The exercise was a component of the comprehensive emergency planning process that the City and the County are developing. A full - scale exercise is being planned for 2010. First 5 approved the Recreation and Parks Department's $175,000 grant request for drowning prevention programs for the next three years. The goal of the programs would be to reduce the number of drownings from children ages 0 -4. The new programs will begin this summer and will also include educating parents on the importance of learning water safety skills. -� The beaver has been sighted again, and staff is taking precautions by wrapping more trees in the area just east of the Park at River Walk. The Water Resources Department was officially notified on December 1, 2009 by the State of California that the application for grant funding under the Local Levee Assistance Program (LLAP) in the amount of $341,550 was approved. The program requires the City to provide a 50% match or local contribution. The grant funds will reimburse the City up to 500 of the cost to complete a field investigation and engineering analysis of the Kern River Levees through Bakersfield in accordance with Federal Emergency Management Agency (FEMA) regulations. This year, more than ever, we've worked hard to provide our customers with the best entertainment experience. We've added more TV programming and more new and innovative features that they can only get with AT &T U- verse. These include: Exciting new features such as U -verse TV Multiview, which lets customers watch four channels at the same time, and Media Share, which gives customers the ability to stream photos and music from any qualified, networked PC to their TV. Continued improvements of our Total Home DVR service and better ways to manage their recordings from any Internet - connected computer or mobile phone. An increased number of HD channels at over 110 available HD channels. And even more exciting new additions are coming up this year. AT &T U -verse will just keep getting better. We are writing to inform you that the monthly price of some U -verse TV packages will be changing effective February 1, 2010. For customers who subscribed to their current package prior to February 1, 2009, the monthly price for U- family and U100 packages will increase from $44 to $49, U200 will increase from $59 to $64, U300 will increase from $79 to $82, and U400 will increase from $99 to $104. For customers who subscribed to their current package on or after February 1, 2009, the monthly price for U- family and U100 packages will increase from $49 to $54, U200 will increase from $64 to $67, U200 Latino will increase from $74 to $77, U300 will increase from $79 to 582, and $64 will increase from $109 to $112. In addition, the Filipino TV package will increase for all customers from $21 to $25 on February 1, 2010. If a customer is on a current AT &T U -verse TV pricing promotion, the promotional benefit will continue until the applicable promotion ends or expires. We expect the bottom courses of roadway reconstruction for this project to be complete next week with the final lift of paving to be completed after the Christmas Holidays. The scheduled completion date of this project is February 10, 2010. AMERICAN RECOVERY AND REINVESTMENT ACT PROJECTS: Mt Vernon Ave - SR178 to University Avenue Paving operations on Mt. Vernon Ave. are complete. Striping of the street is expected to be complete this week and traffic detection loop installation will be completed next week. This project is expected to be complete on December 10, 2009. Ashe Road - White Lane to Mina Avenue Paving operations will be completed this week. Once the paving is complete, the contractor will restore traffic to two lanes in each direction. The contractor will be striping and raising utilities to grade next week. This project is expected to be complete on December 14, 2009. Wilson Road - White Lane to Planz Road Paving operations on Wilson Road are complete. Traffic will be restored to two lanes in each direction by the end of this week. The contractor is scheduled to perform striping operations next week. This project is expected to be complete by December 16, 2009. Hughes Lane - White Lane to Planz Road Paving operations on Wilson Road are complete. Traffic will be restored to two lanes in each direction by the end of this week. The contractor is scheduled to perform striping operations next week. This project is expected to be complete by December 16, 2009. Wible Road - Pacheco Road to White Lane Work on this street has been postponed until after the Christmas holidays. SHE ALSO REQUESTED THAT STAFF REPAIR THE NUMEROUS POTHOLES ON "N" STREET BETWEEN 4T" STREET AND BRUNDAGE LANE. Upon inspection of Canterberry Drive staff found the pavement to be very rough with areas that are starting to get alligator cracks. The street is in need of reconstruction. Canterberry Drive is in an area that qualifies for Community Development Block Grant Funds (CDBG Funds). The Streets Division has submitted a request (FY 2010 -2011) for $500,000 for street improvements in the area between Belle Terrace Way to Brundage Lane, and Chester Avenue to Union Avenue. The request includes the reconstruction of Canterberry Drive. If CDBG funds cannot be obtained, other funding sources (Gas -Tax) will be used to reconstruct Canderberry Drive in the FY 2010 -2011. Beginning Monday, November 30, 2009, a street maintenance crew will be assigned to Patch potholes on "N" Street between 4th Street and Brundage Lane. In addition, potholes on the streets between Chester Avenue to "P" Street and 4th Street to Brundage Lane will be patched. G:\GROUPDAT1Referrals \2009 \11- 18\#140—Street Maintenance.doc • MM B A K E R S F I E L D CITY MANAGER'S OFFICE MEMORANDUM November 25, 2009 TO: Honorable Mayor and City Council FROM: Rick Kirkwood, Management Assistant SUBJECT: Citizen's Problems with a Former Landlord Council Referral No. 141 Councilmember Couch requested that staff contact Mr. Quirarte and provide suggestions on how to resolve problems with a former landlord. During the Public Statements portion of the November 18, 2009 City Council meeting, Jose Quirarte spoke about ongoing issues, which had been presented at previous City Council meetings, and raised new issues regarding his eviction from Village Lane Apartments and the landlord's refusal to return his deposit. The attached letter sent to Mr. Quirarte clarifies the roles and responsibilities of the City of Bakersfield in addressing and resolving his ongoing and latest issues. This is accomplished by identifying Mr. Quirarte's complaints and advice provided by staff as to how he could seek resolution. Since Mr. Quirarte is no longer a resident of the apartment complex, Code Enforcement is not able to take action on his complaints regarding the conditions of