstruction operations are currently underway on the west side of the street with final paving being completed this week. Construction delineation and temporary traffic signage will be configured to allow one lane of traffic in each direction while this operation is being performed. This project is expected to be complete on December 16, 2009. Hushes Lane -White Lane to Planz Road_ Reconstruction operations are currently underway on the west side of the street with final paving being completed this week. The ax fell hard on nearly every city department Thursday as Mayor Swearengin laid out budget cuts for the next 18 months. "Let's not kid ourselves,"said city manager Andy Souza."We are not going to get to these numbers without somebody being impacted.And I'm not trying to be callous because please,we have all lost a heckuva lot of sleep over this issue." Even after cutting$27 million this spring,some faulty projections on tax revenue and retirement costs leave the city in a huge hole. The numbers look like this: The city is losing$18.2 million in revenue this year. And it's paying an extra$9.6 million in expenses. Add it up,and you have$27.8 million to make up. "The forecasting that was done was fairly conservative,"said city council member Lee Brand."But it wasn't conservative enough." The cuts will be painful in ways it might take a while to notice as well. Four neighborhood centers will be shut down,city departments could shut down when employees take forced furloughs,and even tree trimming services will be reduced. CRUMLEY, ASSOCIATE CITY ATTORNEY Zj SUBJECT: CAR PARKING LIMIT ON PRIVATE PROPERTY COUNCIL REFERRAL NO. 139 F ncilmember Carson has requested staff to provide information regarding the limit of number of cars a person can park on private property. Question presented: Is there a limit on the number of cars that can be parked on private property? Short Answer: Yes and No. Generally, you may park an unlimited amount of functional cars on private property, provided the cars are parked on paved concrete. Discussion: The following factors limit private property parking: I. Parking on Unpaved Surfaces Under Bakersfield Municipal Code (BMC) § 10.32.160, a person may not park any vehicles on unpaved private property. This includes motor vehicle, trailer, camper, boat or other mobile equipment on front, side or backyards. Any parked cars in unpaved areas are subject to a twenty-four hour removal notice, then citation if not removed. II. Vehicles Displayed for Sale Under BMC § 10.32.150, no person shall park a vehicle displaying it for sale on private Property, unless the area has been licensed and zoned to transact that type of business. Any vehicles displayed for sale unlawfully are subject to twenty-four hour removal notice, then citation if not removed. III. Abandoned or Junk Vehicles Under BMC § 10.64, it is unlawful for any person to maintain an abandoned orjunk vehicle on private property where the vehicle is visible from any public street. An abandoned or junk vehicle is defined as a "vehicle or any major portion thereof which is incapable of movement under its own power and will remain so without major repair". HONORABLE MAYOR AND CITY COUNCIL November 23, 2009 Page 2 There are three main exceptions to a prohibition of a visible abandoned orjunk vehicle: 1) the vehicle is completely enclosed (within a garage) and not visible from the street; 2) the vehicle is parked in connection with the business of licensed dismantler, licensed vehicle dealer, a lawful junkyard, vehicle repair business or school training program; or, 3) an owner is allowed to maintain one junk vehicle parked on any paved surface of any single-family residence, so long as one or more persons are present and working on such vehicle or it is covered by a fitted opaque cover and no vehicle parts or tools are visible. The penalty for maintaining an abandoned or junk vehicle is an infraction, starting at $100 dollars for a first offense, rising $100 dollars for each additional offense within a one year period, and impoundment after four infractions. City Code Enforcement also has the ability to declare an abandoned vehicle a public nuisance subject to abatement and removal. There are no California Vehicle Code sections that limit the parking of cars on private property beyond that of the BMC.