the unit. However, Code Enforcement has made contact with the new management at Village Lane Apartments and will visit them to answer any questions and provide information relevant to maintenance of the property. Mr. Quirarte is again advised to seek legal advice from Greater Bakersfield Legal Assistance regarding the issues that are civil matters. The letter provides contact information for the Volunteer Attorney Program which may be able to provide assistance. B A K F R S F I E L D November 25, 2009 Alan Tandy • City Manager Jose Quirarte 705 Lilac St. #A Bakersfield, CA 93308 Dear Mr. Quirarte; Thank you for raising your concerns regarding problems with the landlord of Village Lane Apartments (5101 Marsha Street) at the last City Council meeting. At the request of Councilmembers Couch and Sullivan, the purpose of this letter is to explain the roles and responsibilities of the City of Bakersfield in addressing and resolving your past and present issues. You may recall that the issues you raised during City Council meetings in December 2007 and February 2008 were promptly referred to staff during each meeting. You requested the City's assistance with the following (in bold) and staff from the City Manager's and City Attorney's offices discussed them with you during those meetings and provided the following responses (in italics): 1. Release of your car from a towing company before. a pending lien sale - This issue was a civil matter that the City could not provide assistance to resolve. You were advised to obtain legal advice from Greater Bakersfield Legal Assistance (GBLA); 2. Payment of hospital bills resulting from a spider bite - This issue was a civil matter that the City could not provide assistance to resolve. You were advised to obtain legal advice from GBLA; 3. Repair of broken heater inside the apartment and other needed repairs which the landlord was neglecting, as well as other abandoned vehicles in the parking lots - You were advised to request an inspection of the property by Code Enforcement, which was also requested by staff following the meetings; and, 4. Landlord's retaliation due to complaints filed with Section 8 - You were advised to contact the City of Bakersfield's Fair Housing coordinator to discuss related issues and receive further advice on how to proceed. In a letter, dated February 21, 2008, the City Manager's Office relayed to you that Code Enforcement had made contact and was working with Fran Elam and Billy Becks, the maintenance project manager, to address any issues at Village Lane Apartments. Upon your request, the seven parking lots at the apartment complex were also inspected for abandoned junk vehicles. At the November 18, 2009 City Council meeting you raised a couple new issues and requested the City Council's help to resolve issues related to the following: I . Your eviction from the Village Lane Apartments; 2. The landlord's refusal to return to your deposit; and, 3. A black widow /roach infestation and other needed repairs. The best course of action would be to seek legal advice from GBLA by calling (661) 325 -5943. GBLA offers the Volunteer Attorney Program (VAP) which may be of service to you. For more information about this program, please contact VAP Coordinator Carol Bracy, Esq. at (66 1) 334 -4662. With regards to the third issue, Code Enforcement responded to numerous complaints between 2002 and 2008 at Village Lane Apartments and there are currently no open complaints. Upon Code Enforcement's visual inspection of the outside areas, it was determined that there were no visible life safety issues or signs of blight in the apartment complex. The only complaint received thus far in 2009 was from you regarding the conditions inside your previous unit, which was addressed at the counter at the Building Division by one of our Code Enforcement Officers. At that time, it was explained that action will only be taken upon receipt of a complaint from a current tenant of that unit. Since you are no longer a tenant, the complaint is considered to be a civil issue as it may be relevant to other civil issues you have with Village Lane Apartments. Code Enforcement has recently made contact with the new management of the complex and will visit them to answer any questions and provide information about programs and state laws relevant to the maintenance of the property. You also commented that the City Council is responsible for resolving the issues at hand since the City issued a Business License to Village Lane Apartments. The Bakersfield Municipal Code (BMC §5.02.020) expressly states that a Business License is issued "...solely to raise revenue for municipal purposes, and is not intended for regulation ". Therefore, the City Council cannot resolve these issues through the Business License process. The City will, however, attempt to resolve as many issues as Possible through the processes it has in place (e.g., referral to Code Enforcement). The attached letter was sent this week to Rebecca Moore, Executive Officer of the Local Agency Formation Commission (LAFCo), regarding the purpose behind the City sharing conceptual exhibits and maps with LAFCo during the Metropolitan Bakersfield General Plan Update. Councilmember Couch requested that staff write a letter clarifying the purpose behind the City sharing conceptual exhibits and maps with the Local Agency Formation Commission (LAFCo) during the MBGP Update. The process to update the MBGP began in May 2007. Input was solicited during a series of town hall meetings and surveys to identify issues and potential solutions to be considered during the update. A report was compiled, known as the "Existing Conditions, Constraints and Opportunities Report ", which highlights issues, challenges, and recommended changes to the existing General Plan. The content of this report is considered a guide to creating and updating goals, policies, and implementing actions in the MBGP. Multiple documents have been developed, such as exhibits and maps, which illustrate a plethora of information. Over the next year, many of these documents will likely be revised several times as information is added and removed. Once these documents are integrated into an updated MBGP adopted by the City and County, decision makers from all local agencies will have a solid foundation from which to make decisions. The City is committed to its efforts to keep interested local agencies, including LAFCo, informed and at times will share information as it is being developed. It is important to note that until the updated MBGP is adopted, local agencies should not apply or rely upon such conceptual information when making decisions. This information will be refined over time and, when it is adopted in its final form, will produce a valuable policy tool which will serve to guide such decisions.
